The applicant seeks primary plat approval for 2 residential lots on 0.53 acres. Also, the following waiver is
requested from the Subdivision Control Ordinance:

The site is located at 420 First Ave NW (on the Monon Greenway) and is zoned R- 2/Residence within the
Character Subarea of the Old Town Overlay. Filed by Jeff King, owner.
The applicant seeks approval to create a minor subdivision with 2 lots on 0.53 acres. The subdivision control
ordinance waiver request is similar to one the Commission reviewed and approved a few months ago, where the
minimum 50 -ft lot width of the back lot is not being met. However, in this case, there is a 10 -ft wide alley that
currently exists along the north property line of the property, which will be improved/paved, that will serve this
back lot.
The proposed new house on the back lot will go through administrative review and approval of its location and
architecture with the Site Plan Design Review (SDR) application, since this site does lie within the Old Town
Overlay District.
There is a legal drain easement that runs through the back portion of the property, which limits where a new
house could be placed.
Currently, the petitioner plans to plat a 24 -ft rear yard building setback on the back lot, in order to preserve the
trees along the Monon Greenway; this building setback is greater than the minimum 5 -ft rear yard building
setback allowed by the Old Town Overlay District (Character Subarea) regulations of the Zoning Ordinance.

Recommendation:
The Dept. of Community Services (DOCS) recommends that the Commission votes to suspend its rules of
procedure and vote to approve these items. (Or, the Commission can send this item to the Nov. 1 Subdivision
Committee meeting for further review discussion.)
Note: Findings of Fact sheets must be signed by the Commission. Petitioner should distribute them at the
meeting.
