Our comments have been satisfactorily addressed. The outstanding comments are technical in nature and can be resolved as the project moves forward to construction. Docket No. 11050013 Z: Silvara PUD. Our comments have been satisfactorily addressed. `Docket No. 11080014 PP: 420 First Ave NW PP: We issued comments and the petitioner has responded. The Department has no exception with the Primary Plat, in general. All comments have been satisfactorily addressed with the exception cf the following: 2. We need to check the right -of -way requirements for 1st Avenue NW and the alley per the current Thoroughfare Plan. The existing right -of -way for 1 Avenue NW is consistent with the Thoroughfare Plan for a Minor Residential Street. No additional right -of -way will be required across this frontage. Section 6.03.08 of the subdivision control ordinance states that platted alleys shall be 20 feet in width. Section 6.03.25 states that residential alleys shall be 12 feet in width located within 16 foot rights -of -way. The Department suggests that an additional 3 feet of right -of -way be platted with this development. Due to the fact that the full 16 feet right -of -way is not likely to be provided when the rear lot is improved, the Department will work with the petitioner on the final pavement width of the alley when construction plans are developed. 5. e plan does not provide the easement required by the subdivision control ordinance. The Department rescinds this comment. Section 6.06.01 indicates that certain easemen s are required when alleys are not provided. An alley is provided in this case. 7 Please provide an alley pavement section per my ema This pavement section shall be added to the Primary Plat. 8. Pease provide a drainage pan when developed. We need to check for code violations and to ensure that the off site drainage 's accommodated through the site and to check the drainage of the alley improvements. The Department assumes that the alley will be constructed at existing grade such that a pipe under the al'ey is not required. The petitioner has indicated that the existing grades will not be altered with development. The Department will need to verify the final grading when the back lot is developed. 16. The p.at needs to establish "do not disturb" areas to preserve areas from future development that would otherwise exceed t maximum disturbed area. Future swimming pools, patios, etc, would be considered land disturbance. The existing land disturbance area shall be established and the maximum remaining land disturbance shall be established and ..cluded in the plat and/or covenants. The Department requests that these items be included in the secondary plat as well as the restrictive covenants (if restrictive covenants are being developed). Gary R. Alley Paving As there is no pending start date for a home construction on the the second lot proposed by this plat, I am requesting that the alley improvements not be required until a building permit for a new home is pulled, and then installed prior to a final inspection /CO on the home. It does not make good sense to put in a paved roadway while home construction is being performed. I trust you will agree. 8. The lot is already 'developed', and therefore drainage is in place. And given the alley will be constructed at existing grade, there will be no change in the storm water drainage already in place. 10. When responding to this comment yesterday, I neglected to reference a conversation I had with John Thomas, Storm Water Administrator. We talked on August 24, 2011, and he agreed at that time, there would be no development drainage changes /additions, and that any construction phase erosion and sediment control plan would be administered through the building permit requirements. This should clear up /address your comments, except that I still need clarification on your 2 and #5 comments. When we spoke on August 17, 2011, you mentioned that you would not have an issue with reducing the easement to 15' on the west side of the drain, but that the reduction would not be granted until after the Primary Plat was approved. Gary Duncan, Carmel Engineering, has stated via email that the plat would not be approved until the legal drain easement reduction is approved. As you will recall, we have already been granted a reduction to 25' on the east side of the drain. However, given we now have accurate data as to the location of the drain, I would ask that the easement be reduced to 15' on either side of the center line. As this being said, would you please issue the letter addressed to the Plan Commission that we discussed on August 17, 2011, stating you do not have a problem with the requested easement reduction, and that said reduction will be granted, pursuant to the process, once the Plat has been approved? Caramel Utilities stated .site was perfect for hook -up to the main sewer line running beneath the alley, and water connection at 1st Ave. NW; Cable and phone are both available along the alley. N one has mentioned any road cuts being required. 7. Please provide an alley pavement section per my email. Scar evor will provide. 8. Please provide a drainage plan when developed. You can name the subdivision plat whatever you want. Justin Moffett named his (just up the road) First and Sixth NW Subdivision. I have sent letter on 3 of the projects. We have no issues on Millennium Foods. Are fine with HealthSouth moving forward as presented, as it is part of the overall. The Bridges has some drainage issues that we are working through with them, so that is all up in the air at the moment. The 420 First Ave NW PP does not have a letter. We were fine with it at first, but the change that pushed it east has raised some red flags for us. I told Jeff I want to know exactly where the drain is before we would agree the the 15 feet easement reduction. I think we can get this worked out, but it sounds like the easement will change from where it is currently shown. Also attached is a Tree Preservation Detail that should be added to the site plan and implemented to preserve trees. I have attached a sign that you may want to use to post the area, it can be attached to the fencing in most cases not required, but helpfu'. 3.
