Carlson 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: It is merely a roof over our patio. It takes no additional property at the back of our house on our private property. Plans call for this roof to be securely attached to our house. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: It does not encroach on any property beyond the existing patio. It will improve the looks of the back of our house and in the long run will enhance the value of the adjacent property due to the permanent and co- ordinated look of the structure 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: _Our patio furniture is constantly getting dirty due to the droppings from the tree canopy. The direct line of vision between our neighbor's bedroom and our kitchen eating area wills continue to exist .The morning sun blinds people at our kitchen table and the hardwood flooring will continue to bleach out by the direct sunlight through our patio door DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. Page 10 fdeneme development standards vanance 2012 second copy d. rev 1228,2011 Statement of Variance Docket No. 12040024 V Chapter 7.04.03D: Construct a roof over our Patio Our Patio extends twelve feet towards our property line, is sixteen feet wide and the far edge is 10 feet from our property line. The city ordinance for our property states that the minimum yard setback is 20 feet. We are not extending any closer to the property line than the existing patio. Statement of Support When our home was built in 1979 a cement patio was constructed with a foundation so that later a screened -in porch or just a roof could be built over it. At this time we wish to build just a roof over the patio to protect it from the runoff from a large Tulip Tree, as well as all the droppings from the Tulip Tree, (flower petals, the empty buds, the little thorns, etc). The patio roof would also block the direct line of site from our kitchen eating area to our neighbor's bedroom as well as block the direct sunlight at our breakfast table.
