865 IAC 1-12-1
In accordance with et seq., the following observations and opinions are submitted regarding the causes and the amounts
of uncertainty in the locations of the lines and corners found or established during this survey as a result of:
A.)availability and condition of reference monuments,
B.)occupation or possession lines,
C.)clarity or ambiguity of the record descriptions for the site and its adjoiners, and
D.)the relative positional accuracy of the measurement.
A.Parcel 1 is controlled by the south line of the Southeast Quarter of the Northwest Quarter of Section 7, Township 17 North, Range 3
East and the old west right-of-way line of Michigan Road.
The right-of-way of Michigan Road was established based on a brass plug found at the P.I. of a curve in the centerline of the road, a
concrete monument found near the southwest corner of Lot 1, Block 4, Mayflower Park (Parcel 1 of this survey) and several
right-of-way monuments found in the area. Due to variances in the right-of-way monuments, there is 0.4 of a foot of uncertainty
with the location of the right-of-way.
The following monuments were found or re-established marking the corners common to said Northwest Quarter. Unless otherwise
noted, there is negligible uncertainty associated with the locations of these corners.
Northwest corner: Harrison Monument found per County Surveyor records.
Northeast corner: Railroad Spike found six inches below grade per County Surveyor records.
found at this corner. The calculated position of that stone was used for this survey. The location of the calculated stone is
approximatey eight feet north of a stone refenced on a Route Survey Plat (Instrument Number 19980201475) prepared in
on the location of the right-of-way grants.
Southwest corner: Nothing found. This location is under water. The corner was calculated based on the location of the southeast
corner of the Northeast Quarter of Section 12, Township 17 North, Range 2 East.
Mayflower park (west adjoiner to Block 4) and the southwest corner of Lot 2 in Block 4. These two rebars were used to establish
the west line of Block 4. Two other rebars (no caps) were found along the line. One is 0.7 of a foot west and 0.3 of a foot north of
the southwest corner of Lot 1. The other is 1.4 feet west and 0.9 of a foot north of the northwest corner of Lot 1. A rebar with no
cap was found 1.6 feet west and 0.6 of a foot north of the angle point on the north line of Lot 1. A rebar with no cap was found 1.1
right-of-way line of Michigan Road 1.2 feet southeast of the southeast corner of Lot 1.
B.Unless otherwise noted, there is no physical evidence of occupation or possession along the boundary lines of the subject parcel.
276.45' Line: A chain link fence ranges from 1.4 to 2.8 feet south of the line near the west end. A second chain link fence ranges
from 1.7 to 2.6 feet south of the line near the east end. A tree is on line near the east end.
77.99' Line: A chaink link fence ranges from 2.9 to 7.6 feet north of the line.
503.67' Line: Utility poles and overhead utility wires range from 1.9 to 4.2 feet south of the line. A chaink link fence ranges from
on line to 4.2 feet north of the line. A tree is on line.
190.11' Line: A chain link fence ranges from 2.0 to 3.2 feet west of the line.
135.02' Line: A chain link fence ranges from 0.7 of a foot west to 0.9 of a foot east of the line. A second chain link fence ragnes
from 2.8 to 6.0 feet east of the line. The fences are in the area of the 1.8 to 3.9-foot deed overlap. The second fence is
representative of the east line of Block 5 of Mayflower Park.
C.The record descriptions for the site and its adjoiners were obtained from the office of the Recorder of Marion County (the latest
research date was February 15, 2012). The record descriptions for the adjoiners were mathematically retraced to disclose any gaps
and/or overlaps between the boundary lines of the site and its adjoiners. The following observations are made as a result of this
retracement:
PARCEL 1 (C & E Rental Parcel)
The parcel is controlled by the old right-of-way line of Michigan Road and the south line of the Southeast Quarter of the Northwest
Quarter.
The legal description doesn't close by 8.06 feet. The last course calls to the point of beginning which is on the old right-of-way of
Michigan Road, but the deed distance is short and doesn't reach the right-of-way line. I extended the line to intersect the
right-of-way line.
There is a triangular-shaped gap along the north line of the parcel that is 0.5 of a foot wide at the west end. Both the north adjoiner
and the subject parcel are controlled by the old right-of-way line of Michigan Road. However, the angle from the right-of-way line
for the north line of the subject and the south line of the adjoiner do not match which creates the gap.
There is a gap along the west line of the parcel that ranges from 1.8 to 3.9 feet wide. The subject parcel is described from the old
right-of-way line and the deed distance was held. The west adjoiner is a plat that was established by found monuments which fall
east of the west line of the subject parcel. The description for the subject parcel does not contain controlling calls to the plat, or vice
versa.
PARCEL 2 (Lot 1 - Block 4)
This parcel is part of the Mayflower Park Subdivision (Block 4). The south adjoiner is Lot 2 of Block 4. The west adjoiner is Block
5 of the original subdivision. The location of the subdivision is controlled by monuments found in the field at the northeast corner
of Block 5 and the southwest corner of Lot 2.
There are no gaps or overlaps between Lot 1, Lot 2 or Block 5. There is a deed gap of 0.8 of a foot between Parcel 1 and Parcel 2 at
the northwest corner of Parcel 2. There is an overlap of 0.3 of a foot between the two parcels at the northeast corner of Parcel 2.
The legal description for Parcel 1 does not contain controlling calls to Parcel 2, or vice versa.
Right-of-Way Grants
There is approximately six feet of uncertainty with the north/south location of the right-of-way grants along the east line of the
subject parcel. The grants are described from the south line of the Southeast Quarter of the Northwest Quarter of Section 7. The
Route Survey Plat (Instrument Number 19980201475) recorded in conjuction with the right-of-way grants indicates that a stone was
used at the southeast corner of said Quarter-Quarter Section. We could not find the stone during this survey. Based on other
monumentation found the location of the stone falls eight feet south of the location used for the same corner on this survey. At the
southeast corner of the subject parcel this discrepancy causes the line used for the grants to be about six feet south of the line used in
this survey. This means that the right-of-way lines (in the north/south direction) may not be where they were intended in relation to
the boundary lines of the subject parcel, but they do match the road improvements and right-of-way markers found along the road.
This also creates a situation where the owner at the time of the grant may have sold about six feet of property that they did not own.
For instance, at the northeast corner of the C&E parcel, the south line of the adoiner's grant falls six feet south of the north line of the
C&E parcel.
D.The relative positional accuracy (uncertainty due to random errors in measurement) of any point on the survey relative to any other
point on the survey at the ninety-five percent (95%) confidence level is within the specifications for an Urban Survey (0.07 feet + 50
ppm) as defined in 865 IAC 1-12-7.
As a result of the above observations, it is my opinion that the uncertainties in the locations of the lines and corners established during this
survey are as follows:
variances
Due to in reference monuments: 8.0 feet;
inconsistencies
Due to
discrepancies
Due to in the record descriptions: 3.9 feet; and
random errors
Due to in measurement: within the specifications for an Urban Survey (0.07 feet + 50 ppm) as defined in 865 IAC
1-12-7.
