The applicant seeks approval to rezone properties which abut the Monon Greenway north of First Street NW, to include them in the Monon Greenway Overlay Zone. This overlay district is super- imposed over the primary zoning districts, and its regulations shall supersede those of the primary zoning districts. The properties which are included in the rezone consist of properties which abut the Monon Greenway from 146` Street to First Street NW. Filed by the Carmel Dept. of Community Services on behalf of the Carmel Plan Commission. 4. Docket No. 11080013 OA: Monon Overlay Ordinance Amendment. The applicant seeks approval to amend Chapter 23H: Monon Greenway Overlay Zone of the Zoning Ordinance in order to modify the regulations as need be during the rezoning of the affected parcels in the Natural Section North. Filed by the Carmel Dept. of Community Services on behalf of the Carmel Plan Commission. This item has been at committee for several meetings and the department believes that the modifications made to the original rezone proposal represent a suitabie solution to the concerns raised by many of the property owners while still addressing the goal of maintaining the current character of the Monon Greenway. Below are some of the main changes made at the committee level: 1. Rezone Boundary. The rezone boundary was adjusted to 88' from the centerline to set the distance concurrent with the largest required setback instead of following the parcel lines. 2. Existing PUDs will continue to follow the requirements of the approved PUD Ordinance, thereby eliminating conflicts for previously approved projects such as Traditions on the Monon, Village Green and Cobblestone Commons 3. Exemptions have been established for structures on existing lots so property owners, primarily existing residences, may continue under their existing zoning. 4. Restrictions on Accessory Buildings were removed and replaced with a reference to the existing zoning ordinance section for Accessory Buildings New Principal Buildings would need to be 88' feet from the Monon Centerline (55' from the 33' Greenway Easement). This would only apply to new subdivisions, rezones, or plat amendments resulting in additional Principal Buildings. Please view the January 6` memo and info packet for more detail. Recommendation The Dept. of Community Services (DOGS) recommends that the Plan Commission forward these items on to the City Council with a favorable recommendation.
