DEFAULT JUDGMENT Come now the Plaintiffs, and hereby move the Court to enter a default judgment against the Defendant of Plaintiffs' Complaint. And it appearing to the satisfaction of the Court that Defendant, Adam R. Taylor, was duly served with due process by personal service through Hamilton County Sheriff s Department more than twenty (20) days prior to the filing of said motion, and that such service is sufficient to confer in personam jurisdiction over Defendant and in rem jurisdiction over the property sought to be forfeited herein, and that Adam R. Taylor has failed to appear, answer or otherwise respond to the complaint in this cause, either personally or by a representative. The Court finds that it has jurisdiction over subject matter of this action pursuant to Indiana Code 34- 24 -1 -3. And this cause being now submitted to the court for a finding, the court being duly advised in the premises, finds that the Plaintiffs are entitled to an order of default judgment against Adam R. Taylor. It is therefore ORDERED, ADJUDGED AND DECREED by the Court that a judgment by default be granted and forfeiture of $38,290.00 is declared. The sum of $38,290.00 is forfeited and of that amount, the sum of $25,526.67 hall be paid to the Hamilton/Boone County Drug Task Force as costs of law enforcement, the sum of $12,763.33 shall be paid to counsel for Plaintiffs, Bruce E. Petit. The Hamilton County Drug Task Force and/or Hamilton County Sheriffs Department is ordered to so release and disburse said funds. It is further ORDERED, ADJUDGED AND DECREED by the court that a judgment by default be granted and forfeiture of a Bersa .380 Semi Automatic Handgun, Serial No. 550706, and such is declared. The Bersa .380 Semi Automatic Handgun, Serial No. 550706 forfeited herein shall become the property of the Hamilton/Boone County Drug Task Force and shall be delivered to the Hamilton/Boone County Drug Task Force for use by such seizing agency as it in its sole discretion shall determine appropriate for a period of time not to exceed three years. After the expiration of said three year period or at such earlier time as seizing agency shall determine, said gun shall be sold by the Sheriff of Hamilton County pursuant to Indiana Code 34- 24 -1 -6. The Sheriff of Hamilton County shall forward the proceeds of said sale to the Hamilton/Boone County Drug Task Force in satisfaction of its costs of law enforcement associated with this and related criminal prosecution. The sum of one -third of the fair market value of the aforementioned Bersa .380 Semi Automatic Handgun, Serial No. 550706, shall be paid to Bruce E. Petit, attorney for Plaintiffs as attorney's fees if said Hamilton/Boone County Drug Task Force determines they will exercise their discretion to use the gun. If the e Hamilton/Boone County Drug Task Force determines that the gun shall be sold at Sheriffs auction pursuant to Indiana Code 34- 24 -1 -6, the sum of one -third of that sale at auction less expenses shall be paid to Bruce E. Petit, attorney for Plaintiffs as attorney's fees. The Hamilton/Boone County Drug Task Force and/or Hamilton County Sheriffs Department is so ordered to disburse said funds. It is further ORDERED, ADJUDGED AND DECREED by the Court that a judgment by default be granted and forfeiture of a 2010 Ford F 150 Pickup Truck, VIN: 1FTFW1EV6AFD52386, and such is declared. The 2010 Ford F150 Pickup Truck, VIN: 1FTFW1EV6AFD52386, forfeited herein shall become the property of the Hamilton/Boone County Drug Task Force and shall be delivered to the Hamilton/Boone County Drug Task Force for use by such seizing agency as it in its sole discretion shall determine appropriate for a period of time not to exceed three years subject to lien held by Ford Motor Credit Company originally reported in the amount of $4,853.13 which shall be paid by the Hamilton/Boone County Drug Task Force if they choose to retain said vehicle. After the expiration of said three year period, or at such earlier time as said seizing agency shall determine, said vehicle shall be sold at auction pursuant to Ind. Code 34- 24 -1 -6. The proceeds of said sale shall be delivered to the Hamilton/Boone County Drug Task Force in satisfaction of costs of law enforcement associated with this and the related criminal prosecution. The sum of one -third of the fair market value of the aforementioned 2010 Ford F150 Pickup Truck, VIN: 1 FTFW 1 EV6AFD523 86, shall be paid to Bruce E. Petit, attorney for Plaintiffs as attorney's fees if the Hamilton/Boone County Drug Task Force determines that they will exercise their discretion to use the vehicle. If the Hamilton/Boone County Drug Task Force determines that said vehicle shall be sold at Sheriff's auction pursuant to Ind Code 34- 24 -1 -6, the sum of one -third of that sale at auction less expenses shall be paid to Bruce E. Petit, attorney for Plaintiffs' as attorney's fees.
