Reis Direct Dial: (317) 238 -6293 E- mail: preis@kdlegal.com Re: Parking for Proposed Restaurant in "The Corner" Retail Center, 116 Street and Westfield Boulevard This will confirm and memorialize my meeting and conversation with Angie yesterday concerning parking for the proposed restaurant to be located in The Corner retail center. BACKGROUND: The Corner is an existing retail center that was developed prior to the establishment of the current parking development standards under the Carmel Zoning Ordinance. A variety and mix of tenants have been doing business in the center over the years including restaurants, grocery stores, banks and other service and retail merchants. On June 5, 2012, the Special Studies Committee of the Carmel Plan Commission approved an ADLS amendment petition to allow a new restaurant to be located in the space previously used and occupied by the Bike Line bicycle shop and the Mangia! Restaurant. Based upon the current mix of tenants in the center, there are not enough parking spaces to meet the current parking requirements under the Carmel Zoning Ordinance with the addition of the new restaurant. Up until November 14, 2011, there were two restaurants operating in the center and parking was adequate to serve the customers and patrons of both the retail tenants and the restaurants. DETERMINATION AND AGREEMENT: Based upon the facts outlined above, it was determined that the use of space in the center for a second restaurant has not been discontinued for more than one (1) year which would require, pursuant to Section 28.01.05 of the Carmel Zoning Ordinance, that either a variance be obtained to allow for a lower number of parking spaces or that additional parking spaces be added to meet the current parking requirements. Therefore, the reduced number of parking spaces will be allowed to continue as a legal non conforming development standard for a restaurant use. Accordingly, a bike rack will be installed as shown on the attached site plan to provide for four (4) bicycle spaces in accordance with the Carmel Zoning Ordinance for the new restaurant.
