The comments from the City review have been satisfactorily addressed with the following exceptions: 1. Comment 10 of a letter dated March 2, 2009, comment 3 of letter dated May 13, 2009, and comment 1 of letter dated September 23, 2010 and a letter dated February 13, 2012: Compliance with the Thoroughfare Plan includes construction of the improvements prescribed by the Thoroughfare Plan across the frontage controlled by the development (including sections with no access). Typically, developers provide a commitment equal to the value to construct these improvements for deposit into the City's non- reverting thoroughfare fund. The City has established a value of $130 /If of frontage for the construction of the improvements stipulated by the Thoroughfare Plan. Based on this cost, the commitment would equal to approximately $36,000for the frontage of the development. Construction of any portion of the improvements stipulated by the Thoroughfare Plan would be credited against the commitment (such as the multi -use path). The commitment amount is based on the developer's costs of construction as approved by the city. To my knowledge, this commitment has not been discussed. 2. Comment 26 of a letter dated March 2, 2009, comment 4 of letter dated May 13, 2009, comment 5 of a letter dated November 16. 2009, comment 2 of a letter dated September 23, 2010 and a letter dated February 13, 2012: If any portions of the existing east -west and north -south alleys are to be vacated, the vacation process must first be presented to the BPWS for recommendation. Final approval of vacated right of way is under the jurisdiction of City Council. Vacation of Right -of -Way procedures are available on request. Please advise as to the status of this right -of -way vacation. The correct documents have not been received by the Department of Engineering for recommendation to the Board of Public Works. Please see the "Vacation of Public Right of Way Procedure" on the Engineering Department's website. We understand this is in the process. 3 Comment 41(d) of a letter dated March 2, 2009 and comment 4 of a letter dated September 23, 2010: Provide the Minimum Flood Protection Grade (MFPG) and Minimum Lowest Adjacent Grade (MLAG) for proposed structures. These elevations are to be based on the local flooding source for this site. Additionally, provide the City's definitions for MFPG and MLAG on the construction plans. These may be obtained from this office upon request. Provide the "off site" 100 -year Flood Route for this project. The MLAG and MFPG were provided for the proposed structures. What is the basis of the MLAG and why is it not the same as the MFPG in this case? Is this based on the maximum water surface elevation on -site. inlets plugged, during 100 -year? Note 16 on C102, regarding the MLAG, states: "This elevation shall be set a minimum of 2 feet above the emergency spillway elevation unless a waiver is requested. A waiver has been requested for this project." In establishing the 100 -year flood storage elevation, did you account for storage in the aggregate base of the parking lot? 5. The Engineering Department does not recommend the construction of basements adjacent to an underground detention facility. 6. What is the maximum water surface elevation on site during the 100 -year storm, with inlets plugged? If you have questions, please contact me at 571 -2441. Sincerely, has no record of this waiver being previously requested or approved. More detail regarding the MLAG, MFPG, flood route, and 100 -year elevation of detention will be required for the Engineering Department to review this waiver. There is no record of a request for the variance to allow the MFPG and MLAG to be less than 2 feet above the emergency spillway elevation. By definition, the MFPG shall be set 2 feet above the 100 -year elevation of the detention system. By definition, the MLAG shall be set 2 feet above the 100 -year emergency spillway elevation. A variance to allow these elevations to be less than 2 feet above the corresponding 100 -year elevations will not be supported by the Engineering Department. If a variance is needed, it would be a variance to allow the buildings to be built less than the established MFPG and /or the MLAG. R. D P.E.
