Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the June 16, 2004 TAC meeting. Please feel free to copy and distribute this e-

Central Park~
Sanitary sewer construction plans need to be submitted for review by the District's
engineers. A District project application must also be submitted. Please submit two sets
of plans to the District for review. An IDEM construction permit may be needed: if so,
all IDEM submittal information should be provided following the District's plan review.
Townhomes at Guilford
Sanitary sewer construction plans need to be submitted for review by the District's
engineers. A District project application must also be submitted. Please submit two sets
of plans to the District for review. An IDEM construction permit may be needed: if so,
all IDEM submittal information should be provided following the District's plan review.
Stanford Park, Sec 3 - Amenity Area
Building permit should NOT be issued be issued unless the District has issued a connection
permit and any work on the sewer connection will require a District permit and inspection.

Re' Park Impact Fees
Pursuant to a request by the Carmel-Clay Board of Parks and Recreation, the Carmel Common Council
directed DOCS to review the appropriateness of the Park Impact Fee, the Impact Zone and the Zone
Improvement Plan, and, if deemed necessary, to prepare a proposed replacement impact fee ordinance.
Attached for consideration at your May 18th meeting are a revised Zone Improvement Plan containing
an analysis supporting a fee increase, and a proposed replacement Park Impact Fee Ordinance. As most
of you know, Park Impact Fees are fees imposed on new residential development by the City of
Carmel within all of Clay Township to provide funds for new parks and recreational facilities
necessitated by new residential development. State law has authorized cities (not townships) to impose
impact fees. In November of 1996, the City of Carmel adopted a Park Impact Fee of $84.00 per
dwelling unit. In December of 2000, the Council increased the fee to $527.00. State law provides that
the life of an Impact Fee Ordinance is 5 years and allows the Council to review its appropriateness
from time to time.
The process used to amend the fee is generally the same as that followed for any zoning ordinance. By
statute an Impact Fee Advisory Committee is established and makes a recommendation to the Plan
Commission. The Plan Commission holds a public hearing on both the Zone Improvement Plan and
the Ordinance and makes a recommendation to the Common Council. In Carmel, the Council then
holds another public heating on the Plan and the Ordinance and adopts a fee amount. As the Council is
the ultimate decision maker with regard to the Plan and the Ordinance and will hold its own public
heating and will receive all information about the proposed fee update, the DOCS and Park Staffs hope
that the Plan Commission will agree to suspend its roles in order to hold the public hearing on both
documents simultaneously and forego sending the documents on to committee. This would allow the
Council to start its consideration as early as possible-and allow implementation of any fee increase
sooner rather than later. By statute, the City must delay any increase in an impact fee by at least six
months.
The Impact Fee Advisory Committee met on May 6, 2004 and received information supporting an
increase in the park impact fee from $527.00 to $2,400.00. The Impact Fee Advisory Committee may
meet a second time prior to May 18.
The attached Zone Improvement Plan draft supports an increase of the Park Impact Fee from $527.00
to a maximum of $2,400.00. Like today's Park Impact Fee, the proposed fee would be paid by those
applying for residential building permits during the effective dates of the increased fee. Since only new
residential development pays the fee, it is important to make sure that newcomers are not beating more
than their fair share. The key legal terms employed by the Plan to guarantee fairness to feepayers are
the "Current Level of Service" and the "Community Level of Service." The Current Level of Service is
the quantitative measure of service provided by existing infrastructure to support existing
development. The calculation of the Current Level of Service is set forth on page 12 of the Zone
Improvement Plan. The Community Level of Service is the quantitative measure of service that the
City determines will be appropriate in the future, the calculation for which is set forth on pages 12 and
13 of the Zone Improvement Plan.

Pursuant to a request by the Carmel-Clay Board of Parks and Recreation (the "Park Board"),
the Cannel Common Council (the "Council") directed Department of Community Services ("DOCS"),
to review the appropriateness of the Impact Fee, the Impact Zone and the Zone Improvement Plan,
and, if deemed necessary, to prepare a proposed replacement impact fee ordinance. Attached for
consideration at your meeting is a proposed replacement Park Impact Fee Ordinance and analysis
supporting a fee increase.
As you may know, Park Impact Fees are charges imposed on new residential development by
the City of Cannel within all of Clay Township to defray or mitigate the capital costs of parks and
recreational facilities required by, necessitated by, or needed to serve the new development.
State law has authorized cities (not townships) to impose impact fees. In 1996, the Council
adopted an impact fee for park and recreational purposes of $84.00 per dwelling unit. In December of
2000, the Council increased the fee to $527.00. The process used to amend the fee is the same as that
followed for an amendment to a zoning ordinance but with the addition of the work of an Impact Fee
Advisory Committee (WAC). Any increase takes effect six (6) months after the Council adopts an
ordinance with an increased fee.
It is the first the job of the IFAC to hear information presented to it. If it chooses to do so, it
can recommend to the Plan Commission an increase in or no amendment to the park impact fee. After
holding a public hearing, the Plan Commission then makes a recommendation to the Council which
body makes the final decision.
Like today's park impact fee, any increase would be paid by those applying for building
permits during the effective dates of the increased fee. Since only new residential development pay the
fee, we have to make sure that the newcomers are not bearing more than their fair share. To do this,
we need to pay attention to what the law defines as the "Current Level of Service" and the
"Community Level of Service." The Current Level of Service is the quantitative measure of service ·
provided by existing infrastructure to support existing development. The calculation of the Current
Level of Service is set forth in the Impact Fee Analysis. The Community Level of Service is the
quantitative measure of service provided by the infrastructure that is determined by the City of Carmel
to be appropriate.
The Impact Fee Analysis supports an increase of the impact fee from $527.00 to a number in
the ballpark of $2,400.00. These calculations use for the first time additional revenue sources allowing
the Current Level of Service to be closer to the Community Level of Service than it has ever been
before. A bigger park than originally acquired and master planned, the Central Park will necessarily be
grander in its development than initially contemplated to serve the entire Carmel-Clay community.
Accordingly, we can add to the Zone Improvement the projected park capitol costs for that portion of
Central Park which is not able to be constructed within the budget afforded by the $55 Million Park
Bond. The grander plan will surely benefit new and existing residents.
