PLAN COMMISSION MEMBERS
At the recent Sub Committee meeting our plat amendment for Cherry
Creek Estates received a unanimous favorable recommendation pending the
completion and delivery of 5 items to staff prior to the August 17 Plan
Commission meeting. These items were:
1. A landscape plan to be delivered to Scott Brewer.
2. A letter describing how we would treat the cemetery on the site
3. A sign program for Cherry Tree Road to limit truck traffic
4. A commitment not to start construction of homes until the new
Cherry Creek Boulevard is completed and there is site access from
the south
5. A copy of the letter to the neighbors with our commitments to them.
Enclosed you will find these issues have all been addressed. If you have any

Platinum Properties has prepared this memo to clarify two commitments
made to the Sub Committee of the Plan Commission on August 3rd, related to
the amended plat for Cherry Creek Estates.
1.) There is a very small ~ess than a quarter acre) cemetery located
within this property called the l<irkendall Cemetery. This cemetery
has a few small head stones located in a wooded area, but otherwise
is unremarkable. Platinum Properties will define the cemetery with a
6' tall wrought iron type fence and gate. Appropriate signage will
identify the cemetery. Further, Platinum Properties will provide for
the continual maintenance and mowing of the cemetery; as a portion
of the "Common Area" by the Home Owner's Association of Cherry
Creek Estates.
2.) To minimize the construction traffic on Cherry Tree Road, a signage
program with a "Hotline" number to report violators will be
established (details on a separate sheet). Further it is committed that
no building permits for home construction in this new section
(Section 6) of Cherry Creek Estates will be permitted until access to
the site is available from the south on the new Cherry Creek
Boulevard to be constructed by Platinum Properties. The road is
expected to be completed this fall.

Dear Mr. and Mrs. Lunik:
As we have previously discussed verbally, Platinum Properties, LLC will agree to the following items as it
relates the property that is currently under the platting process with the City of Carmel to be known as
Cherry Creek Estates Section 6:
1. A fence will be constructed similar in style to that fence on the adjoining property line between our
property and Mr. and Mrs. Smalstig and extending along the entire north property line of Section 6.
The fence will be placed on Subdivision property and maintained by Platinum Properties, Pulte
Homes of Indiana, and subsequently the Homeowners Assoc. of Cherry Creek Estates. The three
board fence with attached welded wire barrier will be continuous (i.e. no gates). Timing of
construction of this permanent fence to be worked out (possibly being preceded by a temporary
construction/storm fence), but no earth moving or home construction will be done before such
permanent or temporary fence is in place (with placement of temporary fencing through the
earthmoving phase and then permanent fencing listed above during home construction phase and
thereafter). The fence will be installed in a platted tree preservation easement, and under the
. current covenants and restrictions for this property the fence will therefore have 1) ongoing care
and maintenance solely at the expense of the Homeowners Association, and 2) the fence will be
restricted from any modification without written communication to all homeowners and adjacent
property owners. In addition to providing protection from trespass, the fence is intended to protect
existing tress on your property from being damaged and/or disturbed during development and
home construction. However, if fence does not provide such protection I we will be responsible to
reaso~ably repair damages during development construction and Pulte Homes of Indiana will be
responsible to reasonably repair damages during home construction.
2. Access ,is hereby granted, after offering written notice and receiving a response, to the Cherry
Creek Estates Section E? property for the sole purpose of maintaining your existing trees by
trimming/pruning/removing any limbs, branches or trees currently on your property during the initial
construction phase during which the Developer is working. However, this does not permit you to
alter any trees, fencing or structures that are not on your property. In addition, you are not
permitted to leave any debris generated from your work on the Cherry Creek Estates Section 6
property.

3. Sewer and water laterals of suitable size and location for potential hookups to your parcel
adjoining Section 6 will be provided. The sewer and water service laterals will be extended north
on to your property approximately 10J beyond the fence mentioned above to avoid damage to such
fence when future hookups are made. Exact location of the laterals will be worked out during
construction plan preparation to insure gravity flow for sewer service and cost effective access to
the water line (as it is necessary to separate waterand sewer lines by at least 10').
4. Platinum Properties, LLC is currently in contract with Pulte Homes of Indiana to construct homes in
Cherry Creek Estates Section 6 that are similar to the "Empty Nester' ranches in Sections 1 and 3
and it is our intention to continue that contract throughout the completion of Section 6.
5. We recognize that Cherry Tree Road north of the subdivision is deteriorating and we are in
negotiations with the City of Carmel regarding potential road work that may be required as part of
this development.

RE: Cherry Creek Estates Subdivision, Section 4-Project Review #2
Dear Mr. Bryant:
The City has received your comment letter and revised drawings dated June 10, 2004
based upon the City review of April 20, 2004.
The comments from the City review and the phone conversation have been satisfactorily
addressed with the following exceptions:
23. Please provide FFE and MFPG for the lots that have no pads and define and explain
these abbreviations in the legend.
30. It is apparent that the requested note was added, but it is still being cut off by the
sheet break. Please ensure that the note is readable on each sheet.
34. If pond is to be constructed as a "dry" detention pond with this section, please show
how the pond bottom will be graded so positive drainage is maintained to outlet from
the inlets. The pond bottom cannot stand wet after pond drains. If swale slopes from
inlets to outlet are less than 1 %, please provide subsurface drains in pond bottom.
Also, please provide pond bottom information with a note that the wet bottom pond
will be constructed during Section 5 project.
35. Please indicate the flood routing for the rest of Cherry Creek Estates Subdivision,
Section 4 with arrows on Sheets C201 and C202.
Based on additional review, the City provides the additional comments:
1. Portions of this section are in a wellhead protection area. Please obtain all pemits
and develop a spill prevention plan, etc. as would normally be required for the fueling
and vehicle maintenance area. Please check with the Utilities Department for any
specific wellhead protection aspects of fueling and vehicle maintenance area (i.e.
liner under stone, containment practices, etc.). Please include a wellhead protection
detail in the plans according to the attached drawing for the roadways.
2. Please provide clarification of the FWS line type on Sheet C202. Is this being used
to revise the FEMA boundaries based on the ditch work proposed? If it is, what is
the status of any approvals? What filling activity is occurring within the FEMA
limits and have you reviewed this with Hamilton County?
3. For the portion of right-of-way indicated for Brazos and Pecos Drives that is shown
on the existing well property, please show on plat as dedicated right-of-way. It is our
understanding that you are going to purchase it fee simple from the Utilities
Department and dedicate it by plat to the City. Please inform this Department if.t~is

4. It is our understanding that the right-of-way for Cherry Creek Boulevard will be
purchased fee simple from the Utility Department and dedicated by plat to the City.

minimum velocity when flowing full. Our drainage review consultant indicated that
full pipe flow in the pipe between structures 846 and 845 exceeds the maximum
velocity of 10 fps. Please revise.
8. Is it intended to install swales behind lots 179-184,209-211,212-215, and 216-220?
Please show swales with minimum 10,10 slope on drawings. Do structures 824, 827,
831, 836, and 874 have beehive inlet castings?
9. Sheets C200-C202 - The abbreviation "B.L." is on the plan view and the
abbreviation "B.S.L." is in the legend. If these refer to the same feature, please
change so that they match. Please assure that all abbreviations in the legend agree
with the abbreviations in the plan views throughout the set of construction plans.
Also, "M.E." and F.F.F." appear on the plans, but there are no legends for these.
10. Sheet C401 - In the plan view curve data, the angle is being called D, which
according to standard nomenclature stands for degree of curvature. What you are
denoting is actually the deflection angle, which is which the Greek letter, delta,
according to standard nomenclature. Please change this here and in other places
where this occurs.
11. Sheet C405 - More information is needed to construct the medians - longitudinal
distance between curb tapers and dimensions of various widths.
12. Is there no curbing proposed along the medians for Cherry Creek Boulevard?
13. Sheet C405 - Detail of Cherry Creek Boulevard/Salmon Drive Intersection, there is
an arrow with a "5 RAD" label. What does it refer to?

20. On this sheet, the position of the subsurface drain trench in relation to the curb is
shown three different ways (centered beneath the curb, aligned with the back of the
curb, and aligned with the front of the curb). vVe've included a copy of the City of
Cannel subsurface drain standard for your reference. Please revise accordingly.
21. In the PAVEMENT COMPOSITIONS (CHERRY CREEK BOULEVARD) detail
change the depth of the #53 stone from 5" to 7." Beneath this detail is the note

THE BASE IS INSTALLED." Please remove this note and add the same note that is

been addressed.

Dear Mr. and Mrs. Smalstig:
As we have previously discussed verbally, Platinum Properties, LLC will agree to the following items as it
relates the property that is currently under the platting process with the City of Carmel to be known as
Cherry Creek Estates Section 6:
1. A fence will be constructed similar in style to that fence on the adjoining property line between our
properties and extending along the entire north property line of Section 6. The fence will be placed
on Subdivision property and maintained by Platinum Properties, Pulte Homes of Indiana, and
subsequently the Homeowners Assoc. of Cherry Creek Estates. The three board fence with
attached welded wire barrier will be continuous (i.e. no gates). Timing of construction of this
permanent fence to be worked out (possibly being preceded by a temporary construction/storm
fence), but no earth moving or home construction will be done before such permanent or
temporary fence is in place (with placement of temporary fencing through the earthmoving phase
and then permanent fencing listed above during home construction phase and thereafter). The
fence will be installed in a platted tree preservation easement, and under the current covenants
. and restrictions for this property the fence will therefore have 1) ongoing care and maintenance
solely at the expense of the Homeowners Association, and 2) the fence will be restricted from any
modification without written communication to all homeowners and adjacent property owners. In
addition to providing protection from trespass, the fence is intended to protect existing tress on
your property from being damaged and/or disturbed during development and home construction.
However, if fence does not provide such protection, we will be responsible to reasonably repair
damages during development construction and Pulte Homes of Indiana will be responsible to
reasonably repair damages during home construction.
2. Access is hereby granted, after offering written notice and receiving a response, to the Cherry
Creek Estates Section 6 property for the sole purpose of maintaining your existing trees by
trimming/pruninglremoving any limbs, branches or trees currently on your property during the initial
construction phase during which the Developer is working. However, this does not permit you to
alter any trees, fencing or structures that are not on your property. In addition, you are not
permitted to leave any debris generated from your work on the Cherry Creek Estates Section 6
property.

3. Sewer and water laterals of suitable size and location for potential hookups to both of your parcels
adjoining Section 6 will be provided. The sewer and water service laterals will be extended north
on to your property approximately 10' beyond the fence mentioned above to avoid damage to such
fenQe when future hookups are made. Exact location of the laterals will pe worked out during
construction plan preparation to insure, gravity flow for sewer service and cost effective access to
the water line (as it is necessary to separate water and sewer lines by at least 10').
4. Platinum Properties, LLC is currently in contract with Pulte Homes of Indiana to construct homes in
Cherry Creek Estates Section 6 that are similar to the "Empty Nester" ranches in Sections 1 and 3
and it is our intention to continue that contract throughout the completion of Section 6.
5. We recognize that Cherry Tree Road north of the subdivision is deteriorating and we are in
negotiations with the City of Carmel regarding potential road work that may be required as part of
this development.

The following are the concerns and requests of the Smalstig and Lunik
homeowners who own the property along the North boundary of your proposed Section 6,
Cherry Creek Estates Subdivision:
1. Now that the exact location of the East West property line between your
Section 6 and our properties has been surveyed, we request that a fence be
constructed similar in style to that on our adjoining property and extending
along the entire North property line of Section 6. We request this fence be placed on
Subdivision property and maintained by Platinum Properties, Pulte Homes of
Indiana, and subsequently the Homeowners Assoc. of Cherry Creek Estates. This

2. We ask for written assurance that the existing tree line on our properties will
not be disturbed by heavy equipment used in developing Section 6. These
established trees form a significant, attractive and necessary barrier between
Section 6 and our properties and the root zones of these trees should be kept off
limits to heavy equipment by signs, supervision, and site visits by the
Developer and Homeowners. Additionally, in order to maintain our existing trees we request the
right, after offering written notice and receiving written response, to enter the Section 6 property
with the sole intent to trim/prune/remove any limbs, branches or trees currently on our (Smalstig
or Lunik) property during the initial construction phase during which the Developer is working.
3. Since the City of Carmel has previously annexed our area and has not yet
brought sewer and water service to our properties we request that the
developer extend stubs of suitable size and location for potential hookups to our
three (3) property parcels adjoining Section 6. We agree to allow these sewer and
water service stubs to be brought North on to our properties approximately 10
ft beyond the fence mentioned above to avoid damage to such fence when future
hookups are made. We request the exact location of the stubs to be worked out with
Developer during construction plan preparation to insure gravity flow for sewer service and cost
effective access to the water lines (as we understand it to be necessary to separate water and

sewer lines by at least 10').
4. We are concerned with the small size of the lots proposed for Section 6,
particularly since our lots as well as most others, both North and South,
along Cherry Tree Road are at least 1/2 acre to 4 acre lots. We are, however,
willing to accept the size and quality of the "empty nester" homes being built by
Platinum Properties/Pulte Homes in the other Sections (Sections 1-5) of Cherry Creek Estates. If
however another-Builder and/or Developer is brought into this Section 6 with significantly
smaller, or lower quality homes we would reserve the right to remonstrate
against such development.
5. An important issue which should be of concern to the Planning
Commission, the Developer, the Home Builder, future Homeowners and current residents of
Cherry Tree Road is the deteriorating condition of Cherry Tree
Road from the area of RDJ's Cherry Tree Estates North to just South of 146
SI. This old country road is barely 16 feet wide in places and the shoulders have
already been chewed off by the increased construction equipment from existing
sections of this Platinum/ Pulte development (in spite of Pulte's
attempts-signage and pleas to sub-contractors-- to direct North bound heavy trucks to use
Hazel Dell). Once this Subdivision is completed 300+ homes will be using
two or three exits from this development with Cherry Tree Road north being one of these.
This section of road has to be upgraded.
6. We would expect that these agreements reached with the current property
owner/developer (Platinum Properties), the builder (Pulte Homes of Indiana),
and the Carmel Planning and Development Office would be adhered to in the case
of a change in ownership / developer / builder of this Section 6 property.

and types of materials, etc. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the
Performance amount for Streets and Curbs and 10% of the Performance amount for al1 other improvements.
Perfonnance Guarantees may be Performance or Subdivision Bonds, Irrevocable Letters of Credit or
Cashier's/CertifiedlOfficial Checks, Please reference the enclosures for more detailed explanation of our
procedures.
AVAILABILITY AND CONNECTION FEES
1 O. Availability (acreage) Fees must be paid after a11 other Engineering Department requirements have been
satisfied and prior to start of construction activities (the exception is that you are allowed to move dirt on
site). Availability Fees are based upon total platted acreage for the development at the current rate of
$1,010.00 per acre for Water Availability and $1,365.00 per acre for Sanitary Sewer Availability. Cemeteries
are exempted from payment of Availability Fees.
Connection Fees are currently $1,310,00 for water and $795.00 for sanitary sewers per single-family
residence. Connection Fees are paid when the infrastructure has been completed, satisfactory test results
obtained and the subdivision has been released for permits. Connection Fees are paid on a ner-Iot basis.
. If an irrigation system is planned is planned for this, or any future section of the development,
additional Water Connection Fees will be assessed based upon the recommendation of the
Director of Carmel Utilities.

12. In the typical street cross section, sidewalk width requirements are now 5-feet. Also, the S.S.D. should be
indicated under the curb.
13, Please provide drainage calculations, to the Engineering Department and the Surveyor's Office, with all
construction plans submitted for review.
14. Will a curb cut be requested for access to the Kirkendall Cemetery?
15. Are there any provisions considered to discourage entry on and off of Cherry Creek Boulevard from the cul-
de-sacs that are very close to the boulevard?
16. We will be requesting road improvements to Cherry Tree Road along that portion of the frontage of Cherry
Creek Estates across from Cherry Tree Estates. At a minimum, we would request that the Cherry Tree Road
east pavement half section be increased to IS-feet along with standard acceleration/deceleration lanes.
17. Is the street in the northwest comer of the future section(s) on sheet 3 planned to be a dedicated street? We
do not feel that a 20-foot street width is adequate or acceptable.
18. We may have raised this question before but why is the portion of Cherry Creek Boulevard adjacent to the
well site not a part of the primary (and secondary) plat?
19. Does the direct discharge at Cherry Creek Boulevard and Wildcat Drive require a BMP? Can this water be
detained?
20. Why are portions of Brazos Drive located within the well site?
21. Is compensatory storage required for the work between the FWF & FFF? Will the lots in the FFF be
removed from any FEMA classifications?
22. Ate the medians to be landscaped with trees on Cherry Creek Boulevard? If so, is adequate site distance
provided at the intersections? Specifically, at Cherry Creek Boulevard and Wildcat Drive?
23. Can common areas 8,20,21 and 33 be claimed as open space conservation? Can the legal drains also be
claimed? Developer does not own the property.
We will not provide additional comments for this project until detailed construction drawings are submitted for review.

has revicwed the information you submined regarding the propos I
suhdivisj(,')n in I familwn County, (ndiana. The devetopml.:1\t plan wlue
the following conditions:
1. After review of the documentat1on provided in the OPR survey report, the boundaries ofthc cemetery
appear to coincide wiLh the currently fenced area depictcd in Figure 1 of the GPR report. In addition,
we concur' that the cemetery boundaries should be ex.panded to include those arCaS of GPR. anomallcs
which arc potentially grave areas to the north and west of the current cemetery boundaries. Without
additional verificationJ we would urge that the southern boundary of the cemetery also be expanded to
include the area which 4D COllsulting considers a subsurface anomaly.
2, All landowners of lots within 100 feet of the cemeteries should be notified ofIndian~ Jaw (IC 14-21-1-
26.5) regarding disturbance of (he ground to erect, alter, or repair any structure within 100 feeL of a
burial ground or c~metery.
j _ If durlng any pha$c of the cons\rucliol1 any buried human rcmains are disturbed, the Department of
Natural Resources must be notified ofthc discovery within lWO (2) business days, per re 14-21-1-27.
4. I f during any phase of the construction any artifacts or burial objccls are disturbed, ground disturbing
activities shall cease, and the Department of Natural Resources will be nOlified within two (2) business
days, per Ie 14~21-1-29.
