Davis Coots COMMITEMENT TO CONSTURCT ASPHALT TRAIL This Commitment is entered this day of L°° 2012 by Lubavitch of Indiana, Inc., an Indiana not for profit corporation to the City of Carmel. WHEREAS, the Carmel Board of Zoning Appeals approved Docket Nos. 11050019SU Amendment; 11060016V; and 11060017 at its meeting held September 26, 2011 and WHEREAS, a condition of the approval was the site plans submitted with the application filed June 28, 2011 that included an asphalt trail extending from the multi purpose path to be constructed bordering the north side of 96 Street, such asphalt trail to connect the building to the multi purpose path; and WHEREAS, Lubavitch of Indiana requested the Department of Community Services permit it to defer construction of the asphalt trail until the building is completed and the multi purpose path is constructed as a part of the 96 Street improvement. NOW, THEREFORE, Lubavitch of Indiana commits that it will construct an asphalt trail extending from the multi purpose path bordering the north boundary of 96 Street, when constructed, to the worship center building to be constructed by Lubavitch of Indiana, Inc., such cost to construct the asphalt trail being the responsibility of Lubavitch of Indiana, Inc.
