L both carry a lot of vehicular traffic. The new sign will be required to conform to the existing sign plan as the rest of the building, according to color, lighting, installation method, etc. The proposed sign is an internally illuminated white letters installed to the fascia of the building. This meets the sign package for the site, for design and size. The size is 46.16 sq. ft. and 75 sq. ft. is allowed by the Sign Ordinance. Petitioner, please confirm which sign will be relocated from the north elevation. The lower sign was allowed up to 105 sq. ft. and the upper sign was allowed up to 189 sq. ft. (The Department wants to make sure it can specify the maximum sign area allowed for the east. elevation.) Please view the petitioner's informational packet for further detail. Findings of Fact: 1. The approval of these variances will not be injurious to the public health, safety, morals, and general welfare of the community because: the proposed sign location will effectively address identification of one of the major tenants of the building from Meridian Street/I -465. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: wall signs facing Meridian Street/I -465 are consistent with the majority of multi -tenant multi -level buildings in the US 31 Corridor and allow for reasonable identification of major tenants. Adequate identification of major tenants promotes higher occupancy rates in the corridor. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: adequate identification of major tenants is generally critical to the success of building leasing. Absent utilizing the proposed sign location the owner will be placed at a competitive disadvantage with other similarly situated buildings in the US 31 Overlay zone which are sometimes permitted more than one sign location facing Meridian Street/I -465. Recommendation: After all concerns have been addressed, the Dept. of Community Services recommends positive consideration of Docket No. 11110007 V.
