The applicant seeks the following use variance approval:

not anticipated. This use variance would
not allow retail sales and would be compatible with surrounding uses. This site does need to comply with the current
Thoroughfare Plan by dedicating additional right-of-way and installing a 10 foot asphalt path along the frontage.
The petitioner has also agreed to install bike parking. Please see the petitioner's informational packet for more
detail. -
Findings of Fact:
1. The grant of this variance will not be contrary to the public interest, due to the existence of special
condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship
because: general personal service uses will function similar to the permitted office uses.
2. The grant of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because: this use will be compatible with the surrounding uses and will
function in the already existing building.
3. The use or value of the area adjacent to the subject property will not be substantially affected in
any adverse manner because: this use will be compatible with the existing and surrounding uses and
will function in the already existing building.
4. The need for the variance arises from a natural condition peculiar to the subject property because:
the current Old Meridian/Office District does not permit general personal service uses,however we do not
believe it was the intent of the Old Meridian District to specifically exclude those uses from this parcel.
5. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan
because: The Carmel Clay Comprehensive Plan does support this use adjacent to employment nodes, attached
residential, and neighborhood service nodes which are all in the vicinity of this site.
Recommendation: After all concerns have been addressed, the Dept. of Community Services recommends positive
consideration of Docket No. 11120007 UV with the conditions that additional right-of-way be dedicated per the
current Thoroughfare Plan, a 10 foot asphalt path be installed per the current Thoroughfare Plan, and 4 bicycle
parking spots be installed.
