There is an existing house that sits on the south lot and a garage that sits on the north lot. We are requesting permission to demolish the garage structure and build a custom home on the north lot. To access the new home and the existing home the alley behind the structures would be paved. At this time we are simply requesting permission to demolish the garage and will submit a new SDR application once a custom home plan has been created. It appears that section 23D.02 B.5.a.iv (replacement) of the zoning ordinance allows for demolition of existing contributing structures if the replacement value is of greater significance to the area. I would argue that the existing garage should not be considered a contributing structure in the first place. It is an old structure, but with no strong character and some awkward additions over the years. Disregarding the validity of the inclusion of the garage structure on the contributing buildings map, the aforementioned section of the zoning ordinance still allows for replacement if the new structure would be of greater value. I have listed a few reasons below for replacement: 1) Removal of a driveway and front facing garage from 15`Ave NE. 2) Owner willing to covenant that B-1 zoning will not be used on the property. 3) Garage structure is of no architectural significance and new home would be designed to be complimentary to the adjacent homes. 4) OTDG intends to make structural improvements to the existing contributing home to keep it in good shape for years to come. Finally, the most important reason for which we are requesting SDR approval is that The Old Town Design Group has chosen a family to buy the existing home at 321 1st Ave NE that otherwise couldn't afford to own a home in Carmel. If the application is approved to allow the demolition of the old garage and the construction of a new home, OTDG will be able to sell the existing home at below market value and even below cost to Brian and Rebecca McGuckin. Brian is a school teacher at Clay Middle School and Rebecca is a stay at home mom to four children. Rebecca also taught in Carmel schools prior to having children. They currently reside in a rental home in Cicero and Brian has a long commute each day. Not only would the opportunity for home ownership be a blessing to the McGuckin family, but their presence in the neighborhood would certainly be a benefit to old town Carmel. Mr. McGuckin is well liked as a teacher and has been a mentor to many students. His family's ability to live and work in Carmel would be a great benefit to the community. We anticipate that demolition would happen over the winter and a new SDR application would be submitted sometime in 2012 for the new structure. Rangeline Road, Suite 200 Carmel, IN 46032 317-966-2023 BOUNDARY SURVEY LOT 80&81 C.W.WIEDLERS SUBDIVISION CLAY TWP.,CARMEL,INDIANA SURVEYORS REPORT-THEORY OF LOCATION The purpose of this survey is to retrace the lots lines and corners of Lots 80&81 in C.W.Weidlers Subdivision in Carmel,Indiana. A diligent search was made around the block and with the records of Hamilton county for existing record monuments. NONE were found. No previous survey in this block was found in the recorders office. No indication of original monuments were shown on the Original plat at the lot corners. Due to this lack of monumentation,the existing curbs were located and used to establish the right-of-way lines of the streets. Existing alley turn outs were located and used to establish location and direction of the alley. The position of the alley causes a 2'to 2.25'overage in the east-west dimensions of the lots. The location of the right-of-way lines as established were found to match very closely with the existing retaining walls within the block and on the subject Lot 80. The lots were laid out per deed dimensions from 3rd Street NE. This adherence to the plat dimensions matched very well with apparent lines of occupation to the north. In accordance with the Indiana Survey Standards as defined in Title 865,Article 1,Rule 12 of the Indiana Administrative Code,the following observations and opinions are submitted with reference to the uncertainties in the locations of the lines and corners established on this survey as a result oh 1)Variance caused by the availability and condition of record monuments; No record monuments were found or discovered in the research for this project. No original monuments were shown on the lots corners of the recorded plat. No uncertainties due to monuments is associated with this survey. 2)The existing deeds and plats of record; No uncertainty is associated with the lots of this survey due to simultaneous conveyances.However,a 2'to 2.25'uncertainty is associated with the East line of the lots due to the alley position. 3)The occupation or possession lines(fences,etc.)as related to the surveyed lines; A 1't uncertainty is associated with the south line of this survey due to the fence line shown hereon. 4)The Relative Positional Accuracy of measurements; A)The Relative Positional Accuracy of position of the lines and corners of this survey due to measurements is within the specifications for a r Suburban Survey(0.13 foot plus 100 parts per million). 3 NOTES 1) Subsurface and environmental conditions were not examined or considered as a part of this survey. No statement is made concerning the existence of overhead or underground containers or facilities that may affect the use or development of this tract 2) No attempt was made as part of this survey to obtain or show data conceming existence,size,depth,condition,capacity,or location of any utility,public service facility,or utility service lines to the property. 3) No excavations were made during the course of this survey to locate underground utilities and/or structures.
