You will geta second pass at this when we bring the final plan through SDR. Let me know if you need a real plan to put teeth to the replacement value argument. I'd guess that the recently approved demos of contributing structures for Tammy Mattingly on 3rd Street NW and Woodmark Homes on 3rd Ave NE were approved under the replacement value provision.There is no way the garage value at 321 is greater than any of these other structures. Please advise. Of course,the devil is in the details, and I would need a bit more detail as to what is planned for the existing home/property in order to not degrade the stature/status of contributing to the character area... From past experience I would say the house is legal non-conforming in that it doesn't have a 5' side yard setback but it doesn't overlap the property line. Precedent is that it's grandfathered. However, we would make a commitment that any new construction on the north lot would maintain a 10' separation between structures. 2) Regarding the "Contributing Structure", it is a garage that has been added onto at least once with poorly matching roof lines, a bad foundation, and street facing garage doors. It would not be missed. What do I need to do/fill out to request permission to remove this.structure that certainly isn't a part of the character of the neighborhood. Just to be clear, we will not ask permission to do anything to the house other than improve it. Would love to resolve this issue this week if possible as our contract requires us to resolve the issue of the usability of the north lot. You will need the Director's approval in order to tear down the garage. See attached .pdf, specifically pages 3-4. You MIGHT also need BZA variance approval for the northern side yard setback of the house,just to make it legal... but then again, it could just be determined to be legally non-conforming (aka grandfathered.) You would have to work with Mike H. on that. The north parcel contains an old garage and the south parcel contains an existing home. We intend to tear down the old garage and refurbish the home. We will build a new home on the north lot. For access we intend to pave the alley behind the home (similar to Blackwell, Leazenby's home, etc....) and place the new garage towards the alley. I see all of this work as SDR and don't see any need for any variances or plat amendment. The survey is attached. Can you confirm my understanding and let me know if you have any concerns?
