The city —of Carmel now owns, the
Carmel. Theater and the 1/8 acre of
land on which it sits.
Theprevious owners of the theater,
Othmar and Libby Grueninger,
turned over the deed and title in-
surance Monday at around noon in
'exchange' for a $55,000 check, as
cording to Mayor Jane Reiman.

• The mayor said a demolition firm,
McKnight Demolition of Indianapolis,
will not be able to begin work tearing
down the theater until the end of
January or the beginning of
February. She said work can
progress as long as there is no snow or
ice. She plans to ; notify 'nearby
residents and business owners when
work is to begin, warning them of the
possible inconvenience of noise and
heavy equipment. , •
The city will pay $4,800 to demolish
the building, considerably Less than
the $10,000 approved for the work by
the city council.
The demolition team was due to
start work in November, but the sale
of the theater was delayed ,by a
controversy surrounding an
easement on the north side of the
'movie house.

Mayor Reiman refused to buy the
lot ' until that • problem could be
resolved. She also refused to give up
the six feet from the lot, which she :.
hopes to make into a small city park
next spring and summer.

She asked Andich . to sign a quit-
claim deed .. but he refused.
Since then, e r ninger's at-
torneys, Campbell, Kyle & Proffitt of
Carmel,, secured title insurance from
Hamilton Title Security Inc., Carmel,
which shows the city has clear title to
all of the property and no right -of -way
easements for Andich.
Andich's . recourse is to take the
matter to court. The title insurance
would cover the city's cost of such an
action.
He was unavailable for comment
Monday and yesterday.,
"We have clear title and he (An-
dich) will have to deal with the title
company," Mayor Reiman said
Monday:: "But I'm not even thinking
about that. All I know is that we have
it (the deed), and we're going to go
ahead with our plans."
Those plans are for . a park with
benches; trees and bushes, and
possibly other facilities,• • such as a
parade review stand or band shelter.

Carmel, Ind. — Thanks to a
donation from R.V. . Welch Invest-
ments Inc. and Fidelity Bank of
Indiana, Carmel will soon have the
kind of park Mayor. Jane A. Reiman
had envisioned on the site of the old
Carmel Theater.
Mrs. Reiman had led city efforts
to purchase the theater when she
feared it might someday be sold to
a firm that would show X-rated
movies. To prevent 'that, the city
bought the theater in late 1984 and
s Ca
demolished the downtown landmark
this spring, hoping to build a park in
its place.
The gift from the two companies
is making that possible, Mrs. Rei-
man said Tuesday.
"This is our first corporate gift.
It's a milestone for us," she said.
"We're very grateful. I didn't solicit
it. They came forward."
F. Richard Rembusch, a vice
president with Welch, said Welch
will underwrite the expenses, paying
the majority of the costs with the
mei ark t theater site
remainder paid for by a "substan-
tial" donation from Fidelity. The
exact figures will depend on . the
final cost, which is expected to be
more than $60,000, he said.
Construction on the new park,
located at 21 South Range Line
Road, should begin next week and
be completed in about 10 weeks.
The new park will feature a
decorative pool and fountain, 6-foot-
high brick walls on the north and
east sides, extensive landscaping
with paving stones and benches,
and a small staging area. A large
evergreen also will be planted near
the front of the park and, Mrs.
Reiman said, will be decorated each
Christmas.
The park is as yet unnamed,
though Mrs. Reiman said she favors
calling it "The Downtown Park."
"We'll always know where it is
then," she said, adding that the also
hopes the park will aid revitalization
of downtown Carmel.
Mrs. Reiman said Michael G.
Browning, president of Welch In-
vestments, asked her late last fall if
there was a city project his firm
could assist in. She told him about
the theater, and said she planned to
go to service clubs for help.
In response, he sent his firm's
architects- and site planners to her
to begin planning the park.
Rembusch said the company
"became aware that for the city to
construct the park, it would require
a significant appropriation ... that
might stand in the way of this being
a first -class project."

Thank you for your letter of August 23 about removal
of equipment, etc., from the theatre before demolition,
Please. feel free to remove any or all equipment inside
the building. In case you read the Carmel papers and are
concerned that the land will become a parking lot, I want
to reassure you that once the theatre has been removed -
that land will be a PARK. The public hearing is for the
funds to pay to you and for demolition. It is not a pub-
lic hearing to decide what we will do with the land. We
elected officials are completely committed to a park and
.nothing else. I wanted to reassure you of that fact.
I am so pleased that you decided to sell to the City
of Carmel.and we take that trust very seriously, I be-
lieve it will be a beautiful quiet green area where peo.
ple can-sit and watch the world go by and perhaps even a
few birds will nest in the trees we will be planting.
Libby, the theatre was an important part of our family's
recreation for many years. We always appreciated your
facility. Now in 1985 a whole new generation will instead
be able to have a small quiet park in the middle of a now
bustling' community.
I feel good about our transaction and I truly hope
that you share the same feeling. If you have any other
questions, please phone or write. I will be in touch with
you in October regarding the purchase and closing, Thank

THIS. AGREEMENT is executed this. 17. day of December, 1984,
between Elizabeth Anne Grueninger ( "Vendor ") and the City of
Carmel, Hamilton County, Indiana ( "Purchaser "):
WITNESSETH:
WHEREAS, the parties have heretofore verbally agreed that
Vendor will sell and transfer unto Purchaser that property
commonly known as 21 South Rangeline• Road, Carmel, Indiana, and
WHEREAS, the parties are consummating the above referenced
sale this date pursuant to the terms of this•AAgreement.
NOW, THEREFORE, for good and valuable consideration and the
covenants contained herein, the parties agree as follows:

installed or which belong to or are used in connection with the •
real estate, - wherever located,'such as electrical or gas
fixtures, heating equipment, hot water- heater and water softener
(if not leased); window shades and venetian blinds, curtain and
drapery poles and fixtures; screens, storm doors and window /am.
awnings; and television and radio antennae.
2. Instruments Delivered to Purchaser from Vendor. Upon
the execution of this Agreement and payment of the purchase price
as provided for in paragraph 3 hereof, Vendor shall and does
hereby deliver to Purchaser the following documents, receipt of
which is hereby acknowledged by Purchaser:
A. Commitment for Title Insurance No. 84- 12041127
issued November 27, 1984, by Ticor Title Insurance
Company through its authorized agent, Hamilton Title
.:Security, Inc:, together with Endorsement thereon issued
December 12, 198.4, forming a part of said commitment.
B. Vendor's_ Affidavit, a copy of which is attached
hereto, covering the real estate. sold.
C. Warranty Deed, a copy of which is attached hereto,
transferring the real estate sold.
D. 5'lrve'v, certified December 10, 1' -f•-54,
Weihe, Reg, L.S. . for the real estate being v ^:c.ed
herein.
3.. Payment of Purchase Price. Upon the execution of this
Agreement and delivery of documents referred to in paragraph 2
hereof, Purchaser shall and does hereby tender to Vendor the sum
of Fifty -Five Thousand Dollars ($55,000.00) by certified check,
representing the total purchse price for the real estate conveyed
herein, receipt .of which is hereby acknowledged by Vendor.
4. -Payment of Closing Costs. It is understood and agreed
that Vendor shall pay all costs attributable to surveys and title
insurance. premiums, and Purchaser shall be responsible for all
costs attributable to recordation of documents delivered to
Purchaser herein. It is also acknowledged that there are no
brokerage fees or other."commissions which either party is
obligated to pay resulting from this transaction.
5. Assessments and Taxes. Purchaser does hereby assume all
assessments for municipal improvements becoming a lien subsequent
to the date of this Agreement and installments of real estate
taxes, if any-, assessed for the year 1985 and thereafter. Vendor
shall pay all 1984 real estate tax installments, due and payable
in 1985, and shall furnish Purchaser with receipts showing that
such taxes are in fact paid by the respective due dates in May and
November.
6. Possession. Upon the execution of This Agreement and
completion of the transaction in accordance herewith,. Purchaser
shall be given complete possession of the real �-tate and

Please find enclosed documents relevant to the Carmel
purchase of Lot No. 6 at 21 South Rangeline, Carmel, Indiana, being
photocopies of Warranty Deed, Vendor's Affidavit, and Contract
for Purchase and Tit le Policv.

Secondly, please accept this as a confirmation of the city's
standing with respect to title work whereby the title company
guarantees that we have received fee simple title, free and clear
of any easements. However, the City of Carmel could possibly be
involved in litigation as a named party defendant if Mr. Andich
would file a law suit to declare his easement of prescription
across the eastern portion of Lot 6. If a law suit were initiated
by Mr. Andich, the title company would take over and be responsible
for a substantial amount of the attorney fees in defending this
litigation and establishing that Mr. .Andich does not have an
easement. However, as .I mentioned earlier, the City of Carmel
would be involved in the law suit as :a. party defendant and would
therefore have to participate to that extent._ •

This Wednesday, March 27th or Thursday, March 28th the
demolition of the Carmel Theater will commence - The actual
day will depend on the weather and bringing in a crane. Our
city departments will be assisting with traffic control,
safety, and any other helpful way to assist the demolition
company. It should take two days to complete. If you have
any concerns, please feel free to contact Lee Dolen our
Street Commissioner, as I am putting him in charge of this
project. (His office phone number is 846- 7499).
We hope there will be minimal disturbance to each of you.

The. City of Carmel will be the beneficiary of a major corporate
contribution from R. V. Welch Investments, Inc. and Fidelity Bank of
Indiana. The two .firms announced today that they would underwrite
the expense of constructing a public park on the former site of the
Carmel Theater at 21 S. Range :Line Road in downtown Carmel. The
site had been acquired earlier by the City for park purposes. The
contributions announced today will .enable a first -class park to be
constructed without any municipal appropriation of funds.
Michael G. Browning, President of R. V. Welch Investments and
Richard L. French, President of Fidelity Bank said that the
projected cost of construction exceeds $60,000. The majority of
that cost will be paid' by R. V. Welch Investments, with a
substantial contribution from Fidelity Bank. Browning said "We have
been very successful in Carmel, and the park project provides us
with the opportunity to share that success with the community. This
contribution is consistent with the spirit of public- private
partnership that is so important to community progress."
Carmel Mayor Jane A. Reiman acclaimed the corporate gift, saying
"This is the City of Carmel's first major corporate contribution.
The elected officials are overwhelmed with the attractive landscape
architecture and plans for the new downtown park. We are very
grateful to R. V. Welch Investments and Fidelity Bank. I have said
many times Carmel has been blessed by the R. V. Welch firm's
developments and now our City is blessed with a beautiful new park
project made possible by the Welch organization and Fidelity Bank.
The quality of this park project will be a significant step in the
revitalization of downtown Carmel."
The new park • will feature a decorative pool and fountain, brick
screening walls on the north and east sides, extensive landscaping
with paver stones and benches, and a staging area for small
functions. A large evergreen tree to be planted near the front of
the park can be decorated during the Christmas season to provide
holiday cheer for the entire Carmel community. The architectural
design and landscape planning was done by Browning Day Mullins
Dierdorf Inc. in consultation with _ city officials. Construction is
expected to begin immediately and will be completed in about ten
weeks.
