(V) Brookshire North, Lot 128. The applicant seeks the following development standards variance approval for an 8-ft tall fence: Docket No. 12060016 V ZO Chptr. 25.02.02 Fence height cannot exceed 6-ft. The site is located at 4591 Abbey Dr. It is zoned R-1/Residence. Filed by Joe Harvey, on behalf of Kristi Troutman, owner. Present for the Petitioner: Joe Harvey,4591 Abbey Drive • Fence needed repair when he bought property last year • Looking out kitchen, can see neighbor (Hicks) whenever outside o Hicks were comfortable with 8-foot fence • Did not realize 8-foot fence was in violation (6-foot allowed) • Fence installed for security and privacy • Could he also ask for.8-foot fence on north side of property? • Has had compliments on fence; not intrusive Public in favor: Barbara Hicks, 12968 Wembly • Mr. Harvey has made improvements to property • Appreciate the,privacy from Harvey's pool o Hicks' deck is raised, so they can see into Harvey's backyard • Fence is beautiful; compliments from their guests Public Hearing closed. Discussion: • • Since petition filed, neighborhood boys have been throwing tennis balls over fence o They could scale 6-foot fence to retrieve balls from pool area o He does not want to be liable • North fence would require another variance and public notice o Could re-file for additional variance o Could amend original variance and continue vote to next month's meeting • Would save filing fee, but still require public notice o Mr. Harvey decided he wanted decision for original variance at this meeting • Would consider re-filing for an additional variance for north side of fence • North side is not seen from the street • He found out he needed a variance because someone complained about his fence Action: Mr. Broach APPROVED Docket No. 12060016 V, Brookshire North, Lot 128 for rear yard fence height of eight feet. 2-5. Department Report: Rachel Boone o These new signs will help with issues of identity for two buildings labeled with same address o Smarter to have less directional signs and larger square footage o Wall sign underneath canopy will help patrons identify building o Will be backlit o Will not have much light impact on neighbors across Illinois Street o Good solution and glad they have come to agreement on signage Department recommended positive consideration. (SU) Mercy Road Church. . . • The applicant seeks the following special use approval: Docket No. 12070006 SU ZO Chptr. 12.02 Special Uses, place of worship in B-1 district. The site is located at 10505 N. College Avenue. It is zoned B-1/Business and lies within the Home Place Business District. Filed by Patrick Sheehan of College Building Company,LLC, owner. Department Report: Alexia Donahue Wold • Mixed uses in the area: office, retail and residential nearby • Existing building with office use • Existing parking will satisfy number for proposed Special Use • Do not feel it will negatively impact area or neighborhood • Good they are able to use the building and parking lot on opposite days/hours • No changes will be made to site Department recommended positive consideration. Discussion: • The Family Church originally occupied the space o They have moved to their own building in the area • South part of building was built in the 1970's o Addition in 2005 with atrium in between o Makes it appear to be two buildings Action: Mr. Broach APPROVED Docket No. 12070006 SU,Mercy Road Church for place of worship in B-1 zoning district.
