Detailed Description of the Modification of Commitments requested:
When the Board of Zoning Appeals approved the special exception application under Docket BA 2-69,
the application was approved with a condition that there be no access to Dav Drive. Since 1969 all but
one of the lots have either been converted to commercial business uses or acquired by Lighthouse
Tabernacle Church. The Church has entered into a contract with an affiliate of the Owner to sell a 1.24±
acre parcel of land on the west side of Day Drive. The affiliate proposes to construct a surface parking lot
on the parcel for the storage of vehicles to be sold by the car and truck dealership located on the Owner's
property. Owner wishes to modify the commitment to allow for access to Day Drive and to the new
surface parking lot.

AFFIDAVIT
I, Larry V. Heid, on behalf of the Owner, being duly sworn, depose and say that The Tom Wood
Irrevocable Real Estate Trust is the owner of One Hundred Percent (100%) of the property
involved in this Application and that the foregoing signatures, statements, and answers herein
contained and the information herewith submitted are in all respects true and correct to the best
of my knowledge and belief.
