ACCEPTANCE OF DEDICATION & DEED OF PUBLIC RIGHTS -OF -WAY
WHEREAS, the foregoing Grantor having filed with the City of Cannel, Indiana ("City "), its
Dedication and Deed of certain real property ( "Property") to the City for the purpose of establishing
City rights -of -way, which Dedication and Deed is attached hereto and incorporated herein as Exhibit
"A ", pages 1 of 2 and 2 of 2, hereinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is desirable and
necessary and in the City's best interests;
NOW THEREFORE, the City, by and through its Board of Public Works and Safety, hereby accepts
said Dedication and Deed, and orders that the Instrument of Dedication and Deed described herein be
recorded in the Recorder's Office of the County of Hamilton, State of Indiana, and that said described
real property be, and the same hereby is, declared open and dedicated to the City.

THIS INDENTURE WITNESSETH THAT One One Six College Apartments. LLC (individually and
collectively the "Grantor "), convey and warrant to the City of Carmel, Indiana ( the "Grantee "), for the sum of
One Dollar ($1.00) and other valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the following described real estate in Hamilton County, State of Indiana:
See attached Exhibits A, pages 1 of 2 and 2 of 2, which are attached hereto and incorporated herein
subject to any and all easements, agreements, restrictions and other matters of record.
It is understood between the parties hereto, and their successors in title, and made a covenant herein which shall
run with the land, that all real estate herein described (excepting any parcels or portions thereof that are
specifically and expressly designated as easements or temporary rights of way) are conveyed in fee simple and
not merely for right of way purposes, and that no reversionary rights whatsoever are intended to remain in the
Grantor.
