Indianapolis, Indiana 46240 RE: CITY CODE VIOLATION — UNSAFE STRUCTURE Dear Sir: This letter is being provided to inform you that the Department of Building and Code Services has some concerns regarding the condition and safety of the structure located at 31 First St. S.E., a property listed under your ownership. A simple site inspection was performed by this Department on May 13, 2009, in response to complaints regarding the safety of the structure. And due to the dilapidated condition of the property, a more detailed inspection of the structure was performed by McComas Engineering on June 9, 2009, and the inspection report was forwarded to this Department. This report stated that there are virtually no areas of the building that remain watertight, and that significant deterioration of the roof framing and exterior masonry walls was noted throughout the building. Itemized structural deficiencies were noted to include, but not limited to, the following: - Roof framing is missing in several areas, and significantly decayed in others. - Support for the west portion of the elevated floor is completely gone and floor members are rotted and sagging. - The wood top plate that supports rafters and connects the roof to the masonry walls is deteriorated or missing along the west and east walls. - Wood rafters and decking are deteriorated or missing in several areas. - Water penetration and deterioration of both the masonry and wood at truss bearing points in both east and west walls. These issues as well as the other noted deficiencies violate § 6-79 Public Nuisances Affecting Peace and Safety of the Carmel City Code, which states: (0 All buildings or structures so old, dilapidated or out of repair as to be dangerous, unsafe, unsanitary or otherwise unf t for human use; or shall be ONE C1VIC SQUARE CAM EI , INDIANA 46032 317/571-2672 an invitation to children and endanger the lives of such children, or which, because of its condition has become afire hazard. The Carmel City Code also defines this property as an Unsafe Building per § 6-159 Unsafe Building Regulations as outlined by the following provisions: (h)(1) Is in an impaired structural condition that makes it unsafe to a person or property; (h)(3) Is a hazard to the public health; (h)(4) Is a public nuisance; (h)(5) Is dangerous to a person or property because of a violation of a statute or ordinance concerning building condition or maintenance; (h)(6) Is vacant and not maintained in a manner that would allow human habitation, occupancy or use under the requirements of any statute or ordinance; (h)(8) Has the walking surface of any aisle; passageway, stairway or other means of exit so warped, worn, loose or otherwise unsafe so as not to provide safe and adequate means of exit in case offire or panic; (h)(9) Has stress on any material, member or portion thereof, due to dead and/or live loads, that is more than one and one-half times the working stress allowed for new buildings of similar structure, purpose or location; (h)(1 D) Has any portion thereof that has been damaged by fire, earthquake, wind, food or other cause to such and extent that the structural strength or stability thereof is materially less than it was before such event and is less than the minimum requirements for new buildings of similar structure, purpose or location; (h)(11) Has any portion, member or appurtenance thereof that is reasonably likely to fail, to become detached or dislodged or to collapse and thereby injure persons or damage property; (h)(12) Has any exterior portion, member, appurtenance or ornamentation thereon that is not of sufficient strength or stability, or is not anchored, attached or fastened, so as to be capable of resisting a wind pressure of one -ha f of that specified for new buildings of similar structure, purpose, or location without exceeding the working stresses permitted for such buildings; (h)(13) Has any portion thereof that was warped, buckled or settled to such an extent that walls or other structural portions have materially less resistance to winds or earthquakes than is required in the case of new building of similar structure, purpose or location; (h)(14) Is or has any portion thereof that, because of (1) dilapidation, deterioration, or decay; (2) faulty construction; (3) the removal, movement, or instability of any portion of the ground necessaryfor the support of such building; (4) the deterioration, decay, or inadequacy of its foundation; or, (5) any other cause, is reasonably likely to partially or completely collapse; ONE aVIC SQUARE CARMEL, INDIANA 46032 317/571-2672 (h)(16) Has exterior walls or other vertical structural members that list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle one-third of the base; (h)(17) Shows, exclusive of its foundation; thirty-three percent (3301o) or more damage or deterioration of any supporting member, or fifty percent (50%) or more damage or deterioration of any non -supporting member, enclosure or outside wall or covering; (h)(18) Has been so damaged by fire, wind, earthquake or flood or has become so dilapidated or deteriorated so as to become (1) an attractive nuisance to children, or (2) freely accessible to persons for the purpose of committing unlawful acts; (h)(19) Has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by any law of the State of Indiana or any City ordinance or building regulation relating to the condition, location or structure of buildings; (h)(20) Has, whether or not it was erected in accordance with all applicable laws and ordinances, in any supporting part, member or portion, less than fifty percent (5001o), or in any supporting part, member, or portion, less than sixty-six percent (66%), of the (1) strength, (2) fire -resisting qualities or characteristics, and/or (3) weather -resisting qualities or characteristics that would be required by law in case of a newly constructed building there -at of like area, height and occupancy; (h)(22) Is, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits or lack of sufficient fare -resistive construction, determined by the Carmel Fire Department to be afire hazard; (h)(24) Is abandoned for a period in excess of six (6) months, so as to constitute an attractive nuisance or hazard to the public. The condition of the building has created an unsafe condition that may lead to partial or total collapse of the building shell. Please ensure the building is secured at all times. Please begin repairs to the structure, or begin demolition proceedings, by August 24, 2009. All work for reconstruction, repair, or demolition of buildings and other structures performed pursuant hereto shall be performed in a good and workmanlike manner according to accepted standards and practices in the trade. The purpose of our review was to determine the structural adequacy of the existing building. The building originally served as a church. However, in 2005 McComas Engineering, Inc. (MEI) was hired to provide design of temporary bracing and shoring of walls and roof trusses in conjunction with plans to change the building to a restaurant. On June 9, 2009, we visited the building to do a brief, visual walk-through survey in order to comment on the current status of the structure. The building consists of masonry walls supporting wood roof trusses and wood rafters covered by wood decking. Elevated floors in the building are comprised of wood joists and wood decking. The age of the building is not known. In 2005, MEI designed temporary lateral braces to support the exterior masonry walls after a portion of the floor had been removed. MEI also designed temporary scaffold shoring to support dilapidated trusses, as well as measures for repair of the trusses. During our site visit we noted that the wall braces and scaffold shoring were still in place, and it appeared that some of the truss repair measures had been undertaken. However, the truss repairs do not appear to have been completed. Generally speaking, there are virtually no areas of the building that remain watertight. Significant deterioration of the roof framing and exterior masonry walls was noted throughout the building. Some of the specific deficiencies noted were as follows: 1. Roof framing is missing in several areas, and significantly decayed in others. 2. Support for the west portion of the elevated floor is completely gone and floor members are rotted and sagging. 3. The wood top plate that supports rafters and connects the roof to the masonry walls is deteriorated or missing along west and east walls. 4. Wood rafters and decking are deteriorated or missing in several areas. 5. Water penetration and deterioration of both the masonry and wood at truss bearing points in both east and west walls. 6. Prominent cracks and deterioration in all concrete lintels over windows and below trusses in east, south and west walls. 7. Eroded foundation in south wall at southeast corner. 8. Wall at entry stair has decayed joints and bows into the stair. 9. Wood framing over entry stair deteriorated and missing. 10. Significant cracks in masonry at north and west tower walls. 11. Open joints in masonry at northeast comer — can see into the building from the outside. 12. Moss, mildew and ivy cover large areas on the west, north and east walls. 13. Sections of the roof and exterior walls are missing and the structural adequacy of these framing systems has been greatly reduced. The missing portions of roof and framing create walls that are unsupported laterally. Additionally, deteriorated portions of the walls appear to no longer have adequate capacity to support the roof structure. These factors create an unsafe condition that, in our opinion, may lead to partial or total collapse of the building shell. The purpose of our review was to determine the structural adequacy of the existing building. The building originally served as a church. However, in 2005 McComas Engineering, Inc. (MEI) was hired to provide design of temporary bracing and shoring of walls and roof trusses in conjunction with plans to change the building to a restaurant. On June 9, 2009, we visited the building to do a brief, visual walk-through survey in order to comment on the current status of the structure. The building consists of masonry walls supporting wood roof trusses and wood rafters covered by wood decking. Elevated floors in the building are comprised of wood joists and wood decking. The age of the building is not known. In 2005, MEI designed temporary lateral braces to support the exterior masonry walls after a portion of the floor had been removed. MEI also designed temporary scaffold shoring to support dilapidated trusses, as well as measures for repair of the trusses. During our site visit we noted that the wall braces and scaffold shoring were still in place, and it appeared that some of the truss repair measures had been undertaken. However, the truss repairs do not appear to have been completed. Generally speaking, there are virtually no areas of the building that remain watertight. Significant deterioration of the roof framing and exterior masonry walls was noted throughout the building. Some of the specific deficiencies noted were as follows: 1. Roof framing is missing in several areas, and significantly decayed in others. 2. Support for the west portion of the elevated floor is completely gone and floor members an; rotted and sagging. 3. The wood top plate that supports rafters and connects the roof to the masonry walls is deteriorated or missing along west and east walls. 4. Wood rafters and decking are deteriorated or missing in several areas. 5. Water penetration and deterioration of both the masonry and wood at truss bearing points in both east and west walls. 6. Prominent cracks and deterioration in all concrete lintels over windows and below trusses in east, south and west walls. 7. Eroded foundation in south wall at southeast comer. 8. Wall at entry stair has decayed joints and bows into the stair. 9. Wood framing over entry stair deteriorated and missing. 10. Significant cracks in masonry at north and west tower walls. 11. Open joints in masonry at northeast comer —can see into the building from the outside. 12. Moss, mildew and ivy cover large areas on the west, north and east walls. 13. This properly is currently zoned as residential (S-1), and as I explained to you during our initial personal contact on April 5, 2010, the landscaping/mowing business being operated from your residence was in violation of Carmel/Clay Land Use Regulations. The only standards that permit for a business to be nun from a residential property are outlined in Carmel/Clay Land Use Regulations $25.18 Home Occupation. I've included a copy of the Home Occupation standards for your reference. Please note that the Home Occupation standards prohibit the dwelling to bear any indication that it is being used for anything other than a dwelling. Failure to discontinue operations by May 22, 2010 will result in further Enforcement action to include the issuance of citations, which can be issued daily as long as the violation persists, and which also requires mandatory appearance in Carmel City Court. Also, on April 27, 2010 during a re -inspection of your property I noticed a six (6) foot privacy fence being erected in the front yard of your property. I advised the man erecting the fence to stop since comer lots (like yours) have two front yards, and since the fence was over the maximum height allowed for a front yard that it would be considered in violation. I also explained this to you in a subsequent phone conversation, and I advised that you could apply for a variance for the fence and a Use Variance for the Home Occupation. You indicated this would be the options you would pursue. In a later phone conversation you noted that you had the illegal fence completed so that it would appear more favorable to the Board of Zoning Appeals. Carmel/Clay Zoning Ordinance $25.02 regulates all fencing in residential zoning districts: ONEQVICSQUARE CARME1,INDIANA46032 317/571-2417 25.02 Fences. 25.02.01 On residentially used or zoned tots of less than two acres, fences located within any required front yard shall not exceed forty-two (42) inches in height, as measured from the topmost point thereof to the ground adjacent to the fence.
