Docket No. 12070021 OA: Carmel Dr— Range Line Rd Overlay Sunset Amendment The applicant seeks to amend the Zoning Ordinance, Chapter 23F: Carmel Drive-Range Line Road Overlay Zone in order to modify development standards and remove the sunset provision (expiration date). Filed by the Carmel Department of Community Services. Please see the revised proposal to modify the standards and extend the sunset provision (expiration date) of the Carmel Drive — Range Line Road Overlay Zone. Special Studies Committee Discussion & Recommendations: Overall the Committee agreed that there are many benefits to keeping the Carmel Drive — Range Line Road Overlay Zone. However, the two concerns noted were regarding the requirement of an entrance at the corner of a building and the requirement of a second story. With absence of agreement over a solution to the 2 story requirement and concerns for the need of the Council to have their full 90-day review period before the end of the year, the committee recommended that the corner entrance requirement be eliminated and the sunset be extended for another year. A draft ordinance is attached with the committee recommendations highlighted. ONE CIVIC SQUARE CARMEL,INDIANA 46032 317/571-2417 I I Sponsor: Councilor Rider 2 3 ORDINANCE Z-###-12 4 AN ORDINANCE OF THE COMMON COUNCIL OF THE 5 CITY OF CARMEL,INDIANA 6 7 An Ordinance amending the standards and removing the sunset provision of the Carmel Drive—Range Line 8 Road Overlay Zone in the Carmel Zoning Ordinance 9 10 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC 36-7-4), 11 each unit of local government that wishes to adopt land use and zoning ordinances must first approve by 12 resolution a comprehensive plan for the geographic area over which it has jurisdiction; and 13 WHEREAS, the Carmel Clay Comprehensive Plan "C3 Plan 2009" Docket No. 08070020 CP was 14 given a favorable recommendation by the Carmel Advisory Plan Commission on November 18, 2008, and 15 duly approved by Resolution No. CC-05-04-09-02 of the Common Council on May 4, 2009, and is therefore 16 the official Comprehensive Plan of the City of Carmel and Clay Township; and 17 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning Ordinance; 18 and 19 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the 20 text of the zoning ordinance; and 21 WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D-1600-02, the 22 Carmel Zoning and Subdivision Control Ordinances are incorporated by reference into the Cannel City Code; 23 NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Cannel, Indiana, 24 that, pursuant to IC 36-7-4-600 et seq. and after Docket No. 12070021 OA having received a 25 recommendation from the Cannel Advisory Plan Commission on Tuesday, , 2012, it 26 hereby adopts this Ordinance to amend the Carmel Zoning Ordinance (Ordinance No. Z-289, as amended), to 27 read as follows: 28 Section I: 29 ZO CHAPTER 23F: CARMEL DRIVE—RANGE LINE ROAD OVERLAY ZONE 30 a. Exceptions include: 4 A. Buildings on lots with 120 feet or less of frontage provided they occupy the maximum amount 5 of frontage,except for driveways,sidewalks and landscape areas,as required by the Ordinance. 6 B. Frontages along public streets other than Carmel Drive or Range Line Road have no minimum 7 frontage requirement. 8 23F.06.03 :.' . .. ...
