If you have any questions, please give me a call at 571-2417. • Docket No. 12080007 Z: Old Town Neighborhood Rezone. The applicant seeks approval to rezone 22 parcels from the B-1/Business, 8-3/Business and B-5/Business District Classifications within the Old Town District Overlay Zone, Character Sub-Area to the R-3/Residence, R-4/Residence and 'B-5%Business District Classifications within the Old Town District Overlay Zone, Character Sub-Area. The • properties are located along 1st Avenue NW, 1st Avenue NE, 2nd Avenue NE, 1st Street NE, 2nd Street NE and 5th Street NE. Filed by the Carmel Departmentof Community Services. NOTE:A suspension of the Plan Commission's Rules of Procedure will be necessary to hear the-above item. The 25-day public.notice requirement was met with respect to newspaper publication and Certified mailings; however, public notice signs were placed 18 days prior to the public hearing. Additionally, due to the time and costs invoked with sign preparation, some signs are shared by houses in the same block. The.Department-of Community Services proposes to'rezone several properties in the Old Town area, north of Main Street. The purpose of this effort is to further protect the residential nature of the area by reducing the presence of business'zoning districts in residential areas and limiting the types of business uses adjacent to residences., All of the subject properties will remain in the Old Town District Overlay Zone, Character Sub-Area and subject to the requirements of Zoning.Ordinance Chapter 23D: Old Town District Overlay Zone. Enclosed you find a ma• and address list to help identify the properties affected by this: ro osal: Of the 22 y - p p � Y p •p Y P p parcels included in this rezoning proposal, 20 are proposed to be changed to a residential zoning district to match surrounding properties in the R-3/Residence and R'-4/Residence Districts. Currently these properties are:used as residences, and therefore, would not be affected by rezoning' to a residential district. The remaining two parcels are located at the edge of the residential neighborhood at the NE and NW corner of 1st Avenue' NE and 1, Street NE. 'Both properties are in the B-1/Business District and have been or are currently st ' being occupied by businesses. DOCS Staff believes the B-5/Business District could be a better fit with the adjoining neighborhood due to the limited number of permitted uses in B-5. A brief summary of the B-1 and B- 5 Districts 'is included in the enclosure. Carmel Zoning Ordinance B-1/Business District: The purpose of this district is to provide primarily for light commercial and office uses:to be developed as a unit or on individual parcels. The intent is to provide an area where lighter businesses may locate, protected from encroachment of other uses,with minimal requirements. Permitted Uses include Offices,Schools, Retail &Service Uses, Galleries and Restaurants. See full requirements in Zoning Ordinance Chapter 12&Appendix A. B-S/Business District: The purpose of this district is to provide a location for office buildings and general offices protected from encroachment from heavier commercial uses; Inasmuch as this district is frequently found in close proximity to residential areas and/or intermixed with residential areas, it is the intention of this district to allow for a compatible mixture of the two uses with reasonable regulations. Permitted Uses include Residential, Offices, and limited Retail &Service Uses. See full requirements in Zoning Ordinance Chapter 16&Appendix A.
