A portion of the subject parcel will be taken by the State of Indiana (the "State ") for use as public right -of -way (see attached exhibits) in the Indiana Department of Transportation's project to make US 31 a limited access roadway. The taking of a portion of the real estate for right -of -way, as illustrated in the attached exhibits, will impact existing setback, parking and landscaping requirements. Section 23B.08.01 of the Zoning Ordinance addresses setbacks and build -to- lines, Section 23B.12 and 27.08 of the Zoning Ordinance addresses parking requirements and Section 23B.10 of the Zoning Ordinance addresses site landscape requirements. The taking by the State will result in inadequate room for the necessary setbacks, the elimination of some required parking spaces and the elimination of required landscaping and landscape area. Absent relief from the above noted requirements of the Zoning Ordinance, the taking by the State will result in non - compliance with the Zoning Ordinance and, as such, the Applicant is requesting the subject variances.
