The Carmel Plan Commission offers you the following report on the application (Docket No. 11050013 Z)
of Silvara Real Estate Company, LLC, petitioning the Commission for a favorable recommendation to
rezone approximately 281 acres located northwest of 116`'' Street and Spring Mill Road, from S-1 and S-
2/Residence to PUD/Planned Unit Development.
The Carmel Plan Commission's recommendation on the petition of the applicant is"FAVORABLE."
At its regularly scheduled meeting on October 18, 2011, the Carmel Plan Commission voted eight (8) in
Favor, three (3) Opposed (Judy Hagan, Susan Westermeier, and Nick Kestner), zero (0) Abstaining to
forward to the Common Council the proposed Ordinance Z-553-11 with a FAVORABLE recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-
4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified
by the Commission. Ninety days from the date of this Certification (October 21, 2011) is Thursday,
January 19,2012.

Favorable Recommendation of Silvara PUD to the City Council subject to the following
changes:
1. Add the following definition to Section 2, Definitions: "Apartment: A Multiple Family
Dwelling owned by a single person or entity in which the Dwelling Units are rented or
leased."
2. Add to Section 5.2, Accessory Buildings and Uses, the following: "...Chapter 25.02 of
the Zoning Ordinance shall apply to fences. Fences within bufferyards that are adjacent
to Spring Mill Road or Clay Center Road ("Perimeter Bufferyards") shall be of a uniform
material, style and height within a Planning Area. Fences within lots that are adjacent to
Perimeter Bufferyards shall be of a uniform material, style and height within a Planning
Area.
3. Modify the second sentence of Section 10.3, On-Street Parking, as follows: "On-street
parking spaces may not be counted as part of the total parking spaces required if available
and adjacent to the lot it serves."
4. Modify Section 14.2, Infrastructure and Environmental Standards, as follows: "All
public infrastructure within the District shall adhere to the City's standards and design
criteria, unless otherwise stated within this Ordinance or unless specific waivers have
been approved by the City. In addition, tThe District shall comply with the requirements
of the Thoroughfare Plan in accordance with Chapter 2.09 of the Zoning Ordinance. At
such time as requested by the City and upon the enactment of this Ordinance, the Master
Developer shall cause to he conveyed and dedicated to the City of Carmel for public
right-of-way use one-half of the full right-of-way width prescribed in the Thoroughfare
Plan, as measured from the centerline of 116"' Street and Spring Mill Road, across the
entirety of Hamilton County Parcel No.: 17-09-34-00-00-019.000. This dedication of
right-of-way will allow the City to construct an expanded roundabout and related
improvements at the intersection of 116th Street and Springmill Road, including the
extension of a Side Path along Sprint., Mill Road from 116th Street to the Real Estate."
5. Add a Section 2.5 to Exhibit I, Village Neighborhood Architectural and Design
Standards, to read as follows: "Multi-story Buildings shall have a variable orientation
along Spring Mill Road (e.g., varied setbacks, angled or skewed)."
