SURVEYOR'S REPORT Ci,ent: Coldweii Banker - Cro,g Kaiser Number- 95 -399 Type of Survey; Inaorio Minimum Standords Survey (Recert,F, cation) Ci,ss of Sur ,/ey: Cross C Survey (865 IAC 1 12) F.etd Work Completed Apr-,I 24, 1995 Location o+ -urvey P,,rt of the Northwest Quarter, Section 26, Township 18 North, Range 4 East and port of the Northeast Quarter, Section 27, Township 18 North, Range 4 East, all .n Hamilton County, Indiona. note: The Theoret, coi Uncertainty of the corners of the sU&ject tract established this survey, is within the s, _.fications r"or o Class C Survey ( +/-0.50 foot) as dr:,ned in 8o` IAC 1.12 ( Theoretical Uncertainty of c r-eosuremer t ,s the radius of o circle which c,r _.Amscribes un area containing the probable true ic, ton of o specified point as determined by the pi-r, =,sion of tree instruments and procedures employed ,r) trle performcnce of a survey). In accordance with Title 865, Article 1, Chapter 12 of the Indiana Administrative Code (IAG), the following observations and opinions are submitted regarding the uncertainty in the position of the tines and corners established and /or reestablished on this survey as a result of: 1) Availability and condition of reference monumentsi 2) Clarity and /or ambiguity of the record description(s) used and /or the od joiner's descriptions; and 3) Occupation or possession lines. 4) Measurements (Theoretical Uncertainty) Note: There may exist unwritten rights associated with these uncertainties. Attention is called to the fact that in many locations, the original section corners hove not been perpetuated or hove been lost. In these instances, the only evidence available to indicate the true positions of original corners is existing topographical features and current monuments. Lacking the aforementioned evidence, a surveyor may resort to proportional measurement to reestablish section corners. Section corners that are not original are usually classified as Title Corners. Since undiscovered information may affect the true position of a title corner, the uncertainty in a title corner is unknown. AVAILABILITY and CONDITION OF REFERENCE MONUMENTS The boundaries of the surveyed tracts were reestablished based upon a previous Land Title Survey of part of the Northwest Quarter of Section 26, Township 18 North, Range 4 East and part of the Northeast Quarter of Section 27, Township 18 North, Range 4 East, oil in Hamilton County, Indiana prepared by Weihe Engineers, Inc. as Job #91 -585 on June 27, 1991. During recent field activity by Weihe Engineers field personnel, several monuments (i.e. iron rebors, stone markers, etc.) were located at or near grade level and n fair to good condition. The monuments found (see plat of survey, sheet I of 3) were some of those which were referenced in the aforesaid Land Title Survey prepared by Weihe Engineers, Inc. - in June, 1991. Distances between these monuments were mathematically checked and found to agree with those distances shown on said survey; thus, said monuments were accepted as good control monumentation for the reestablishment of the boundary lines of the surveyed tracts. It is this surveyor's professional opinion that the uncertainty in the lines of the surveyed tract due to the availability and condition of reference monuments is +/- 0.30 feet. CLARITY and /or AMBIGUITY OF RECORD DESCRIPTIONS The record deeds for Parcels #3, 4, 5, 7, 8, & 9 of the surveyed tracts and the adjoining real estate were obtained from the Office of the Hamilton County Recorder and mathematically retraced in an effort to disclose any possible record deed gaps and /or overlaps. A 4.80 foot record deed gap between the most westerly line of Parcel #5 of the surveyed tract and the west adjoining real estate (Instr. #94- 46245) was discovered during this mathematical retrocement (see plat of :iur -ey, sheet 1 of 3). It is this surveyor's professional, opinion tnc.t this record deed gap was caused by the tack of horizontal control in the record description of the west ad joiner to the most westerly line of Parcel #5 of the surveyed tract. It should also be noted that during the course of this retracement some ambiguity in the record description for the east adjoiner (Instr. #94- 25771) was discovered. A basis of bearing was not noted in said record description; however, the call for the boundary line adjoining the most easterly , boundary of Parcel #3 of the surveyed tract was given an arbitrary bearing. Because of the lack of a basis of bearing (known or assumed), the arbitrary bearing given in said record description may cause a record deed gap and /or overlap between lthe easterly line of Parcel #3 and said east ad joiner, but it is uncertain of the amount if any. OCCUPATION and /or POSSESSION LINES At the time of the field survey, April 24, 1995, the following physical evidence was discovered between the lines of the surveyed tracts and the adjoining properties- 1.) Sone deteriorating Farm fences were found running along the boundaries of Parcel #5 and the West and South ad joiners, Instrument #'s 94 -46245 and 89- 24773, respectively (see plat of survey, sheet 1 of 3). A carport, located on Parcel 1116, was found encroaching frpm 3.8 to 12.3 feet onto a portion of Parcel #5 of the surveyed tract (see plat of survey, sheet #2 of 31. As o result of the above observations, it is my opinion that the uncertainties in the locations of the lines and corners estoblished on this survey are as follows: Due to Variances in reference monuments: See above Due to Discrepancies in the record descriptions: See above Due to Inconsistencies in lines of occupation: See above 95399-rep wc172 This survey was performed under the direction of the undersigned, and to the best of this surveyor's knowledge and belief was executed according to survey requirements in 865 IAC 1.12 for the State of Indiana and the field work was completed on April 24, 1995.
