(, Tp1(1 OW !NDI.% MINUTES Carmel Board of Zoning Appeals Special Meeting Tuesday, September 18, 2012 5:45 pm Caucus Rooms, Carmel City Hall Present: James Hawkins, President Kent Broach Alan Potasnik Connie Tingley, Recording Secretary Staff members in attendance: Alexia Donahue Wold,Planning Administrator Angie Conn,Planning Administrator Adrienne Keeling,Planning Administrator Plan Commission members: Kevin Rider Steve Stromquist Legal Counsel: John Molitor New Business: 1. Rules of Procedure Discuss changes to the Board of Zoning Appeals Rules of Procedure and Public Notice requirements. John Molitor: ® Change needs to be made to Rules of Procedure in order to comply with State Law and Open Door Law with regard to publication of notices in the newspapers ® Legislature.changed State Law a couple years ago o Necessary to publish notices in a daily newspaper that is published and circulated in the County o Current BZA Rules of Procedure say the Indianapolis Star which circulates here but is not published here o Rules are out of compliance with State Law o Only newspaper that complies is Noblesville Times ® Council is now publishing in Noblesville Times ® Recommended Rules of Procedure be changed to comply WWW.CARMEL.IN.GOV Page 1 of 3 (317) 571-2417 Carmel Board of Zoning Appeals Special Meeting September 18,2012 Discussion: • Less citizens will see it • Need to talk to our Legislators • No other newspaper published daily in the County to meet the requirement • Current is published and distributed weekly • Certified mail and signs notify neighbors of any meeting John Molitor: • Another issue is requiring citizens to give their name and address when they address the Board Discussion: • BZA does not require "blue cards" with name and address be submitted before speaking o Citizens may decide at Public Hearing that they want to speak • Some citizens have been harassed after City Council meetings • Required to sign up with Staff if a lawsuit is involved • Could give name and street or subdivision or residency • BZA and Plan Commission Rules of Procedure are the same for newspaper and name and address of speaker • Petitioner could still advertise in Indianapolis Star, at double the expense John Molitor: • Could require them to publish in Noblesville Times and Indianapolis Star • Noblesville Times notified the City with regard to the requirement James Hawkins: • Would be hesitant to waive any public notice sign issues John Molitor: • Lawyers and title companies know they need to subscribe to Noblesville Times to watch notices • Few people read the public notices Motion: On a motion made by James Hawkins and seconded by Kent Broach: The BZA Rules of Procedure be changed to require public notice in the Noblesville Times to comply with State Law. MOTION CARRIED UNANIMOUSLY(3-0) Motion: On a motion made by James Hawkins and seconded by Kent Broach: The BZA Rules of Procedure be changed to ask for name and community, rather than address,of citizens speaking at BZA meetings.
