• Concerning the apartments at 440 1st Ave NE feel that the car-
• port does not look right there close to the street and its out of character
for the neighborhood. I'm concerned because we also have investment
properties in Old Town Carmel. I'm not happy that the apartment unit
increase was approved because of the downtown overlay. I live at 311 5th •
St NE. We have a neighbor at 320 5th St NE that was granted a variance
so he could build within approx 10' of the street. It should have been
turned down. It too is out of character. I hope that 440 1.st Ave NE carport
does not get approved. Holding the cities board members feet to the fire
doesn' t work if our property values go down the drain. I would like to do
some improvements on mr own house for it is due , but I'm holding off to
see if theres any improvement in these situations. The streets are narrow
now and adding that much parking on our streets.will make it very hard to
drive with both sides of the street being used for parking to accommodate
for that many units.

Dear Angie:
When my wife and I started planning to build our new home on First Avenue NE, we
contacted the DCS regarding the building code for Old Town, Carmel.
We were given explicit directions regarding building heights and setbacks, especially
from the front sidewalk.
The carport under construction at Fifth Street NE and First Avenue NE abuts the
sidewalk. We were instructed there was a minimum setback from the sidewalk of
twenty-six feet. We also submit, the presence of a carport on the front of the structure
is inappropriate and counter to the character of Old Town.
My wife and I drove the streets of Old Town north of Main Street on both the east and
west side of Range Line Road; We found the following:
- a small carport at 431 Second Avenue NE in front of the garage that extends to
the front edge of the single-family home and is more than 25 feet from the sidewalk.
- We found three other carports at apartment .complexes (331 First Avenue NW,
Fourth Street NE, and Fifth Street N.E). Two, at 331 First Avenue NW and at Fourth
Street NE were located behind the buildings. The one at Fifth Street NE had a carport
at the side of the building and was located more than 40 feet from the sidewalk.
We object to a carport'located in front of the building. This is contrary to instructions
we received regarding building in Old Town. The carport under construction extends
clear to the sidewalk and is out of place on the building being renovated.

As a side note, may i ask what your primary concern is'? Is it the fact that it would be a carport, it is the
architecture/design of the carport, or'that it appears to be too close to the street'?

Good afternoon Richard- I am sendingthis BZA variance info to you ahead,of time just in case it is determined
thatyour-only option is to seek BZA variance approval for the location of the carport,

For this typeof petition,we could send you the route of the BZA hearing officer.Those meetings are around 5:30
pm,right before the regular BZA meetings, and only one member of the BZA would vote on your item. The public
notice is 10 days prior,rather than 25. Also,the filing fee is less,at$154.00,but we could waive that filing fee due
to the circumstances.
The next BZAhearing officer meeting is Feb.27,so if you can get us the application asap,then we can process it.
We would need it by Feb. 10 at the latest. Public notice would need to be done by Feb. 15 to the IndyStar and by
Feb. 17 to the neighbors(see application for instructions). If this is too soon for you, then the next BZA meeting is on
March.26.
