Forwarded with afavorable recommendation: Ordinance Z-562-12 (Docket No. 12070021 OA): Carmel Dr—Range Line Rd Overlay Sunset Amendment Petition to amend the Zoning Ordinance,Chapter 23F: Carmel Drive—Range Line Road Overlay Zone, in order to modify development standards and extend the sunset provision. Filed by the Carmel Department of Community Services. Please find enclosed the Plan Commission-certified ordinance to modify development standards and extend the sunset clause in the Carmel Drive—Range Line Road Overlay Zone. Adopted in 2005, the purpose of the Carmel Drive— Range Line Road Overlay Zone is to enhance the livability of Carmel by encouraging a range of activities in mixed-use buildings, and to establish an attractive and safely designed pedestrian oriented environment in buildings and along streetscapes. The original expiration date of December 31, 2006 was inserted into the Overlay as a trial period to ensure that if major problems arose, the regulations would expire. The sunset period has been extended for several years. Staff, Plan Commission and City Council have agreed over the years that the Carmel Drive— Range Line Road Overlay Zone is a valuable tool which has improved development in the corridor. However, it has been made clear that adjustments need to be made before considering this Overlay Zone to be permanent. Proposed Amendments: In addition to a 1-year extension of the sunset (expiration date), several amendments are proposed. These amendments take into account several years of development examples, as well as analyzing which standards have been the subject of variances. They are summarized as follows: 1. Permitted Uses: Residential will no longer be limited to 75% of a project's gross floor area. 2. Building Orientation: The requirement that 70% of frontage is occupied by buildings has been clarified to only apply along the Carmel Drive and Range Line Road frontages, and not to cross-streets such as Shoshone Drive or Medical Drive. 3. Building Footprint: Eliminate the minimum floor area ratio (FAR)requirement. 4. Pedestrian Circulation: Sidewalk widths shall be increase to 12' from 8'. This figure matches the standard for Urban Commercial Sidewalks in the C3 Plan. 5. Parking: a. Second story square footage will not be included for the purpose of parking calculation. We've heard that some of the complication of requiring a second story is the additional land and costs associated with parking. b. Bicycle Parking will now reference the Bicycle Parking standards in ZO Section 27.06, which have been adopted since this Overlay. 6. No. 12070021 OA) of the City of Carmel Department of Community Services petitioning the Commission for a favorable recommendation to amend Chapter 23F of the Zoning Ordinance, Carmel Drive-Range Line Road Overlay Sunset Amendment, in order to modify development standards and remove the sunset clause (expiration date.) The Carmel Plan Commission's recommendation on the petition of the applicant is `FAVORABLE.' At its regularly scheduled meeting of September 18, 2012, the Carmel Plan Commission voted nine(9) in Favor, zero (0) Opposed, zero (0)Abstaining, to forward to the Common Council the proposed Ordinance No. Z-562-12 with a Favorable Recommendation. Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-4-607(e) the Council has ninety(90)days to act on this petition before it becomes effective as Certified by the Commission. Ja or e rman, President -�- A ST: R. ona Hancock, S-cretary � .tj ( d Z 130 llQl Cannel Plan Commission Dated: October 2, 2012 1 Sponsor: Councilor Rider 2 3 ORDINANCE Z-562-12 4 AN ORDINANCE OF THE COMMON COUNCIL OF THE 5 CITY OF CARMEL,INDIANA 6 7 An Ordinance amending the standards and extending the sunset provision of the Carmel Drive—Range Line 8 Road Overlay Zone in the Carmel Zoning Ordinance 9 10 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC 36-7-4), 11 each unit of local government that wishes to adopt land use and zoning ordinances must first approve by 12 resolution a comprehensive plan for the geographic area over which it has jurisdiction; and 13 WHEREAS, the Carmel Clay Comprehensive Plan "C3 Plan 2009" Docket No. 08070020 CP was 14 given a favorable recommendation by the Carmel Advisory Plan Commission on November 18, 2008, and 15 duly approved by Resolution No. CC-05-04-09-02 of the Common Council on May 4, 2009, and is therefore 16 the official Comprehensive Plan of the City of Carmel and Clay Township; and 17 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning Ordinance; 18 and 19 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the 20 text of the zoning ordinance; and 21 WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D-1600-02, the 22 Carmel Zoning and Subdivision Control Ordinances are incorporated by reference into the Carmel City Code; 23 NOW, THEREFORE,BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, 24 that, pursuant to IC 36-7-4-600 et seq. and after Docket No. 12070021 OA having received a favorable 25 recommendation from the Carmel Advisory Plan Commission on Tuesday, September 18, 2012, it hereby 26 adopts this Ordinance to amend the Cannel Zoning Ordinance (Ordinance No. Z-289, as amended), to read as 27 follows: 28 Section I: 29 ZO CHAPTER 23F: CARMEL DRIVE—RANGE LINE ROAD OVERLAY ZONE 30 a.
