Basic Information
The following information was provided by the petitioner:
Number of employees:4
Number of Students: Max per day=25;30 to be conservative
Hours of Operation:9:00 am—11:30 am and 11:30 am—2:00 pm
Staff arrives at 8:30 am
Drop off starts at 8:50 am and ends at 9:10 am.
Some students leave at 11:30 am;the rest leave at 2:00 pm.
Traffic Analysis
The ITE Trip Generation Manual does not have a classification that fits this use.The classification that most closely fits the proposed
use is"Daycare".The 1990 data for a day care states that there are 5-trips per child per day or 80-trips per 1,000-square feet per
day. 19%of these trips occur in the morning peak and 18%of these trips occur in the pm peak with a ratio of 5 vehicles entering to 5
vehicles exiting at any given time during the peak hour. Due to the fact that there are staggered departure times in the afternoon,
the morning peak was the only time considered in this analysis. Using trips per child as the basis,the am peak hour would be
expected to generate 28 vehicles(approximately 1-vehicle every 2-minutes assuming an even distribution of arrivals throughout the
hour). Using square footage as the basis,the peak hour would be expected to generate 24 vehicles in the morning(approximately 1-
vehicle every 2.5-minutes under the same arrival distribution assumptions).The petitioner has indicated that drop off is to occur
within a 20-minute time frame.30 vehicles in 20-minutes equals 1-vehicle every 40-seconds. 1-vehicle every 40-seconds is more
intense than the ITE data for"daycare"and assuming an even distribution throughout the peak hour. However,the petitioner has
indicated that the parents will not need to leave their vehicles and that two staff members will meet each vehicle and walk the
students from the car to the building. In any case, it is not possible to establish the distribution of drop offs(how many vehicles
arrive at a given time)within this timeframe without direct observation.The 1990 data states that the peak number of vehicles
arriving at any given time within the peak hour is 5.The number of on-street parking spaces available is 7 or 8(please see below).

Current parking restrictions
• No parking within 30-feet of a stop sign per State Code
• No parking within 30-feet of a crosswalk per City Code.
• There is No Parking on the east side of 3rd Avenue N.E. from 1st Street N.E. north to 2nd Street N.E.at any time unless vehicle
has a valid residential sticker.
• Between 8:30 am and 9:30 am, Monday through Friday while Carmel Clay Schools are in session,parking is restricted(1)on the
west side of 3rd Avenue NE between 1st Street NE and 3rd Street NE;(2)on the east side of 3rd Avenue N.E. between 1st Street
N.E.and 3rd Street N.E.;(3)on either side of 3rd Avenue N.E. However,there is a provision in the City Code that exempts
vehicles that have a residential sticker or that are guests of the residents who have an address which abut these segments of 3rd
Avenue NE.
Available on-street parking spaces
With the restrictions for parking in the vicinity of stop signs and crosswalks, existing driveways and alley cuts, I estimate the number
of on-street parking spaces available on the west side of the roadway between 152 Street NE and 2md Street NE to be 7 or 8.
Roadway geometry
The roadway width is approximately 24-feet. Parking is generally allowed on the west side of the roadway outside of the hour
between 8:30 am and 9:30 am when Carmel Clay Schools are in session.An area of 8-feet for a parked vehicle results in a net
roadway width of 16-feet. In Old Town,this is generally considered adequate for maintain two way travel with one vehicle yielding
to another vehicle.There are actually roadways in Old Town that have less then this pavement width available to maintain two way
vehicular traffic.
Evaluation of proposed Circular Driveway
The Department does not support the proposed circular driveway for the following reasons:
• The creation of a second curb cut close to the intersection;
• The creation of an additional pedestrian-vehicle conflict point;
• Widening the distance pedestrians must cross before being solely on the sidewalk(they would need to cross the drive cut and the
alleyway);
• The loss of three existing on-street parking spaces;
• The fact that in the event that more than two or three cars arrive at the same time for drop off or pick up,the extra cars will be
staged in the right-of-way or utilize the on-street parking to the north anyway.
Evaluation of angled and parallel parking
Engineering has explored the creation of angled and perpendicular parking across the property frontage. More spaces would be
gained but would require the sidewalk to push up into the property, near the structure.These spaces would need to be available to
the public and would need to be restricted at certain times so that they could be used by the business...which is not something that
we typically do.
Conflicts with High School Traffic
The Department understands that High School starts at 7:50 am and gets out at 3:10 pm; outside of the peak hours of the requested
use. Excepting High School drop off and delivery times,the Department does not have any evidence that this roadway experiences
high volumes of traffic.The Department has checked with Carmel Clay Schools as to this roadway being used by school buses during
pick up and drop off times. Carmel Clay Schools has indicated that the buses do not use this road.
Other options
The petitioner has indicated that the option to pave the alley versus constructing the on-site circular driveway is not feasible from a
cost standpoint.
Recommendation
The Department is of the opinion that 3rd Avenue NE in its current configuration is able to accommodate the peak traffic from the
requested use for the 20-minute drop off timeframe each day between 8:50 am and 9:10 am.

I am writing you in regards to Carey Addition Lot 3 that Starting Line Preschool would
like to zone for educational use. My name is Maryann Williams and I attended the last
BZA meeting in May. I have been a teacher for Starting Line for 5 years, I have lived in
Carmel for almost 17 years and my four sons attend the Carmel schools. While listening
to the concerns expressed in the last meeting, I was very frustrated that the floor had been
closed and that others could no longer respond to the concerns brought forth. This is my
response.
With regards to traffic, I do not understand why the board has an issue. The high school
traffic backs up from the freshman parking lot all the way to Rangeline some days and for
a period of at least 30 minutes as well as traffic in the area is constant going to the high
school from 7 A.M. in the morning until 8 A.M. not to mention the mess that the high
school creates in the afternoon. Our drop off times are well after the high school students
are in class and our pick up times are well before the high school students are done with
class. Starting Line Preschool's drop off and pick up would at the most be on the street
for 10 minutes coming and 10 minutes going and all in one direction. Nothing could be
as bad as the high school traffic, so how can our 20 cars have you all in a dither?
It seems that you were also concerned with safety for the preschoolers. Starting Line
Preschool wants to provide a safe home type environment for its students with a low
teacher to child ratio. We are looking to purchase the home for that very reason. A sweet
home in the middle of a Carmel business/residential neighborhood is the perfect venue
whereas what some of you are suggesting, a strip mall, or the property by the guns and
ammo building on Rangeline are absolutely ridiculous options even though they are
currently zoned for our purposes. How can those options be considered safe at all?
Being a resident, I would much rather see a small preschool in the arts and design district
than on the outskirts of the city in a strip mall. Preschoolers are soaking in and learning
from their environment everyday. At Starting Line Preschool we expose our students to a
rich variety of the arts and what better place to house ourselves than the Arts and Design
District where we can learn and even contribute to the atmosphere that is Carmel.
I am completely saddened by the BZA board and their lack of concern for this business
that has been in operation in our great city for 18 years. It has come to my attention that
a small preschool was located on Rangeline for a few years and has now moved into the
Monon Center. I have a sinking feeling that the city of Carmel is trying to make it
impossible for Starting Line Preschool to stay in business, so that another preschool that
has ties to the city can become more successful. Now, I may be wrong, but if it looks like
a bug, let's call it a bug.
Diane Atkins is the most honest, generous person that I know and when forced to move
her preschool to another location chose to take all the correct and legal steps by coming
to you with the simple request to zone a piece of property for a small preschool. Diane
follows all the rules. Safety of the children is her number one concern in all situations.
You could not find a better business owner to endorse than Diane. Someone who grew
up in Carmel, graduated from the public schools, raises her family in Carmel and operates
her business in the city she has always called home. By denying the zoning of the home
for Starting Line Preschool, you aren't only crushing a longtime resident, or a small
business, but you are displacing 20+ preschoolers from a school that they adore and
teachers who love them. Shame on you!

Alexia,thank you for meeting with Angie,Amanda and I this morning and again with the petitioner, her engineer,
Amanda and myself before lunch. I have outlined below some items for the Board to consider in the event that they
have not already weighed such factors in making their prior decision.
The current plan includes a paved drop off area at the front/east side of the house. I expect this area to allow two,
maybe three cars at a maximum to be staged for drop off and pick up. My thought is that while having a drop off area
outside of the roadway may be safer, we need to weigh this against several items, each of which poses its own issues:
1. The creation of a second curb cut close to the intersection;
2. The creation of an additional pedestrian-vehicle conflict point;
3. Widening the distance pedestrians must cross before being solely on the sidewalk (they would need to cross the
drive cut and the alleyway);
4. The loss of three existing on-street parking spaces;
5. The fact that in the event that more than two or three cars arrive at the same time for drop off or pick up, the
extra cars will be staged in the right-of-way or utilize the on-street parking to the north anyway.
I do not expect this to be a busy roadway. I checked with Carmel Clay Schools to see if school buses use this road during
pick up and drop off times. I recall the response was that the buses do not use this road.
Drop off is to occur at or around 9:00 am. Parking is restricted on the west side of 3rd Avenue NE between 1st Street NE
and 3rd Street NE between 8:30 am and 9:30 am, Monday through Friday while Carmel Clay Schools are in session.
However,there is a provision in the City Code that exempts vehicles that are guests of the residents who have an
address which abut this segment of 3`d Avenue NE. Patrons of this business may need to obtain temporary resident
stickers as guests of the property owner to utilize the on-street parking during the 9:00 am drop off time.
Engineering has explored the creation of angled and perpendicular parking across the property frontage. More spaces
would be gained but would require the sidewalk to push up into the property, near the structure.These spaces would
need to be available to the public and would need to be restricted at certain times so that they could be used by the
business...which is not something that we typically do.
Engineering has also discussed the potential to have the petitioner pave the east-west alley north of the property and
have the property owner require patrons to access the midblock alley between 2nd Avenue NE and 3rd Avenue NE from
15t Street NE and then turn onto the new alley and head east to a drop off area from the alley.Then the vehicles would
proceed east to 3`d Avenue NE. We have not established a cost for this paving to weigh it against the cost of construction
of the proposed on-site circular driveway.

In regards to Starting Line Preschool:
My name is Pamela Ocaranza and I live at 230 1st Street NE,Carmel, IN 46032 which is the house next to
the property in question for the school located at 110 3rd Ave NE.
I did come to the original public hearing last November 28, 2011(docket no. 11100019 SU)and was not
aware that this was not approved at that time. I have decided to write instead of attending this new
hearing since I voiced my opinion at that time.
Even though I'm not in favor of this school right next door to my house because of more traffic,added
noise to the neighborhood and my ability to sell my house, I have had discussions with Diane Atkins the
prospective buyer for the property. We had come to an understanding in November that I would be in
agreement with the school if a privacy fence was put up instead of the chain length fence which was in
the original plans. This would really help with privacy if we are in our back yard when the school is in
session and hopefully help to filter any noise from the children/business. The final issues for the fence
would be worked out if Starting Line Preschool is approved by the board between myself and Diane
Atkins with Starting Line Preschool.
In closing it appears the buyer of the property is really willing to work with the neighbors to make this
business work for everyone. The one good thing that might come out of all of this is better maintenance
for this existing property which has been neglected for several years.

only fill out the docket number and petitioner.
J 2. Please note that fences in the front yard must have at least 25%of its area open as viewed on any line
perpendicular to the vertical plane of the fence. Please make an adjustment to your proposed fence detail and
email me the revised version. See the regulations from Chapter 25 of the Zoning Ordinance below:
25.02 Fences.
25.02.010n residentially used or zoned lots of less than two acres,fences located within any required front yard shall not
exceed forty-two(42) inches in height, as measured from the topmost point thereof to the ground adjacent to the fence.At
least twenty-five percent(25%)of its area shall be open as viewed on any line perpendicular to the vertical plane of the
fence. Such open spaces must be reasonably dispersed throughout the entire area of the fence,except where solid stone or
brick walls are permitted. No primarily wooden fences shall be constructed within any required front yard adjacent to any
arterial,parkway or collector roadway(see also Subdivision Control Ordinance Section, 6.03.27).
3. Please provide any copies of letters that you have received from TAC members.
4. Also, please provide your Public Notice Sign Placement Affidavit as well as any other Affidavits necessary as a
part of this petition. Please refer to your application and instructions.

transportation. I have reviewed the project submitted for review for the May 16, 2011 Technical
Advisory Committee meeting, and the comments from the Alternative Transportation review have been
satisfactorily addressed.
We request that all responses to our comments be provided in writing. Failure to provide written
responses may result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted,
particularly if any such changes are considered"new" or fall outside of our previous reviews. Please
provide revised plans indicating all revisions. Please notify us of any changes and specifically state any
changes,including changes resulting from Plan Commission, Special Studies or other committee
meetings.

Hi Lex,
The sign is fine as proposed. 12 sq.ft.and 6'tall meets the Old Town section of the Sign Ordinance. The only comment I
might give is that the design seems a little busy. It might help to not have the yellow in their website and some kind of
color block behind their name. Other than that,just remind them that the sign has to be landscaped with something
other than grass and mulch.

Hi Diane,
The Department of Community Services has received your application for a Special Use at 110 3rd Ave NE for the Starting
Line Preschool. Unfortunately,we are not able to process your application at this time. This site was recently involved
in a previous special use petition and was denied by the board on November 28, 2011. Per Chapter 21,Section 21.02.05
of the Zoning Ordinance,whenever a Special Use application is denied,the property involved in the application may not
be the subject of a different Special Use application for a period of six(6) months following the date of the denial.
Therefore,your application can not be heard until the May 29th BZA meeting. I will keep a copy of your application until
that time. Please email me around April 14 to confirm your wish to proceed with the Special Use and I will process your
application at that time.
