Along the western boundary of this site, a 30 foot greenbelt is required and the petitioner is requesting this be reduced. Along the northern boundary there is landscaping required per the Landscape Plan and the petitioner is requesting all of this be allowed to be eliminated. The proposed additional sign will be 87.5 sq. ft. and will face north towards 146th St. Currently there are two wall signs— one facing west towards US 31 and one facing south towards the parking lot.There is also a ground monument sign at the entrance on the east side of the site facing Lowe's Way. The three existing signs are allowed by the PUD. The proposed sign on the north will help with identification to those traveling along 146`h St.The Sign Ordinance would allow a sign up to 95 sq. ft. to face north, since it is a public street.The applicant is asking for up to 100 sq. ft., which would be the same as what is allowed to face west. The department is supportive of these variances; however, we would like clarification on what landscaping will remain, if any. Findings of Fact 1. The approval of these variances will not be injurious to the public health, safety, morals, and general welfare of the community because: it will allow for the continued operation of the existing business, and a reduction in the landscaping and a new sign will be the only change to the use. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: this business already exists and a reduction in landscaping and a new sign will not have a substantial effect on the surrounding property which is mostly major roads. 2 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: it would require major changes to the existing site which could make the current use of the property difficult. Recommendation: After all comments and concerns have been addressed,the Dept. of Community Services recommends positive consideration of Docket Nos. 12040007 V and 12040009 V. 3
