ORDINANCE D- 2106 -12
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA.
ADOPTING A POLICY REGARDING NEPOTISM AND CONTRACTING WITH THE CITY
TO BE CODIFIED IN CITY CODE CHAPTER 2, ARTICLE 5, SECTIONS 2 -181 AND 2 -189,
RESPECTIVELY
WHEREAS, Indiana Code Sections 36 -1 -20.2 and 36 -1 -21, as added by P.L. 135 -2012, mandate
that the City establish certain policy requirements regarding nepotism and contracting with the City; and
WHEREAS, this Ordinance places the City in compliance with this new Indiana law, is in the
public interest, and should be adopted.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. The following policies should be and the same are hereby adopted by the City of
Carmel and shall be codified as set forth herein below:
"Section 2 -181 City Policy Regarding Nepotism.
(a)
The City shall adopt a nepotism policy that meets or exceeds the minimum requirements of Indiana Code
36 -1 -20.2, as the same may be amended from time to time, which is incorporated herein by this reference.
(b) Any City employee who fails to comply with this policy may be subject to discipline, up to and including
termination and /or other curative action. Any elected official who fails to comply with this policy may be
subject to such actions as are allowed by law.
(c) The City reserves the right to adopt by ordinance additional requirements regarding the subject matter of
this Ordinance."
The City's Human Resources Director shall, no later than 10 days from the date on which this Ordinance
is enacted, provide each City employee and elected official with a copy of the City's newly revised
nepotism policy and shall request such information as is necessary to ensure that the policy is unifoiiilly
enforced.
Section 3. The following policies should be and the same are hereby adopted by the City of
Carmel and shall be codified as set forth herein below:

"Section 2.189 City Policy Regarding Contracting with the City by Relatives of Elected Officials.
(a) The minimum requirements of Indiana Code 36 -1 -21, as the same may be amended from time to time, shall
be the City's policy regarding contracting with the City by relatives of elected City officials, and the same is
hereby incorporated herein by this reference.
(b) Any elected official who fails to comply with this policy may be subject to such actions as are allowed by
law.
(c) The City reserves the right to adopt by ordinance additional requirements regarding the subject matter of
this Ordinance."
The City's Director of Administration shall, no later than 10 days from the date on which this Ordinance
is enacted, provide each City employee and elected official with a true and accurate copy of Indiana Code
Section 36 -1 -21.
Section 4. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor and such publication as is required by law.
