Time: 9:00 a.m. 9:00 a.m. (UV) Tom Wood Parking Lot. The applicant seeks the following use variance approval for a surface parking lot on a residentially zoned property: Docket No. 12080016 UV ZO Ch. 6A1.01 Permitted Uses The site is located at 9624 Day Drive. It is zoned S-2/Residence. Filed by Paul Reis of Krieg DeVault for Tom Wood, Inc. and (CA) Docket No. 12080017 CA: Tom Wood Day Drive Access. The applicant seeks to amend a commitment made in 1969 as a part of the BZA Special Exception approval for an auto dealership, to allow access to Day Drive. The site is located at 3130 E 96th Street. It is zoned B-3 within the Keystone Overlay Zone. Filed by Paul Reis of Krieg DeVault for Tom Wood, Inc. Roger Ward with Roger Ward Engineering, Jim Burroughs with Philip Burroughs & Associates, Paul Reis with Krieg DeVault LLP, and Julia Allman presented on behalf of the petitioners. The petitioners are seeking a use variance from the BZA, who has asked the petitioner to look at the drainage so if a variance was granted, the site could be properly drained. The property is adjacent to Day Drive along 96`'' St. The purpose of this lot is to be an overflow display parking lot for Tom Wood Ford. Immediately to the west is the 96"' street office/condo park that was developed by Paragus Development. There is a detention pond in the back of this property which all drainage flows into. The water then discharges out of the pond to a storm sewer along 96�' Street. Paragus Development also acts as the property manager for development, and they are open to this project running drainage to their pond. Petitioner has received drainage calculations from the county surveyor's office, and also the original plans. The petitioner is proposing a standard drainage plan with inlets. Mr. Reis added that Day Drive is a private street, with City water, and City sewer service. Water lines are on the west side of the road and sewer is on the east. Joanie Clark — Vectren Energy - Vectren does not have services in the area, and there are no objections to this project. Greg Hoyes — Hamilton County Surveyor's Office - Letter sent. This area has been annexed and is now part of Carmel's jurisdiction. No further comments. Dan Davenport — Indianapolis Power & Light - There is an overhead line along the west side of the property but this project should not interfere with the line. Ms. Foley asked Mr. Ward if the drainage calculations have been submitted to Crossroads Engineering. Mr. Ward said the plans have not yet been submitted. Ms. Foley said there are some concerns regarding Day Drive serving as essentially a third curb cut along 96"' Street. Engineering is trying to determine if this would potentially conflict with the future plans for the area. Mr. Ward said regardless of this project, Larry Heid at Tom Wood has been active in connection to the 96r'' & Keystone upgrade, and this project will affect their property. Ms. Foley said Tom Wood would most likely lose a curb cut. Mr. Ward said Mr. Heid is aware of this. Ms. Foley said she was not sure if this would affect BZA approvaL Ms. Donahue-Wold said TAC is part of the use variance process and if there are changes made to the site plans because of suggestions in TAC, this could affect how BZA votes on the project. This is why the City would like TAC approval prior to BZA. John Thomas — City of Carmel Engineering - Project is still being reviewed. No further comments. Ryan Hartman — Clay Township Regional Waste - E-mail sent. Petitioner will need to show sanitary sewer marked on the plans. Mr. Hartman asked if the developer will be leaving the house, which currently stands on the property. Mr. Ward said the house can be maintained if needed. Daren Mindham — City of Carmel Urban Forestry - Waiting for plans to review. Alexia Donahue-Wold — City of Carmel Planning & Zoning - Asked petitioner to consider permeable pavement instead of the typical pavement. Mr. Ward said this is something being discussed with the client. Ms. Donahue-Wold asked Mr. Reis for verification that Day Drive is a private road. Mr. Reis said the problem is that it's difficult to prove the negative. He added that there are a series of roads going north from 96r'' Street in which the property line goes to the center line, and looking at the title work there is nothing showing up as a grant of right-of-way. Mr. Burroughs said he has a map of easements from the Recorder's Office and can provide a copy. Ms. Donahue-Wold said the preference would be to have drainage issues addressed prior to the BZA meeting. Mr. Ward said while he understands why the City would prefer to have drainage issues addressed prior to BZA, in the end, they will need to wait until Engineering approves the plans, and the developer will not start construction until they receive the approval. Angie Conn — City of Carmel Planning & Zoning - No comments. 9:15 a.m. (SUA,V) Carmel Seventh-Day Adventist Church Parking Lot Addition (aka Carmel Hope Fellowship). The applicant seeks the following special use amendment and development standards variance approval to expand their parking lot: Docket No. 12090016 SUA - Ordinance Ch 7.02: Church in R-1 district Docket No. 12090017 V - Ordinance Ch 27.03.01: Parking Facilities (temporary gravel requested). The site is located at 14445 Carey Rd. and is zoned Rl/ResidentiaL Filed by Jamie Shinneman of Weihe Engineers on behalf of the Indiana Association of Seventh Day Adventists, Inc. DeHart with Carmel Seventh Day Adventist Church presented on behalf of the petitioner. Mr. Carter said this church has expanded in the last few years and is looking for additional parking options. The only other option currently is parking on the street, which is not desirable. Joanie Clark — Vectren Energy - This project will be close to service which runs to a house just south of the area. Ms. Clark advised petitioner to use the Call Before You Dig service. Greg Hoyes — Hamilton County Surveyor's Office - This project is being reviewed in coordination with Carmel Engineering for drainage issues. Dan Davenport — Indianapolis Power & Light - Project is in Duke Energy service area. No further comments. Amanda Foley — City of Carmel Engineering - Letter sent regarding drainage. The petitioner will also need a sidewalk across both parcels, and should work with David Littlejohn, Carmel Alternative Transportation Coordinator to discuss requirements for this. Ms. DeHart said she spoke with Mr. Littlejohn regarding this sidewalk and the plan is to construct the entire sidewalk while the project is taking place rather than part of it now and the rest at a later time. John Thomas — City of Carmel Engineering - Preliminary comments have been issued for water quality. No further comments. Ryan Hartman — Clay Township Regional Waste District - This project falls outside CTRWD service area. No further comments. Daren Mindham — City of Carmel Urban Forestry - The landscape plan is ready to proof, minus any future changes. Alexia Donahue-Wold — City of Carmel Planning & Zoning - Ms. Donahue-Wold said when this project starts, the City would like to see the landscaping installed sooner rather than later as a buffer between the project and the existing house on the property. She also suggested the developer uses permeable pavement if possible, as well as other low impact development techniques to reduce the impact on the environment. Ms. Donahue- Wold wanted to clarify that gravel would not be used on the entire project, but rather just part of it. Mr. Carter said the plan was to get approval for the parking lot, but if the approval comes during the winter, gravel would be used until the weather allows them to install asphalt. Ms. DeHart said the plan was for gravel to only be used as a backup plan. Angie Conn — City of Carmel Planning & Zoning - No comments. 9:25 a.m. Docket No. 12090018 DP Amend: Ed Martin Parking Lot Expansion (Mayflower Park, Block 6, Lot 2). The applicant seeks approval for a 140-space parking lot expansion, impacting about 1.18 acres. The site is located at 9896 N. Michigan Rd. It is zoned I-1/ Industrial and lies within the US 421lMichigan Rd. Corridor Overlay Zone. Filed by Brian Cross of Civil Site Group, Inc. for Ed Martin Buick GMC. Mr. Cross said this property was developed in the late 1990's by Chrysler and was never occupied. The purpose of this project is to change existing green space to a parking lot, which is what was originally intended for the space. This lot will be used for new vehicle inventory storage. There will be no utilities besides site lighting. There will be on-site drainage to an existing detention facility. There will also be additional landscaping that may need to be updated from the original landscape plan. The anticipated construction start date would be the spring of 2013 when asphalt plants reopen. Joanie Clark — Vectren Energy - No comments or objections. Greg Hoyes — Hamilton County Surveyor's Office - Letter sent. Carmel Engineering will review drainage. Dan Davenport — Indianapolis Power & Light - No facility in the expansion area. No objections. Amanda Foley — City of Carmel Engineering - The main issue is drainage and Carmel Engineering will need to make sure the existing pond is adequate. Mr. Cross said the petitioner is working through design calculations and will provide these when available. John Thomas — City of Carmel Engineering - Has issued initial water quality comments. Ryan Hartman — Clay Township Regional Waste - Email sent on October ls` stating the lateral will fall underneath one of the lighting posts. Mr. Hartman said he wasn't sure if the petitioner would want to provide a new layout with the posts or if they would want to re-route the services. Mr. Cross said the petitioner had hired Bloodhound Underground Utility to scope the lateral along with the water service line. Fortunately the waste lines missed the light standard foundations. Daren Mindham — City of Carmel Urban Forestry - Comments sent. Mr. Cross said he would like to meet on site with Mr. Mindham as well as the landscaper to review the overall plan for the site. Mr. McCoy said as of the last week, many of the shrubs on-site have been replaced. They had been waiting for the heat of the summer to subside before replacing the shrubs. Alexia Donahue-Wold — City of Carmel Planning & Zoning - Asked petitioner if they were considering permeable pavement for this project. Mr. Cross said they would look into it, but from his experience, permeable pavement in high volume traffic areas such as this, have a tendency to become damaged easily. Mr. Cross said because of this, for example, Bloomington had previously required permeable pavement, but has since disallowed it. Mr. Cross said this pavement is also not conducive to snow removal techniques in the winter. Ms. Donahue-Wold said the request was not limited to permeable pavement, and there are other methods to consider which would lessen the impact on the environment. Mr. Cross said they would possibly consider adding more landscape islands and things of that nature, if there are leftover areas. Mr. Cross said they are working towards public notice in the paper. The petitioner is also working with a lighting contractor and will provide an updated lighting plan based on the cut sheets. 9:35 a.m. Docket No. 12030014 DP: 9800 N. Michigan Rd. Docket No. 12030016 ADLS: Dunkin Donuts, C-Store & Gas Canopy. The applicant seeks site plan and design approval for a multi-tenant building & fuel canopy on 3.98 acres. The site is located at 9800 N. Michigan Rd. and is zoned I-1/Industrial, within the US 421lMichigan Rd. Overlay Zone. Filed by Brad Walker of H& H Restaurant Management. Jon Dobosiewicz with Nelson & Frankenberger Law, Brad Walker with H& H Development, Eric Gleissner with Civil Site Group, and Brad Smith with SITE Architecture presented on behalf of the petitioner. Mr. Dobosiewicz said this project was in front of TAC in April. At that time, the project included a second primary structure on the west side. That building has since been removed from the plan and the fuel station, Gstore, and another retail building has replaced it further to the east of the site. The petitioner's plan is to present this to the plan commission at their November meeting, go to committee in December, and go back in front of the plan commission at their December meeting to get adoption consideration. Joanie Clark — Vectren Energy - E-mail sent. Ms. Clark asked if it was possible to get an easement on the south side of the property. Mr. Gleissner said this should be possible but there will be landscaping on this side of the development. Mr. Gleissner said once the developer figures out what variances are required, they would file detailed construction plans. He said this project would most likely start in Spring 2013 at the earliest. Ms. Clark requested an AutoCAD. Greg Hoyes — Hamilton County Surveyor's Office - Letter sent. Carmel Engineering will review drainage. Dan Davenport — Indianapolis Power & Light - Mr. Davenport said on the landscape plans, the potential transformer locations are shown completely surrounded by shrubs. Mr. Davenport said a door can be found on one side of these transformers, and 10-feet of clearance is required at all times. Mr. Gleissner said this should not be a problem but he will discuss with Urban Forester. Mr. Mindham said all that is required is a buffer, and that can be 10 or 15 feet away from the transformer. He added that Urban Forestry department typically recommends grasses to be planted around doors because they are easier to cut down if needed. Amanda Foley — City of Carmel Engineering - DP/ADLS plans and detailed drainage report are required, but have not yet been submitted. John Thomas — City of Carmel Engineering - Has not yet reviewed this project. Mr. Thomas said when this was presented earlier, he walked the rear of the property and noticed many low spots. Mr. Thomas said at that time, he asked if the site had been studied for water resources, and he is not sure where that stands currently. Mr. Gleissner said it has been studied, and the site now has Williams Creek involved to resolve any possible issues. Mr. Gleissner said this is a new plan, and the entire back half of the property will not be developed, as the potential cost to fix this area would have negated any benefits. This plan is much less invasive as the previous plan. Ms. Foley asked petitioner if INDOT has approved two entrances. Alexia Donahue-Wold — City of Carmel Planning & Zoning - No comments. Angie Conn — City of Carmel Planning & Zoning - This project is being reviewed. Since it has changed from what was originally submitted, it is being treated as a new project. Mr. Dobosiewicz said once a review letter is received and the petitioner knows what variances are required, they would file for a Hearing Officer. Mr. Dobosiewicz said he doesn't expect opposition from surrounding property owners. Ms. Donahue-Wold said the petitioner could still make the November deadline for the Hearing Officer but reminded petitioner that there will be no December meeting. Ms. Donahue-Wold said the Noblesville Times is now the newspaper that needs to be notified. Mr. Mr. Dobosiewicz said the clients appreciate this because of the reduced cost of posting legal descriptions compared to the Indianapolis Star. 9:45 a.m. TABLED TO NOV. 21: Docket No. 12090019 DP/ADLS: Sterler Productions (Park Northwestern, Lot 8A1). The applicant seeks approval for a 10,000 sq. ft. building and parking area.
