If there is any flexibility given the circumstances, it would be very much appreciated. We are only taking title to Lot 1 at closing, but will be incurring the costs to install all of the infrastructure improvements for the entire 8.64 acres in connection with the development of Lot 1. Therefore, we are not able to burden the Outback Steakhouse project with any additional costs for it to remain financially viable. As part of our PC Approvals for the project,we agreed that Lot 2 will not be developed until Retail Pkwy is installed which is why we are proposing the timing of the reimbursement payment be tied to the development of Lot 2 If it helps,we would offer that the payment be made upon the earlier development of Lot 2 or Lot 3. Hopefully the City can find this compromise to be agreeable in light of the circumstances. If so,we will revise the letter and get it back to you and move forward with the filing of the secondary plat. Please let me know. I look forward to hearing back from you and appreciate your help in working through this. The commitment for right-of-way dedication and payment in lieu of constructing the improvements stipulated by the Thoroughfare Plan are a condition of the approval of the plat. It would not be customary to burden one of the lots with this payment nor for the City to seek this from them directly.We normally will work with the developer that files the plat. Payment of any commitments is usually made before the release of the 1 construction plans or the recording of the secondary plat. I expect we will need to discuss this further and I would be happy to meet with you. Since several items were discussed during the meeting, I just wanted to provide a brief recap of the discussion and action items to keep us moving forward: 1. Extension of Retail Parkway -City has contracted Clark Dietz to do the design of the roadway extension. At this time, the intent is to only design and construct the roadway west to the extent of the Darden property. The City's goal is to have this constructed by the end of 2012. 2 Proposed Alignment—Per above,the proposed alignment is determined to the width of the Darden parcel and will fall within the 90' R/W split between the north and south lots with 15' on the north side and 75' on the south side. These dimensions will also be added to the site concept plan included with the acknowledgement letter. 3. Reimbursement Agreement—After further discussion,the City does not believe that a Reimbursement Agreement is the right document for this situation and believe a different agreement/commitment letter would be more appropriate. The reason for this is that per the thoroughfare plan, it is required that the developer(s) provide the R/W and install the improvements as these are not commitments by the City. The way we are moving forward now is the City will work with the County to get the TIF dollars and will proceed with the design and installation of the roadway. Our preference would be for the access onto Michigan Road north of the signal be eliminated long-term and that the - first full access from Retail Parkway to serve the lots on both sides be as far to the west as possible. Any access closer to 1 the signalized intersection would be right-in/right-out only. Would the INDOT want to review proposed access points on Retail Parkway within say 500-feet of the signal? The Department has issued TAC comments and has received an informal response. The Department agrees that most, if not all of the comments, will be addressed in connection with the review and approval of the Development Plan.The Department will review the response to the additional right-of-way request with the petitioner. It has been requested that the need for auxiliary lanes at the entrances on Illinois Street be analyzed. The Department expects these to be addressed in the traffic report. The plan needs to further identify and clarify how storm water treatment will be provided.The Department is requesting improvements to 136th Street that will close the existing median break at Memory Lane.The proposed access to 136th Street will be restricted to be right-in/right-out only. Docket No. 11120029 DP/PP: West Carmel Commons The Department has met several times with the petitioner and are actively working through issues. One main point is drainage.The site has no defined outlet but we have identified possible drainage discharge points. The petitioner is analyzing these options. As to the Primary Plat itself, unfortunately, we cannot support the Primary Plat in its current configuration. Long term access to the lots is not identified. In the current Primary Plat, Lots 3 and 4 are not served by a public street.The Department understands that options are being explored for the construction of the extension of Retail Parkway but that this has not been firmly established.The location of this roadway is critical to this development and it is not shown on the Primary Plat. If this development will rely on Retail Parkway to be located fully on the property to the south,the Department has required a letter from the property owner to the south acknowledging this fact. The Department suggests the development of a master connectivity plan that shows the location of Retail Parkway and the access to the adjacent developments.The Department has also requested a copy of the information submitted to the INDOT for the expected revisions to the signal timing due to the extension of Retail Parkway. Storm Basin Watershed Map, including the storm structure designation that each basin is draining. ii. Inlet grate design, including gutter spread calculations. It appears that the pipe calculations for some of the structures indicate that the calculated full flow velocity is slightly greater than the available full flow capacity of the pipe. Could the pipe slopes being increased to correct this issue? Please review and revise accordingly. 12. Please revise the Grading Plan to include address the following: a. Please include contours / grading elevations around the perimeter of the site to verify that there is no drainage being direct discharged from the site. b. Multiple large areas of the site show proposed spot elevations and contours to indicate the grading is completely flat. Please revise the proposed grading to verify that all water is being conveyed to storm structures,and no ponding areas are being created. c. It appears that there are existing easements within the proposed Lot 4 of the development. However, there no existing easements labeled on the proposed Plat or Plans. Please review and revise as necessary. 14. It appears that Note #10 on Sheet C104 does not apply to this project. Please review and revise accordingly. 15. Per Section 104.01 and 303.05.7 of the manual, all swales shall be installed with subsurface drains. Please review and revise accordingly. 16. Per Hamilton County Surveyor's Office Typical Pond Section D-7, the pond shall contain a minimum freeboard of 2 ft. from the peak 100-year elevation and the top of bank elevation of the pond. Please review and revise accordingly. 17. Per Section 302.03 of the manual, the allowable release rate for the site shall 0.1 cfs per acre of development for 0-10 year return interval storms and 0.30 cfs per acre of developed area for 11-100 year return interval storms. As this site consists of a pre-developed area with more than one (1) outlet, the release rate should be computed based on the pre-developed discharge area to the western outlet point. In addition, if there are areas being directly discharged from the site (area west of the proposed pond), these areas that are being directly discharged should be subtracted from the on-site area used in the calculation of the allowable release rate. Please review and revise accordingly. 18. Per Section 302.06.01, please provide information to verify that a minimum of 90%of the original detention capacity of the proposed dry detention basin is restored within 48 hours from the start of the design 100-year storm. 19. It appears that the outlet control structure has been designed in accordance with Section 302.06.07, as the orifice size required to limit the release rate from the proposed pond is less than the minimum 6- inch diameter size. However, please revise the drainage report to provide full modeling calculations, and resulting critical elevations and flow rates, for both the ordinance and minimum 6-inch orifice scenarios. The drainage summary within the plans shall also be revised to include the specified information for both scenarios. 20. Per Section 302.06.10 of the manual,a minimum fifteen (15) feet horizontally from the top of bank of the proposed detention pond facility shall be dedicated as a permanent stormwater easement. Please review and revise accordingly. 21. Per Section 302.06.11 of the manual, please provide verification that an additional ten (10) percent of available capacity has been provided for sediment accumulation within the proposed detention system. 22. Per Section 302.06.12,detention basins are to be sized to detain the runoff from the fully developed Right-of-Way per the City of Carmel 20-year Thoroughfare Plan across all frontages, regardless of existing watershed boundaries or drainage breaks/divides. 23. Please provide calculations for the proposed spillway to show that it complies with all requirements of Section 302.11 of the manual. 24. Per Section 302.12,all detention facilities shall outlet to an acceptable outlet,as determined by the City of Carmel and indicated within the manual. It appears that the proposed pond will outlet to an existing depressional storage area,within the Park Northwestern regulated drainage shed. Please review the requirements of Section 302.12 and revise the proposed pond outlet accordingly. 25. Please review the stormwater easement requirements of Section 306 and revise the plans to provide the necessary easements. 26. Please provide grate capacity calculations verifying conformance to Section 305.05. 27. Per Section 501.03, a minimum drop of 0.1 foot through manholes and inlet structures should be provided. It appears that the area in the Lot 2 hydrograph is listed as 1.37 Ac, but the calculations indicate 1.18 Ac. Please verify that the curve number for the Lot 2 hydrograph includes the additional pavement area being directed to Str.#109. 29. It appears that there are discrepancies between the areas and the curves numbers from the calculations and the values used in the unit hydrographs for the 'Pond' and 'Pipeline'areas. Please review and revised accordingly. 30. it appears that as the proposed pond outlets to the existing depressional areas, water will stage in the depressional area until it reaches a level high enough to outlet over the banks(approximately 891.00, or greater). This will create a submerged outlet scenario,and should be considered in the modeling of the proposed pond. 31. Please provide TC calculations for Str#109 to verify the 10 minute time of concentration used in the pipe calculations. 32. Please comment on how it is intended to drain Lot 1 and 3 during and after construction. It appears that these areas are largely flat and will create ponding issues. Also, it appears that areas of Lot 1 and 2 will be directed to Str#107; however,the structure is indicated to have a solid lid. Please review and revise as necessary. Please include with your submittal,one (1)copy of the comments indicating the action taken or a written explanation for action not taken.
