Petitioner seeks the following development standards variance approval:
Docket No. 04120010 V Chapter 25.07.03.03(d)(2) real estate sign height
The site is located at the northwest comer of 131 st S1. and US 31. The site is zoned B-5/Business
within the US 31 Overlay. Filed by Sherry Marchbanks of Mazda Sign, Inc. for CMC.
General Info:
The petitioner is seeking variance
approval for the height of a temporary
real estate sign reading "Now Leasing".
Analysis:
The sign is 1 0- ft tall, rather than the
ordinance required 8- f1. It will be about
100- ft from the US 31 right of way. The
building was built for short-term leases
for new start up businesses. The sign will
allow potential tenants to know of a lease
space available. Currently, there is a
temporary "office space for lease" sign
on the site, adjacent to US 31, which
looks bad. The sign is supported with
support beams, in order to get the sign up
to the level of the grade of US 31,
making it look like it is on stilts. There is concern that the approved sign might look this way.
Findings 'of Fact: sign height
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because: the variance of 2 feet will not impact the
sign greatly. Even thought the grade oflan'd is slightly lower than the highway, the sign still has
the advantage of being placed on a parcel that is adjacent to the highway.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a s'ubstantiallyadverse manner because:
the variance of 2 feet will not impact the sign greatly. Even thought the grade of land is slightly
lower than the highway, the sign still has the advantage of being placed on a parcel that is
adjacent to the highway.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
the variance of2-ft in height will probably not affect the readability of the sign adequately
from the highway. If the sign is placed as 8-ft tall, it will still be readable.
Recommendation:
The department recommends negative consideration of Docket No. 04120010 V. If the proposed sign
in approved, the Department recommends the sign along US 31 be removed, along with all other signs
that are illegally placed on the site.
