At that time, it was discussed that if the roundabout moved forward,that Kite would be agreeable to dedicating additional right-of-way on the SW corner at such time as the property redeveloped so as not to affect the redevelopment of the Centre property. If the Kite is contending that the current plan for the former bike shop does not need to conform to Section 2.09 of the zoning ordinance, since it is an ALDS Amend, I have no issues with that.They could argue that to what they were referring at the meeting was a total or partial redevelopment of the site and not a tenant buildout (plus some exterior work) Future redevelopment of the parcel will be subject to the requirements of Section 2.09. What we are looking for is a commitment for the additional right-of-way on the SW corner that would be needed to locate the roundabout so that it does not affect the Centre. Moving the roundabout would not be necessary if the plan for the redevelopment of the Centre had dedicated the necessary right-of-way per the roundabout plan presented at the meeting on March 8th Please let me know if this makes sense.
