Please be advised the property located at 11590 N. Meridian Street, Carmel, Indiana 46032, (commonly known as Fidelity Plaza, Tower 3) is zoned S-2/Residence and B-6/Business within the US 31/Meridian Corridor Overlay Zone, according to the Official Zoning Map of the City of Carmel, Hamilton County, Indiana. Office uses are permitted within the B-6, and the US 31 Corridor Overlay Zone districts. Currently, the property complies with requirements of the Zoning Ordinance of the City of Carmel, so that the operation of the Property as an office building is legal. However, as you are well aware, the City will be purchasing land from your company for road right-of-way along 116th Street. This action will cause your property to become non-conforming with Chapter 26.04.05, regarding landscape buffer yard/plantings along 116th Street. As part of the City's process for purchase of right-of-way, the Department will assist with your filing of a development standards variance (DSV) application that will bring your property into compliance with the ordinance. As a co-applicant,. the Department process without charge the DSV application and public-notice notification information submitted by you, and will present the petition to the Board of Zoning Appeals. The fee will be $515.00 for the variance request will be absorbed by the Department as part of the City's agreement.
