This letter is in regards to the landscaping requirements for the business property of the Ginkgo Tree,
owned by Jenny Hartmann, and located at 105 1st Ave. N.E. in Carmel. Jenny Hartmann and I (T.J. Houghtalen -
Landscape Designer with Green Vista Landscaping for the past 12 years) met with Scott Brewer tram the Carmel
PlanningDept. on Wednesday September 15, 2004, in regards to the landscaping requirements for the Ginkgo
Tree business site. As we looked at the plot plan of the property, and discussed the actual green space available,
we all agreed the Carmel Landscape Requirements for this site would be difficult to meet. This was due to the size
of the lot, the available green space on the lot, and the two large existing shade trees on the property.
In accordance to the recommendations made by Scott Brewer. Jenny Hartmann has or will complete the
following landscaping improvements to the property. 1) Install 2 ornamental trees on the southside of the property
between the building and the road. This has been completed with 2 Kousa Dogwood trees. 2) Complete the
landscaping around the foundation of the building as listed on the landscape plan. This has been completed in
accordance with the landscape plan. 3) Install a screening buffer between the Ginkgo Tree building and the
property line on the Northside of the building. This win be completed in the next couple of weeks with one of the
following plant material items: Pyramidal Arborvitae, Rose of Sharon, or Ornamental Grasses.
The Ginkgo Tree property would like to ask for a landscape variance for the number of shade trees
required to be placed on the lot by the City of Carmel. The building lot has 2 extremely large existing shade trees
on it. One tree is a Sweet Gum located in the &ontyard, and the other tree is a Maple located in the backyard. The
canopy of these trees cover a great portion of the property. With my experience, I feel adding additional shade
trees to this property would be more detrimental than good for the property. This is because the additional trees
could obstruct the street lighting and traffic view at the intersection. Also, the trees win obstruct the view of the
business building and the sign on the building. Finally, the trees could have some effect on the existing plant
material already around the building.
I hope you will take into consideration the size of the property, the available green space for landscaping,
and the large existing trees on the lot and allow a landscape variance for the Ginkgo Tree property.

I hope this letter finds you well. My name is Jennifer Hartmann and I am writing in to inform you of the
action taking place to rezone the property known as 105 1st Ave NE. My husband Carl and I are hoping
to rezone this property to welcome a holistic spa. I am aiming at having an acupuncturist, and
esthetician, and myself a massage therapist. This will not create a heavy flow of traffic and we would
, like to keep the Olde Town flare. The Carmel Plan Commission meeting will be held on October the
19th at 7:00pm in the City Hall Council Chambers, 1 Civic Square, Carmel, Indiana 46032. This petition
may be examined at the Office of the BZA (Carmel Department of Community Services). Any person
may offer verbal comments at the Public Hearing or may file written comments prior to or at the
hearing. The application is identified as Docket No. 04060026Z. The real estate affected by said
application is described as Carey's Addition Lot 9.

Dear Mr. & Ms. Hartmann:
We have received the packet of information regarding your rezone request that is scheduled to be heard at
the September 22, 2004 Technical Advisory Committee meeting. We offer the following comments:
Typically, this office does not have comments regarding rezones. We do not have comments or issues with
this rezone. However, there may be future requirements if this progresses beyond the rezone and/or rezone
approval, namely:
1. Conversion of this single family residence to a business use will require re~approval of the curb
(driveway) cut on 1 st Street NE by our Board of Public Works and Safety. This approval would be
necessitated by the conversiqn of the curb cut from residential to commercial use.
2. Conversion from a single-family residence to commercial use may require additional water and
sanitary sewer availability approval from our Board of Public Works and Safety and additional
water and sanitary sewer connection fees. Carmel Utilities will make t~s determination.
3. The intended use may be acceptable in the present. Future use, once curb cut and zoning is
approved, could cause traffic problems. Does B~ 1 preclude high traffic volume users?

Dear Ms. Hartmann:
This letter is in response to your rezone application for Lot 9 of Carey's Addition. The following'
issues must be addressed with the rezoning of this property so that the property can function as a
compliant B 1 parcel:
1. If this rezone application js approved, Architectural Design, Exterior Lighting,
Landscaping and Signage (ADLS) approval by the Commission will be necessary
prior to the establishment of any business on this lot.
2. As per the parking requirements and based upon the estimated square footage of
the existing structure and your proposed use, you will need to. provide 5 parking
spaces (space dimensions: 180 sq.ft. min, 9 ft. min width). The number .of spaces
may be decreased by 50% due to the size of the subject property (which would
require you to provide 3 spaces). Parking lots must be paved, curbed, and located
no closer than 5 feet to a residential lot.
3. Exterior lighting is restricted to lamps mounted on the building, sev'en foot
maximum height pole mounted decorative lights, and low-wattage landscape
lighting.
4. All dumpsters and trash receptacles must be screened from view.
5. One sign is permitted to identify the business. This sign will require ADLS
approval.
6. Due to the lot size of the subject property as well as the existing structure,
variances from the following ordinances may be required for this lot to comply
with zoning ordinance B 1 Standards, Old Town District Overlay, and Additional
Regulations:
a. 12.04.02: Minimum Front Yard - to reduce front yard setback from 15 feet to
existing setback on b<?th 1 st Avenue NE and 1 st Street NE.
b. 23D.03(C)(1 )(a){iii):Minimum Lot Coverage - to increase the maximum lot
coverage from the required 70 percent.

Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the July 21, 2004 TAC meeting. Please feel free to copy and distribute this e-
mail or attach it to your meeting minutes. For future reference, we post all CTRWD TAC

Village of WestClay
If the amended PUD ordinance or rezoning has any direct effect on existing sewer lines or
future service, plans need to be re-submitted. Sanitary sewer construction plans need to
be submitted for review by the District's engineers. A District proj:ect application may
also need to be re-submitted.. Please submit two sets of plans to the District for
review. An IDEM construction permit may need to be submitted or revised. If so, all IDEM
submittal information should be provided following the District's plan review.

Plans have been reviewed and approved by the District's engineers. Plans are ready to be
submitted to IDEM for state approval. Requested developers to submit IDEM package was
sent on July 16, 2004.

District's plan review.
