Dear Mr. Brasseur:
This letter acknowledges the receipt of check number 10469 on May 31, 2006 from
Platinum Properties, LLC in the amount of$72,285.00 as payment for commitments
concerning the use and development of real estate made to the City of Carmel for the
Bellewood, Heather Knoll, Long Ridge Estates, Guilford Townes, and the Cherry Creek
Estates subdivisions pursuant to your letter dated May 15, 2006. After your credits of
$15,091.00 for Bellewood and $64,963.00 for Cherry Creek Estates were applied, the
balance of $72,285.00 was satisfied by the receipt of check number 10469 on May 31,
2006 in our office. This fee included payments to the City of Carmel for commitments
related to Heather Knoll, Long Ridge Estates, and Guilford Townes. These
commitments have now been satisfied.

Dear Mr. Dobosiewicz:
I am writing on behalf of my client, Jim and Marcia Henry, located at 13850 Shelbourne
Road, regarding their previous remonstration against the above-referenced proposed Subdivision.
In a letter to the Department of Community Services, dated September 8, 2004 ("Letter"), we
outlined a number of concerns that the Henrys were seeking to have addressed by the Developer
to minimize the negative impacts that the Subdivision would have on their property.
Since the date of that Letter, the Developer has met with the Henrys and has worked to
address each of the concerns outlined in that Letter. As of today, the Henrys and the Developer
have reached an agreement on each of those concerns, and the Developer has agreed to make the
following commitments:
. That the row of existing trees on the Subdivision property immediately abutting the
shared boundary of the Henrys' property be preserved for a distance of 370 feet starting at
the eastern boundary of the Subdivision property outside of the Shelbourne Road right-
of-way.
· That the farm fence on the Henrys' property immediately abutting the shared boundary
with the Subdivision property be replaced, improved or repaired to close off the gap
between the ground and the wire fencing material itself in order to l(eep dogs and other
small animals from entering the Henrys' property from underneath the farm fence.
· That a farm fence be installed on the Subdivision property a distance of 5 feet from the
Henrys' shared boundary with the Subdivision property, starting 370 feet from the eastern
boundary of the Subdivision property and running a distance of approximately 770 feet
west to the end of the shared boundary with the Henrys' property and continuing

approximately 256 feet for the length of the western boundary of the Henrys' property.
The farm fence shall be a "non-climbable" wire mesh and at least 5 feet in height.
CD That a landscape buffer be installed on the Subdivision property according to the revised
landscape plan attached hereto and incorporated herein as Exhibit A ("Landscape Plan"),
with the following modifications: the addition of those trees as requested by the City of
Carmel's arborist, and that the trees shown on the Landscape Plan be placed no further
apart than 12 feet between each tree.
. That adequate steps to ensure that the Subdivision does not create or exacerbate allY
drainage problems regarding the Henrys' property.
. To the extent feasible, that water, sewer and gas utilities ("TJtilities") serving the
Subdivision be stubbed, at the Developer's cost, to the shared boundary between the
Subdivision and the Henrys' property to allow the Henrys' to hook onto such Utilities.
Should it not be feasible for the Developer to stub the Utilities at the Henrys' southern
boundary line, the Developer shall commit to stub the Utilities to the Henrys' western
boundary line, to the extent feasible. To the extent that it is not feasible for the
Developer to stub the Utilities to the Henrys' western boundary line, the Developer shall
commit to stub the Utilities to the Henrys' eastern boundary line from existing utilities
across the street, to the extent feasible.
. That adequate steps be taken to avoid having any outdoor street lighting from the
Subdivision spillover the property line onto the Henrys' property, and to that end, that no
street lighting within the Subdivision shall be placed between Lots 19 and 20 on either
side of the main entry boulevard of the Subdivision.
. That adequate steps be taken to minimize construction debris comIng from the
Subdivision onto the Henrys' property.
. That the Henrys are provided with 48 hours' prior notice before any site work commences
on the Subdivision property to allow the Henrys adequate time to restrain or relocate the
horses on their property.
The Henrys respectfully request that all of the above commitments be made conditions of
primary plat approval by the Carmel-Clay Plan Commission for the Subdivision and that
secondary plat approval be subject to these commitments being recorded with the Office of the
Recorder for Hamilton County and running with the Subdivision property.

In exchange for the Developer's agreement to make and record the above commitments as
covenants running with the Subdivision property, the Henrys agree to withdraw their
remonstration to the Subdivision and will quitclaim that portion of their property as shown on a
plan prepared by Stoeppelwerth & Associates, Inc., dated August 13, 2004, and labeled "Option
3," attached hereto and incorporated herein as Exhibit B, for the installation of a decel lane.
Both parties hereto agree to execute any further documents necessary to effectuate the terms of
this Agreement.

I Jive at 3573 Larkspur Lane, Carmel) Indiana in Larkspur Subdivision located at the
intersection of 116'h Street and Shelborne Road. I also own 3acres on Shelbome just
south of 11601 street on the east side of the road. I am very interested in any and aJl
development that occurs on Shelbome Road.
That being said, I would like to go on record of providing my fuIJ and undividcd'~upport
of the proposed subdivision known as ULong Ridge Estates." When my 'wife and I
decided to move to Cannel and start our fami,ly) we chose Carmel because. of its strong
school system and the reputation of the Carmel Dad!!s Club.
We have been happy with our decision. However~ D1Y wife and I are both business
owners and our children have been unable to participate in sports that OCCur on the east
side of Carmel at Badger Field.. We are ecsta.tic to hear that there are potential plans to
provide additional fields for youth sports on the west side of town. Further, I understand
that these fields will be provided at no cost to the taxpayer.
Itis my pp;nion that this'community cannot a.fiord to turn it)s back on a proposal that 'Will
provide such a nccded.asset to a community that.is already turning kids away or placing
kids on waiting lists and limiting their recreational opportunities. In addition) the
location of such a facility would help reduce the cross...town travel that is necessary to
participate in ~xisting programs.

Knowing that nothing is free, I ask what is the cost to the community to have such an
asset as is being proposed at '~I.,Iong Ridge Estates?n As I under~tand 'it, the developer is
asking tot' additional density than what is currently al1owed. What is the cost of
additional density? I can only surmise that it-is additionallraffic. I-have lived in other
cities and I can 'say., "we do not have traffic problems in Western Clay Township.t' I
wou]d not have made the financial commitInent to the area if I have ever experienced,
unreasonable traffic delays in my excursions to daily at,1:ivities_ In addition., I am
confident that with the impcndjng annexatio~ Carmel will ensure that any potential
traffic issues wi]} be handled in a reasonable time frame.
I ask that you support '.Long Ridge Estates" and th~ additional value that jt win create in
making Carmel an excellent place to live, work, play and raise a family.

Dear Plan Commission Subdivision Committee Members:
We live at 13881Shelborne Road in Clay Township. Our property borders Stanford Park
currently under development and will be just north and east of the Lacrosse/Multi-purpose
fields proposed to be developed in the Natural Open Space on the Claybourne Subdivision site
just south of the newly proposed Long Ridge Estates development by Pittman Partners on your
docket for your meeting Tuesday evening, August 31, 2004. Neither of us are available to
attend the meeting Tuesday so we wanted to relay our thoughts in writing.
We understand that the open space in question was used as Natural Open Space (ROSa III,
Section 7.6) for the Claybourne subdivision. Use of that area as open space provided additional
density for the Claybourne development. The proposal currently under consideration would
change the Claybourne open space into Design Open Space (ROSO III, Section 7.9). However,
the proposal does not meet the definition of any of the specific types of Design Open Space in
the ordinance and. would be developed as "other" open space under ROSO III, Section 7.9.11.
While that section does not require specific set access points for" other" types of Design Open
Space, we are concerned about the single point of access onto Shelborne Road. Design Open
Space for Parks (ROSa III, Section 7.9.2) require up to three points of access; Squares (ROSa III,
Section 7.9.1 require streets on two sides; Greens (ROSa III, Section 7.9.3) require streets on up
to three sides. In your discussion last year on the football fields, specific safety concerns were
raised regarding the access issue and it was determined that accessing the parking lots from
136th Street instead of from Shelbome Road was optimal for the peak types of traffic that sports
fields enjoy. A similar thought process should be used for these fields.
We understand that the Claybourne open space cannot also be considered as open space for the
proposed Long Ridge Estates development (in other words, it is not being" double counted" as
open space) but that the development of the sports fields is intended to be used an "additional
community investment" under the provisions of the comprehensive plan for the purpose of
securing additional density in the Long Ridge Estates development. While this still appears to
be using the same open space twice for density additions, we are not necessarily concerned
e e
about the level of density in the proposed Long Ridge Estates development. We are more
concerned about traffic issues with the proliferation of sports complexes in the area along
Shelborne Road.
As we testified this past year in the development of the football field project at the Stanford
Park development, we are in support of assisting the Carmel Dad's Club. Our children were
involved in the Dad's Club when they were growing up and we have fond memories of those
days (as well as the memories of the traffic getting in and out of the parking lots).
We have significant concerns regarding traffic in our area and how this additional sports field
development would impact traffic flow. We now have a new Junior High School and
Elementary School on Shelborne Road with adjacent soccer other sports fields. The three
football fields are currently being constructed almost directly across Shelborne Road from the
proposed new Lacrosse/Multi-purpose fields.
136th Street, while partially under construction, will not be fully available to provide East-West
ingress and egress to any of these sports fields for some time to come. This puts undue pressure
on Shelborne Road to handle the huge load of traffic. The current traffic in the area is already
significant and many of the proposed homes slated to go into the area have yet to be built. So
far, we have not seen the new school zone speed limit signage bringing the speeds on Shelborne
below the 65 miles an hour that seems to be the standard in the area. We have heard of no plans
to improve Shelborne Road to what is needed for this high-level of use as a sports center rather
than the rural character that the area had previously enjoyed.
We understand that the football fields have restricted hours and times of operation (they are not
multi-purpose fields and will be used only during football practice and game season). The
Lacrosse/Multi-purpose fields are not similarly restricted and could be used on a year-around
basis. Hopefully, these new fields will also carry a restriction against artificial lighting. Using
both sets of fields during the same seasons would cause unbelievable traffic problems on
Shelborne Road with people attempting to gain access to Shelborne Road from entrances just
slightly offset from each other.
The football fields will eventually have East-West ingress and egress through the use of 136th
Street with two points of entry to the parking lot. The proposed Lacrosse/Multi-purpose fields
have only one proposed point of entry and only onto Shelborne Road. This entrance point will
be fairly close to 136th Street where it will cross Shelborne Road. We are concerned that this will
cause conflict between football traffic, 136th Street through traffic, and traffic using the new
fields. We are concerned for the safety of all children in the area, not just those using the sports
fields.

Dear Mr. Dobosiewicz:
I am writing on behalf of my client, Jim and Marcia Henry, located at 13850 Shelbourne
Road, to. express their opposition to and remonstrance against the above-referenced proposed
Subdivision. As homeowners located immediately adjacent to the proposed Subdivision, Mr.
and Mrs. Henry have significant concerns regarding the negative impacts that Long Ridge
Estates would have on their property and would like to see the Developer address their concerns
as a part of the Developer's efforts to seek approval for this proposed Subdivision.
Specifically, the Henrys are concerned about the substantial increase in traffic and noise
that will arise from the addition of 180 homes to property located immediately adjacent to them.
Preservation of the current landscape buffer that exists between the Henrys' property and the
proposed Subdivision is needed to mitigate the negative impacts of the substantial increase in
traffic and noise arising from the Subdivision. Furthermore, the Henrys own and, keep horses on
their property, and they are concerned that the placement of 180 homes adjacent to their horses,
without adequate buffering between the Subdivision and their property, would create an
attractive nuisance for the children residing within the Subdivision. To that end, adequate
landscape buffering between the respective properties is needed to eliminate, or at least
substantially reduce, the danger to children within the Subdivision of interacting with the horses
and possibly being bitten, kicked or worse.
Most importantly, however, is my client's objection to the proposCid placement of a decel
lane on their property to serve the Subdivision. According to several alternate plans provided to
the Henrys by the Developer, the proposed decel lane would take anywhere from .106 acres to
.263 acres of the Henry's front yard, including a number of mature trees. As of this date, no
agreement has been reached between my client and the Developer for the placement of this decel
lane on the Henrys' property, and unless a binding written agreement is reached between the
Henrys' and the Developer to address the Henrys' concerns regarding the Subdivision, the Henrys

will not consent to any placement of the decel lane on their property and will require their
property to be taken by the City of Carmel by eminent domain.
Notwithstanding the foregoing, if the Developer is willing to address the Henrys'
concerns regarding the proposed Subdivision, the Henrys would be willing to withdraw their
remonstration to the proposed Subdivision and grant the Developer the right to place the decel
lane on their property. Specifically, the Henrys would like to see the Developer make the
following written commitments regarding the proposed Subdivision:
.. That the landscape buffer that currently exists between the Henrys' property and the
property for the proposed Subdivision be preserved; or, in the alternate, if it is not
feasible to preserve the currently existing landscape buffer, that the Developer would
install, prior to construction of the first home in the proposed Subdivision, a landscape
buffer substantially similar in size, density and type of trees to what currently exists
between the respective properties ("Landscape Buffer").
. That the farm fence that currently exists on the property line between the respective
properties be preserved and upgraded; or, in the alternate, if it is not feasible to preserve
the currently existing fence, that the Developer would install, prior to construction of the
first home in the proposed Subdivision, a fence substantially similar in size and quality to
what currently exists between the respective properties ("Fence").
. That the Landscape Buffer and Fence be extended the entire length of the shared
boundary between the Henrys' property and the property for the proposed Subdivision to
minimize the negative impacts of traffic and noise and to mitigate the dangers associated
with the proposed Subdivision's creation of an attractive nuisance with the horses located
on the Henrys' property.
.., That no sidewalk, trail, bike path or other pedestrian walkway be placed along the north
side of the proposed Subdivision adjacent to or near the Henrys' property to mitigate the
dangers associated with the proposed Subdivision's creation of an attractive nuisance with
the Henrys' horses.
. That the Developer take adequate steps to ensure that the proposed Subdivision does not
create or exacerbate any drainage problems regarding the Henrys' property.
. That the Developer allow the Henrys the opportunity to hook on to the water, sewer and
gas utility lines that will be serving the Subdivision at no cost to the Henrys.
. That the Developer take adequate steps to avoid having any outdoor lighting from the
Subdivision spillover the property line onto the Henrys' property.

. That the Developer take adequate steps to minimize dust and construction debris coming
from the Subdivision onto the Henrys' property.
. That, if any decel lane is installed on the Henrys' property in connection with the
proposed Subdivision, the Developer will replace any trees on the Henrys' property that
were disturbed as a result of such installation with trees similar in size, density and type
and will restore the property to its original condition as it existed prior to the installation
of such decellane.
In exchange for the Developer's binding written agreement to make the above-referenced
commitments, the Henrys will agree to withdraw their remonstration to the proposed
Subdivision and will grant the Developer the right to place a decel lane on the property as
shown on a plan prepared by Stoeppelwerth & Associates, Inc., dated August 13, 2004, and
labeled "Option 3".
It is my client's sincere hope that the Developer will view these requests as reasonable
and agree that they are in the best interest of both parties and will make the proposed
Subdivision a better development. Thank you.

We have reviewed the primary plat submitted for this project and offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:

A schedule for Board of Public Works and Safety meeting dates and agenda deadlines was previously sent
for your use. Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or tlte
Board of Zoning Appeals (if applicable) and completion of revie)v by the Technical Advisory Committee.
All written requests to be placed on the Board's agenda must include the appropriate Docket Number and
the date (or dates) of approval by the Plan Co",mission and/or the Board of Zoning Appeals (if
applicable).
4. T.A.C. Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all Engineering Department, Carmel Utilities and Hamilton County Surveyor's Office
issues have been resolved. The design engineer must certify all drawings submitted for final approval.
Because of the dual jurisdiction between the City of Carmel and the Hamilton County Surveyor, we will
require a minimum of eight-sets of drawings for approval after all issues have been resolved. The drawings
will be stamped as approved and will be signed by the City Engineer and by Carmel Utilities. The eight-sets
will then be sent to the Hamilton County Surveyor's Office for approval and signatures. Three approved sets
are to be returned to the City of Carmel. The Hamilton County Surveyor's Office will.retain two-sets. The
Developer, the Engineer and the Contractor win each receive one-set.
5. Please be advised that any instal1ation of signs, walls, irrigation systems, etc. within dedicated right of way or
dedicated easements will require a Consent to Encroach Agreement with the City of Carmel's Board of
Public Works and Safety.

BONDING REQUIREMENTS
9. Individual Performance Guarantees will be required for the following subdivision improvements:
. Streets (base, binder and surface). You may bond perimeter street improvements separately.
. Curbs
. Water Mains
. Street Signs
. Monuments & Markers*
. Sidewalks (builders lot sidewalks, perimeter right of way sidewalks and perimeter asphalt paths may be
bonded separately).
Storm sewer bonding will be under the jurisdiction of the Hamilton County Surveyor's Office. They may
also require bonding for *Monuments & Markers. If that is the case, we will not require duplicate bonding.
Sanitary sewers are under the jurisdiction of the Clay Township Regional Waste District.
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost
of labor and materials to construct the individual improvements, to be provided by the design engineer.
Please provide detailed Engineers Estimates for each improvement including unit costs, quantities, materials
and types of materials, etc. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee, amount is based upon 15% of the
Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements.
Performance Guarantees may be Performance or Subdivision Bonds, Irrevocable Letters of Credit or
Cashier's Checks, Certified Checks or Official Checks. Please reference the enclosures for more detailed
explanation of our procedures.
AVAILABILITY AND CONNECTION FEES
1 O. Availability (acreage) Fees must be paid after all other Engineering Department requirements have been
satisfied and prior to the start of construction activities. Availability Fees are based upon total platted acreage
for the development at the current rate of$1,010.00 per acre (Water Availability Fee). Based upon the
secondary plat indicated acreage, the following Water Availability Fees would apply:
127.569Acres @ $1,OIO.OO/Acre = $128,845.00
Connection Fees are currently $1,310.00 for water per single-family residence. Connection Fees are paid
when the infrastructure has been complete, satisfactory test results obtained and the subdivision has been
"released for permits. Water Connection Fees are paid on a per-lot basis.
. If an irrigation systel1t, swbnming pool or clubhouse is planned for these, or any future section
of the development, additional Water Connection Fees will he assessed based upon the
recommendation of the Director of Carmel Utilities.
11. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted
for review to this office. We will share Crossroad's comments as they are received.
COMMENTS - PRIMARY PLAT
12. Sheet 1 - Primary Plat
. Typical Street Cross Section - The sidewalk should be positioned I-foot inside the right of way
line.
. The underdrains should be located under the curb on the Typical Street Cross Section.

. What will be done to convey offsite drainage from apparent stream that runs east to west, just south of
1415t Street?
. We will need combined calculations for the common detention pond with Claybourne Farms.
. It appears that some inlets are needed in street at the intersection east of lots 85 and 86.
. Lots are being platted such that they encroach on pipeline easements. This could be a problem with
future homeowners.
. Where is the pond overflow? Please indicate.

We have reviewed the primary plat submitted to the Hamilton County Surveyor's Office on
June 21, 2004 for this project and have the following comments:
1. The proposed project falls in the jurisdiction of the City of Cannel
2. The proposed project DOES NOT fall in a Cannel Wellhead Protection Zone.
3. This project will be a Hamilton County Regulated Drain Subdivision.
4. The proposed project falls in the watershed of Lion's Creek.
5. In conjw1ction with Claybourne Farms, improvements to Lion's Creek will be
required as outlines in Hamilton County Ordinance 4-26-99-C(3) and Lion's
Creek will need to be petitioned as a regulated drain.
6.. In accordanoe with Ordinance No. 4-26-99-C; #5; the developer needs to contact
owners downstream of the outlet until the point where it reaches Little Eagle
Creek. This will apply only to the north outlet, as I will have the developer of
Claybourne Farms contact the property owners on Lion's Creek. This will
include the property owners in Boone County and it crosses 2 different parcels
with only 1 property Owner in Hamilton County. This is to determine if the
downstTeam owners wants the existing open ditch or waterway to become
regulated, and to notify them oft11eir rights to appeal any approval of the design,

Downstream improvements to this natural watercourse will be required unless
documentation is provided from the property owners that they do not want to
beoome part of the regulated drain.
8. After completina above item #6t please schedule an on-site meeting with the
engineering firm~ developer, contractor (if selected) and this office to determine
the scope of work for the downstream improvements.
9. While this is only the primary plat it appears no stotm sewer provisions are being
Inade for the pond outlet on the Clampitt property to the east. A natural drainage
way does appear on aerial photography and this drainage way must be
maintained, as not to block the drainage to the adjacent property owners.
10. Please submit the following procedural items to this office. petition for regulated
subdivisiont outlet permit, engineer's estimatet and all associated bonds for 120%
of construction cost. The applications are available on our website at

note a new Petition for Regulated Drain Subdivision is posted on the website.
11. Please consider using oastings that are designed for bi-directional flow in the
"sag" of the streets. The acceptable castings are Neenah 3501..L2 or East Jordan
749S-M4. The Neenah (or equivalent) 3501 TR or TL should be used when a
single direction of flow enters the inlet.
12. All casting should be labeled uDump No Waste - Drains to Waterway," which are
readily available now from local casting distributors. Please add a note to the
plans that will make the contractor away of this requirement.
13. Please submit complete construction plans, the secondary plat, and drainage
calculations to this offioe when they become available.
14. Please note that further comments may be neoessary at a later date.

7.3. Wetness and flooding hazard are management concerns for crop production. This soil
responds well to tile drainage; it is designated not highly erodible (class 3) in the Highly Erodible
Land (HEL) classification system. Because of the flooding hazard, this soil has a severe limitation
for most non-ag uses.
Additional information about soils is available in the "Soil Survey of Hamilton County". The engineer and/or developer
should consider the need for an onsite soils investigation.
I have reviewed the plans for this project and have the following comments:
· A 10-12 acre pond exists east of lot 141. Has flood routing and/or a breach routing been
considered in case the dam were to fail?
· A storm sewer discharges at the rear of lot 172. What water quality practices are being
considered before this water is released from the site?
· What design goals have you considered for storm water quality?
· It is difficult to manage only part of a pond. What considerations for joint pond maintenance
have you considered for pond # 1 ?
· There are several waterways on the western 80 acres that I believe were installed with
USDA cost sharing funds. Please contact John Bush in Boone County to inquire about the
possible contracts.
· From a past soils investigation, you should expect to find wet sand and gravel subsoil on this
si te.
