that State law requires procedures that
resemble those used in a court of law.
State law prohibits Board members from

objective and do not become biased. For
this reason, citizens who wish to present
their views orally on a specific land use
issue are restricted to testifying at the
public hearing. Written testimony on a
quasi-judicial issue must be submitted
at least 5 days prior or during the public
hearing.

I agree with Councilor Seidensticker. I have also made my objections known on the record at the BZA. As I said
at that meeting, this is like trying to stuff a size 16 foot into a size 8 shoe. It appears that the petitioner is
attempting to spend as little in the way of resources as possible on this project.There is nothing wrong with
attempting to conserve ones resources. However, that conservation should not come as a detriment to a
neighborhood.
As I also pointed out to one of the principals of the petitioning group over a year ago, "I am not opposed to what
you are doing. Old Town could use a brew pub." However if I had been told at the time that the location for this
establishment was going to be at this site rather than actually on Main or southwest of the intersection of Main
and Rangeline, I would have said, "No way.I just will not support that."
In conclusion, there is no reason to bring the noise and parking problems to that section of town just so a
potential developer can minimize his outlay by utilizing a lot and a building that are not suited for the use. That
will destabilize that area and turn what is now going increasingly back to residential more commercial.
As some of your have heard me say in the past, "It has been a virtue of Carmel and its citizen volunteers involved
in planning and zoning when they say to a developer, be they large or small, 'Do it the way Carmel wants it done,
or take your project somewhere else'.This is a project that is not being done in a manner consistent with what
Carmel wants or needs.

The side and rear yard building setbacks would have to be at least 5 feet from the side and rear property lines. The Old
Town Overlay Regulations trump the underlying B-1 zoning. Attached is the Old Town Overlay section of the zoning
ordinance.That site specifically falls within the Character Subarea; start at page 13 of the attached .pdf file.
A brewery or brewpub (in addition to a tavern land use) is also a permitted use on this site; it is permitted in the B-1
zone and is not excluded from Old Town Overlay.
BZA Variances: The applicant seeks the final vote on the following development standards variances from the Board of
Zoning Appeals on August 27,with docket numbers 12060013 V and12060014 V:
o Building addition in front yard setback(south).
o Parking in the front yard.

Does this business plan containing the variances requested meet the side yard and back yard minimum sizes as
stated in ZO Ch 12 B-1 Business (Summer 2004 v1)? Also, since the proposed business plan is to manufacture
for resale using either a bottling system or keg tapping with distribution to other establishments is that still
allowed in the B-1 classification or is it better suited for M-1?

Dear Ms. Conn:
We write to express our opposition to the planned establishment of a brewpubtat 32 First AvenueAE:
Putting a brew pub immediately adjacent to a residential neighborhood is a completely inappropriate
use of this property. The noise from this type of business, the increase in pedestrian and vehicular
traffic, as well as the parking on adjacent streets will negatively impact the quality of life for the
residents of this area.
The bulk of the activity will likely take place in evening and night hours increasing the neighbor's
discomfrort. Further, placing a brew pub at this site will undoubtedly lower property values for the
homes in the area.
We ask the Department of Community Services to recommend against the establishment of a brew pub
at this site.

The address is as Brooke mentions....it is incorrectly addressed as it. Now is an excellent time to make the
correction so it can be found easily by all parties involved. I would suggest addressing it as 32 1'` St NE. If the
owner would like an address off of lst Ave NE then it could have one of 3 addresses..100, 102 or 104 due to the
fact that across the street is a property addressed as 105 1'1 Ave NE.
I will wait to hear the decision.

I have a feeling this building has had an incorrect address for some time. This building should have an address of 32 1st
ST NE, as that's the range it correctly fit on. If it were to keep the address of 32 1St AVE NE, it would have to be located a
block south of there between the 2 properties addressed as 20&40 1st Ave NE.
I am assuming the owners want the business to be found easily by patrons, not to mention making it easier for police
and fire to locate them in case of emergency. They can pursue a change of address by contacting Bill Akers at Carmel
Communications(317-571-2577). He can address them off of 1St St NE or he can give them a whole new address off of
1St Ave NE.
