The height g,.%t''%+ —.1s § . ‘A:.., ,...:,..`` J, ..^ h.._ ,.o, H K ":.5 ee17 .-,. of the fence does not appear to be injurious to adjacent property owners. No negative, public comments have been submitted about this project at this time. Please see the petitioner's information packet for more details. Findings of Fact 1. The approval of these variances will not be injurious to the public health, safety, morals, and general welfare of the community because: it is not visible from the street and only a portion of the fence is 8 feet high. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: it will improve the privacy of the homeowner as well as their neighbor thereby improving the value of the property. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: a 6 foot tall fence would not provide the amount of privacy the homeowner would like, which would make the use of their pool and backyard difficult. Recommendation: After all comments and concerns have been addressed, the Dept. of Community Services recommends positive consideration of Docket No. 12060016 V. 1
