I can do all of this plus your other list from Mr. McCarty; no problem. (I only picked solar lights so that the
light's location wasn't tied down in case you wanted to move tables/lights around.) I will shoot for having this

That is a strange request from the neighbors; why would the address and street name make a difference? For the
official address change, please work with Bill Akers in the 911 Communications Dept, to get the exact
address /building number you discuss with the street name being 1st Ave NE. if Bill is no longer assigning
addresses, because of internal changes to staff responsibilities, please contact Pam Lux in the Building Permits
Dept.
The address number and the 'which is the front yard question' are probably two separate issues... I think Mike H.
already made a determination on that south side being the front yard for the sake of building setbacks and parking
locations. The only thing that might change is where Kevin will place his mailbox!

The Department reviewed and submitted comments for this project on 6/15/12. Revised plans were resubmitted on July
6, and the Department is in the process of reviewing the revised plans We do not foresee any major concerns regarding
the site plan for this project.

connectivity through the site The traffic study looks accurate, and we have no issues with what has been presented The
proposed connections to the site are acceptable, including the possible right -in /right -out off of Keystone
Abbey Taphouse
We have not received adequate information to completely assess the ADLS amendment, however, we provide the
following comments The Department recommends squaring off the intersection of 1st Street NE and 1St Avenue NE, 1) to
allow angled parking along 1st Avenue NE in the current public right -of -way, and 2) to create a safer intersection
Squaring off the intersection would allow for a safer crosswalk distance for pedestrians, better site distance for drivers
going south on 1St Avenue NE (if there is parking along 1St Avenue NE), and alleviate confusion that the existing
intersection in its current state may create. We also recommend changing the parking along 1st Street NE to angled
parking. The current plan to direct pedestrians behind the parked cars is not ideal; however, the concrete apron for
pedestrian traffic provides a good alternative to redirecting the pedestrians in front of the parked cars. There is a
significant increase in impervious surface from the existing conditions, and stormwater detention and stormwater quality
treatment need to be taken into consideration

That is 100% my thought as well, On premise consumption in the premises. What I am asking is for the outside
resale, distribution. Since the proposed use includes resale distribution I am sure there is no problems that will
arise when I have a buyer of my B -1 who has the identical intentions.

To be honest, I am not sure if what you are describing below would be a permitted land use in the B -1 district; Staff
would have to research that further.
However, a brewery and a brewpub are specifically listed in the definition of 'Restaurant' in the Zoning Ordinance's
Definitions Chapter 3. A Restaurant is a permitted land use in B -1.

Here is our correspondence with Abby Taphouse from last week. They did accommodate our request for "squaring off"
1St Ave NE in the site plan submited. It looks like we requested a 30' separation between parking and the stop sign only
for 15` Ave NE (not 1st St NE). We also would like the developer to consider stormwater due to the amount of impervious
surface on site. However, the entire site is less than 1/4 acre. So it would be nice if the Plan Commission could be
encouraged to ask for pervious pavement for the patio, or something similar, in order to reduce runoff (and heat) from
the pavement.

That is what we had in mind. I do not know the distance you are showing from the stop sign to the first parking space on
1s1 Avenue NE, but we require 30 feet between a stop sign and any parking.
The concrete apron is probably more desirable than relocating and directing the pedestrians in front of the parked cars. I
think we prefer the apron (as you have shown), but it is not completely ideal.
Please be aware of the need for stormwater detention and water quality treatment due to the amount of impervious
surface you are proposing. It appears the entire site will be paved, which is a measurable increase from the existing We
will further review this site when more details are provided.

Another point that I feel that I should make is if you look at the way the parking and pavement were configured
when this building served as a day care, the pavement was adjacent to the property line on both streets. The
business to the west, has pavement that meets the sidewalk which is actually beyond the property line.
I will propose to Kevin that he downsize the Beer Garden to a patio and we will try to orient away from the
property line to the north. His goal with the 3 seasons patio was as I stated, mostly for special events so maybe
if it was eliminated and they just put up a tent on those occasions it would be better perceived. I will work on
convincing him of that. Just brain storming here.

Thanks for the comments. I will talk to Kevin regarding Conditions of Approval today. He has told me that he
doesn't want to operate as a typical bar regarding hours of operation; probably like l Opm on weekdays and
12am on Friday and Saturday. I'm sure he would commit that his employees would park off -site. We want the
chance to be a good neighbor.
It seems to me pretty much a toss up which street would be considered the busier street. Both are identified as
"Minor Roads" on the GIS Map on the Website. The property east (Hartman) and north (McCarty) have 1st
Avenue address which would suggest to me the front yard. I'm sure Kevin would be open to one of the address
on 1st Avenue that Mr. Akers proposed. Plus, it is our intent for the "front door" to be on the east side of the
building.
I know we are "nit- picking" a bit here, but I would love to be able to not have to go for the variances even
though we have already paid to do so. Any idea when we might have some direction on the aspect of one front
yard to the east? Like I said above, we want the chance to be a good neighbor.

My two cents:
First, I guess the Department needs to determine the street with the greatest traffic. 1st Ave NE *OR* 1st Street NE.
Then we will know which frontage is your front yard and which frontage is your side yard (where you could park). Mike
H. will probably have to make that determination, or someone from the City Engineering Dept.
But, you also need to comply with the other requirement of the Character Subarea Regs: Renovations and Additions to
Existing Buildings: subsection i. Additions, except for open -air porches, may not be added to the front of the building
except where the building is set back more than twenty (20) feet from the Setback line of its nearest two neighbors. (See
Figure 2b). (This means that you have to use the building setbacks of your neighbor to the north (about 20 ft) and
your neighbor to the west (about 1O-ft, so 1 think whatever is determined as to which frontage is your front yard, you
would still need this variance).)

The site is located at 32 1st Avenue NE. The site is zoned B- lBusiness within the Old Town I wanted to share
information with you that I feel is valuable to their pursuit of the zoning variances. I am attaching photos of the
subject property, several of which were taken from my adjoining property at 120 1st Ave NE.
My porperty and the subject at 32 1st Ave NE share the same zoning classifications and have since 1987 when I
purchased my property. The property line between the subject and myself is defined with border trees that, if I
am correct, are the property of both Duell Properties Group LLC and me. Any changes that would effect the
modification or removal of the border trees must be mutually agreed upon.
My concern of ANY business at 32 1st Street NE is directly related to placement of dumpsters, employee
parking, client parking, hours of operation, noise and light pollution as well as the impact on my property value
of a partial zoned for zoned for both residential and commercial use.
When the Ginko Tree was in front of the zoning board prior to opening the greatest concerns were the look of
the building in conforming to the "Old Town" flavor and parking. This request for zoning variance at 32 1st
Ave NE appears to have a greater negative impact to those concerns today.

The street parking on 1st Ave NE during monthly events such as the 2nd Saturday walk as well as Carmel Fest
Parade and occasional festivals creates such a congestion that it would be nearly impossible for emergency
vehicles to travel north or south in the event of an emergency. As a note, emergency response had a degree of
difficulty at this years parade while responding to those in the area effected by heat related medical conditions.
The neighborhood is a mix of families with young children to elderly individuals. 1st Street NE and 2nd Street
NE act as arteries for the functions held at the High School throughout the year. People are constantly in
disregard of the current 4 way stops in those intersections. Add the street parking that this variance will create
and the potential for negative issues pedestrians, residents and patrons increases dramatically.
Please forward this information to all parties of interest for their review. If I can make it to the meeting on
Monday I welcome the opportunity of sharing these concerns.

We write to express our opposition to the planned establishment of a brew pub, at- 32 First:Avenue NE.
Putting a brew pub immediately adjacent to a residential neighborhood is a completely inappropriate
use of this property. The noise from this type of business, the increase in pedestrian and vehicular
traffic, as well as the parking on adjacent streets will negatively impact the quality of life for the
residents of this area.
The bulk of the activity will likely take place in evening and night hours increasing the neighbor's
discomfrort. Further, placing a brew pub at this site will undoubtedly lower property values for the
homes in the area.
We ask the Department of Community Services to recommend against the establishment of a brew pub
at this site.

I noticed on the site plan a ground sign was proposed at 12 sq. ft. and up to 8' tall. If you could please provide a drawing
of this sign, I would greatly appreciate it. Please remember that it should be a "suspended" style sign, with one post in
the ground and an "arm" hanging off it at a 90 degree angle. It can be either illuminated or non - illuminated. Please just
let me know.
Both signs will require sign permits after they have been approved. Please let me know if you have any further

1) Planting details will be required on the AO.1 landscape plan. Please add our city standard details to
the plan.
2) The plant quantities are not listed in the chart. Only the yews have been noted. Please add the
counts for the remaining plants.
3) I have attached a list of our recommended trees. I recommend fast growing shade trees to shade
your outdoor seating. The London Plane tree or Japanese Zelkova would be good choices. A couple
trees could possibly be installed between the boxwoods, while using some of the 2'8" area of grass
as well, along the beer garden.

The Engineering Department has looked at the plan for this project, and we will need further information to adequately
assess the ADLS amendment that is before the Plan Commission next week. Please submit full engineered site drawings
for review. We would like to comment on the parking layout and pedestrian crossings at this time, however The
Department would recommend "squaring -off" the intersection of 1" Street NE and 1st Avenue NE to allow angled parking
along 1st Avenue NE in the current public right -of -way. We would also recommend changing the parking along 1' Street
NE to angled parking. The current plan to direct pedestrians behind the parked cars is not ideal, however, the concrete
apron that is currently shown may work.

The address is as Brooke mentions....it is incorrectly addressed as it. Now is an excellent time to make the
correction so it can be found easily by all parties involved. I would suggest addressing it as 32 ls' St NE. If the
owner would like an address off of 1St Ave NE then it could have one of 3 addresses.. 100, 102 or 104 due to the
fact that across the street is a property addressed as 105 1st Ave NE.
I will wait to hear the decision.

I have a feeling this building has had an incorrect address for some time. This building should have an address of 32 1s1
ST NE, as that's the range it correctly fit on. If it were to keep the address of 32 1st AVE NE, it would have to be located a
block south of there between the 2 properties addressed as 20 & 401St Ave NE.
I am assuming the owners want the business to be found easily by patrons, not to mention making it easier for police
and fire to locate them in case of emergency. They can pursue a change of address by contacting Bill Akers at Carmel
Communications (317 -571- 2577). He can address them off of 1st St NE or he can give them a whole new address off of
1St Ave NE.

Below are Staff's preliminary review comments. We hope you can include these revisions when you submit the info
packets this Friday by noon. If not, there is another mailing to the Plan Commission members on Thursday July 12, at
noon, where you can have us mail out your supplemental info, along with the Staff reports. Thanks.
1. Please submit all design details for the exterior light fixtures: colors, materials, etc.
2. Please submit better details on the signage proposed: colors, materials , size, location, lighting, etc.
3. Please submit photo examples of what the outdoor patio furniture will look like.
4. Please submit a preliminary landscape plan with numbers and types of plantings to this Dept. and to the
Forestry Dept.
5. The bike rack location needs to be located within 50 -ft of the main entrance, per ordinance chapter 27.06.03.
6. Please provide the bike rack design details, per ordinance chapter 27.06.03.A.
7. Please label the sidewalk width. (It should be at least 5 -ft wide)
8. Please provide screening /enclosure details for both the trash dumpster and the cooler for beer storage.
9. On the building elevations, please label the building materials and colors.
10. On the site plan, please label the gravel areas.
11. On the site plan, please add the lot coverage percentage (which includes all building footprints and impervious
surfaces). It should not exceed 70 %.
12. Please provide more design details about the 3 season patio, such as its materials and colors. Also, the
Character Subarea requires that any accessory building /structure match or complement the principal building's
materials and colors -- see page 17 of the Old Town Overlay regulations online:

Thanks for the dimensions and sending this over. Unfortunately, the roof sign is too big. After reading over the Sign
Ordinance, a roof sign would not be allowed in this location because it has been converted from a residence to a
business use. This is in 25.07.02 -08 a). Here is a link to the Sign Ordinance. This section can be found on page 8 of the
link. Since you are on two street frontages, two signs would be allowed. You could have a combination of two the
following:
1. A Wall sign at up to 30 sq. ft. facing 1st St. SE
2. A Projecting sign at up to 20 sq. ft. facing 1st St. SE
3. A Suspended Ground sign at up to 12 sq. ft. and up to 8' tall facing 1st St. SE and /or 1st Ave. NE (preferred size
would be 3' x 4' either horizontally or vertically oriented)
4. A sign placed on the grain silo would count as a wall sign.
Please submit drawings of your preferred sign types with dimensions for further review. If you have any questions,

I took a quick look at the drawings and have a few comments. It looks like the elevated grain bin will be about 100% in
the right -of -way and could potentially block the vision of drivers trying to back out of the parking spaces on the south
side of the site. They are also planning on removing the existing sidewalk that is in the right -of -way and the crosswalk
ramp on the south east corner of the block and replacing it with parking lot and moving the sidewalk onto their
property. We would typically want the sidewalk to be 100% in the city's right -of -way. They are providing more than
enough bicycle parking, but the racks could be too far from the front entrance (depending on what they consider the
front entrance).
It looks like on- street parking would supply just as many spots in front of their building. Would that be a possibility?

The Indiana Fire and Building codes would require a automatic fire sprinkler system for an A -2 occupancy as is
outlined below:
903.2.1.2 Group A -2.
An automatic sprinkler system shall be provided for Group A -2 occupancies where one of the following
conditions exists:
1. The fire area exceeds 5,000 square feet (465 m2)
2. The fire area has an occupant load of 100 or more; or
3. The fire area is located on a floor other than the level of exit discharge.
Please note that the requirements for establishing an occupant load are detailed in
the building and fire codes. Furthermore, see the IAC requirement listed below for the change of use of
and existing building:
675 IAC 12 -4 -11 Occupancy of existing buildings
Authority: IC 22- 13 -2 -13
Affected: IC 12 -17.2: IC 22- 12 -6 -6: IC 22- 13 -2 -2; IC 22- 13 -2 -8; IC 36- 8 -17 -13
Sec. 11 (b) No change in the character or use of any building or structure shall be permitted that shall cause the
building or structure to be classified within a different occupancy group or within a different division of the
same occupancy group, unless the building or structure complies with, or is made to comply with the:
(1) current rules of the commission for new construction for the proposed revised use of the building; or
(2) provisions of:
(A) Chapter 34 of the Indiana Building Code (675 IAC 13- 2.5 -32): or (B) 675 IAC 12 -13.
(e) Subsection (b) shall not prohibit the following accessory uses within Class 2 structures provided they are in
one (1) room that does not exceed five hundred (500) square feet in floor area:
Instructional classrooms for fewer than twenty (20) adults or children when used not more than twelve (12)
hours per week or four (4) hours in any one (1) day.
Anyone needing guidance on the requirements listed above should work with a state of Indianaregistered design
professional (Architect).
