9. (SU)Mercy Road Church.
The applicant seeks the following special use approval:
Docket No. 12070006 SU ZO Ch. 12.02 Special Uses,place of worship in B-1 district.
The site is located at 10505 N. College Avenue. It is zoned B-1/Business and lies within the Home Place
Business District. Filed by Patrick Sheehan of College Building Company, LLC, owner

- The petitioner is requesting a Special Use approval to
allow a church in a B-1/Business district. The

a made. Half of the building is occupied as an office
I use and the church will occupy the remaining half of

f • Analysis:
' A special use is generally looked upon favorably if it
)' is integrated well within the context and character of
the area This special use is proposed in the existing

' Home Place Business District,which has a mix of
uses in the area including office,retail,and some
= residential nearby. The building is already an
existing office building and the existing parking will
satisfy the required number of spaces for the church use. The Carmel Clay Comprehensive Plan(C3 Plan) suggests that
an institutional node is a best fit next to a community vitality node, which this Home Place Business District is classified
as. The department is in support of this Special Use.
Findings of Fact,Special Use:
1. The premise in question is particularly physically suitable for the proposed Special Use because: it is in an
existing building with adequate parking and it is in a neighborhood serving commercial area.
2. The Special Use will not injuriously or adversely affect economic factors,such as cost/benefit to the community
and its anticipated effect on surrounding property values because: no changes to the site are being proposed and
the use of a church will be complimentary to the existing office use on site as the church will mainly function during
hours when the office is closed.
3. The Special Use will be consistent with social/neighborhood factors, such as compatibility with existing uses
and those permitted under current zoning in the vicinity of the premises under consideration and how the
proposed Special Use will affect neighborhood integrity because: it is surrounded by a mix of uses that are
neighborhood serving. There is also residential nearby for the church to serve and will allow patrons convenient
access to this type of use.
4. The Special Use will not injuriously or adversely affect the adequacy and availability of water, sewage and
storm drainage facilities and police and fire protection because: All utilities are currently in place and nothing is
being changed on site.
5. The Special Use will not adversely affect vehicular and pedestrian traffic in and around the premises upon
which the Special Use is proposed because: parking,streets, and sidewalks are all ready in place and no changes are
being made to the site.
Recommendation: The Dept. of Community Services recommends approval of Docket No. 12070006 SU.
