1. The approval of this variance will not be injurious to the public health, safety, morals and
general welfare of the community because:
Clay Tile Roof Material is an industry standard that has been used throughout the United States by
many architects and developers in order to achieve a European,Mediterranean or Italianate
architectural character in their projects. The clay roof tile specified for the Olive Garden project will
meet all local,county and state code requirements necessary to insure the public health,safety and
general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
As stated in the Michigan Rd./US 421 Overlay District Design Guidelines that"all buildings built in the
Overlay District must be consistent with or complimentary to one of the following styles(Georgian;
Federal;Italianate or Greek Revival). The use of clay roof tiles as depicted on our submitted building
elevations is consistent with the Italianate architectural style.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:
The Olive Garden `Capistrano'roof tile by Eagle Roof Company is an integral architectural element for
the overall `italianate'appearance of our Tuscan Farmhouse prototype that is our brand image
throughout the country. Non-use of this specific design material would detract from our overall
architectural look and brand image.
