The building design is more of a Tuscan Farmhouse style instead of Italianate,or one of the other 3 styles, permitted by the Overlay. However,the petitioner has worked with the Department and the Plan Commission on the architectural design of the building and they have made some changes. They have also presented architectural elements/features of the building which they consider complementary to the Italianate architectural style. The Department is satisfied with the changes. At the Plan Commission meeting on September 18,the Development Plan and ADLS petitions received approval. The Department is supportive of this variance. Findings of Fact: Roof Material 1. The approval of this variance will not be injurious to the public health,safety,morals,and general welfare of the community because: the proposed roof material will not detract from the character already established in this area by previous developments. 2. The use and value of the area adjacent to the property included in the variances will not be affected in a substantially adverse manner because: the proposed roof material will not detract from the character and sense of place already established in this area by previous developments. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: while this property will still be viable for other development,it will be difficult for an Olive Garden to build here without their typical roof which is an integral part of the overall appearance of their prototype. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 12070007 V. 10
