Include the perforation specifications on the riser detail on sheet 603. Remove the detail on sheet 601.
Are there any special seeding recommendations to establish the no-mow Bluegrass? Is a nurse crop needed?
The SWPPP does not show any seeding except for the ponds. A separate seeding plan is recommended or show on the
landscaping, plan.
Recomrnend on sheet 403 to include information about dewatering bags, and boring mud will be disposed of properly.
Widen the temporary crossings to 20' wide. Trucks are typically 10' wide. Add a 12" high stone berm along the outer
edges of the two te.:tnporary crossings to prevent slop from entering the waterways. Add silt fence at the crossings from
the stone berms to existing SF or higher ground.
Provide jnlet protection forJhe two flared end-sections. Add appropriate detail.
Note on the plan that the teniporary.swale at the rear of the large building pad and the swale from the B Shops will be
graded, seeded and stabilized with EC Blankets within 7 days of completing rough grade.

for the spoil from Pond B. Construct Pond B. Install outlet with temporary riser before pond is completed. Seed and
install EC blankets on pond slopes and seed dis~rbed area around pond B.
Line 6- Install teniporary crossings and remaining silt fence, except around proposed stock pile.
Line 7- Concurrently start the construction of the remaining ponds and pond outlet pipes. Start the' construction of
the main storm sewer trunk line from pondB to its inter~eptwith the existing 36" pipe. Seed and stabilize the pond banks
'and disturbed areas around the ponds within 7 days of the completion of rough grading.

The Carmel Plan Commission offers you the following report on the application of Brenwick
TND Communities, LLC, (Docket No. 04060035 OA) petitioning to amend the development
requirements established under The WestClay Village Planned Unit Development Ordinance No.
Z-330 as pr~viously established by the Common Council of the City of Carmel, Indiana. The
area affected is generally located on the southeast, northwest, and southwest comers of West
131 st Street and Towne Road, Hamilton County, Indiana.
The Carmel Plan Commission's recommendation on the .petition of Brenwick TND

Village of West Clay Rezoning
Ms. Hancock-
My name is Michael Deganutti, laurel lakes resident, and I attended the meeting last night regarding
the zoning change to include retail south of 131 st and west of Towne.
Some concerns that I have... and would appreciate if you would pass along to other council
members:
Has anyone addressed the three entrances on to 126th street that is.e change from the "one" that
was in the original plan? This will significantly increase the traffic on 126th.. (especially wI the new
school) Dad's club soccer, new housing developments to the west and possibly a new church. This
street is almost entirely "school zone from 7 to 7..... and the traffic at the "T" intersection of 126th
and Towne will be a disaster as traffic exits the retail area to avoid the school zone. It will be almost
impossible in the afternoon for school buses or cars to go north on Towne from 126th street. One fix
maybe to temove the roundabout in front of the village entrance... and put it at 126th and Towne.... I
definitely would hate a street light placed at the 126th and Towne location... and I think another
roundabout would be overkill and a nuisance for school bus drivers.(ie "3" between the corner of 12
6th and 131 st). The three entrances to the village from 126th street will also cause significant
"headlight" pointing into the houses of Laurel Lakes... I can't imagine that three entrances would be
needed if there are only three going east into the village off of Towne road.
Also.... what wHlbe done to prevent traffic cutting through from north of 131 st to get to 126th street to
drop kids at school, soccer or heading to the church?.. also people who live on 126th in the new
developments will cut through to get to the roundabout (retail one) on 131 st instead of turning left at
the "T" intersection on 126th and Towne. I don't think this makes for a "quiet" neighborhood or
retirement village.
I was very impressed wI the questions asked at the mtg wednesday night regarding what types of
businesses, hours of operation, and architectural review questions. I feel that my interests and
concerns are being well represented.... I would appreciate as much concern placed on the traffic
patterns and intersections as was discussed regarding content or purpose of the retail
establishments. Low traffic and minimal light pollution is, i believe, in keeping wI the "spirit" of this
PUD... and as the gentleman from Brenwick stated.. "we don't need the retail to make this project
successful."

My Name is Eric Uren and I live at 12058 Ashcroft Place in the Laurel Lakes Subdivision. I wanted to let you know that I
am strongly opposed to the proposed rezoning for the Village of West Clay.
I moved here in 1998 with the understanding that my house as well as my neighbors were in a zoning that would keep the
property values high. Now it seems that whatever Brenwick wants - they get.
I am asking that you oppose any commercial zoning and any increase in zoning to allow more homes per acre. This will
only have a negative affect on traffic, home values, and safety of our neighborhood.

Description of VWC commercial use Notes' and Comments
Liquor store This type of commercial use is unneccessary as alcohol may be
purchased at other Village of West Clay stores including drug stores
and/or small grocery stores. This type of commercial use has great
potential for deteriorating over the years..
Fast food restaurant with drive through This type of commercial use has the potential to attract unwanted
window traffic and noise and also has the potential to serve as a IIhangout"
for teenagers. Nearby office workers should be able to have luncrl
at small restaurants or sub shops; so there is no need for a
community serving drive-though establishment.. This type of
commercial use does not seem to be neighborhood serving. Such
establishments can be found a few blocks awav on Michigan Road.
Bank and Drug store with drive through Banks and drug stores will be acceptable without a drive through
window and would be neighborhood serving. Inclusion of a drive through
increases the likelihood of drawing traffic from outside the
development and is no longer neighborhood serving, as neighbors
could walk to such establishments.
I Commercial development positioning We would like to request that a!l retail be contained deep within the I
Village and not on the perimeter. A CVS drugstore directly on 131 st
Street would not be acceptable to area residents and would not I
be "community serving" but \^lOuld draw external traffic. It \l'lould
also set a danQerous precedence for future development.
Commercial development - General Commercial development within the Village of West Clay should be
c,omments: restricted to neighborhood-serving uses. The concem exists that I
once commercial development occurs it will set a precedence for
additional commercial development in the surrounding area. This is
of utmost concern to area residents.
Request for Increased density within the The request for increasing the density as contained in the current
Village of West Clay - General comments: VWC 2004 proposal is of utmost concern to area residents. This I
I increased density was not approved in 1999, nor was it approved in I
2002 and I ask for you great consideration in granting Brenwick this
request in 2004. The main reasons for residents concern is the
I inability of the roadvvaysystenl to handle the additional traffic and
the "slippery slope" that this would create with future development
in the area. Once an increased density is approved it \^liII be I
difficult, if not impossible, to deny otrler developers the right to I

My name is Nadine Baker and I am a Board member representing the Crossfields Homeo.. ers
Association. Our subdivision is located at the comer of 116tll Street and Towne Road. 15
I just wanted to send you this letter to highlight a few major concerns that myself and other
residents have regarding the Village of West Clay Docket numbers 04060035 OA and 04060036 Z.
Although Brenwick has made some very positive changes since their initial submission of this
project, there are some significant issues that I have with the current proposal, which include the
following:
1. Raising the density cap within the Village of West is of major concern. Many of our
Crossfield's residents already have great difficulty getting out of (or turning into) the
subdivision at many different times of the day and this proposal would serve to add to that
problem.
2. Raising the density cap and (more specifically) allowing Town homes to be constructed on
the NW comer of Towne Road is of major concern. This would bring the current density of
that land parcel to 4.5 and would add to a pre-existing traffic problem. Furthennore Towne
Road and surrounding intersections are not equipped to handle the increased traffic burden
that Town homes and increased density within the Village of West Clay would provide.
3. The types of retail uses are still of concern. We would like to ask that the liquor store, fast-
food restaurants with drive-through windows, and gas stations not be pennitted as part of
this retail area. The main reasons for this request are related to traffic and road safety.
While I commend Brenwick for placing a cap on the total amount of commercial
development within the Village of West Clay, I would still like for there to be further
consideration regarding the types of commercial developments that are allowed to exist
within the Village.
4. The hours restaurants and stores are permitted to be open should be written into the
ordinance and be restricted to hours compatible with a residential area rather than a typical
commercial area. Lights, noise, and traffic should disappear as evening approaches.
5. As is required along Meridian St. and Michigan Rd. we would like to ask that all outside
sales displays should be completely prohibited. This may be already in the proposed
ordinance, but if not, please include this. While a flower shop with a display of flowers
could be nice for people who walk by, the area is proposed for auto-driven traffic.
Regarding the proposal for Town homes on the NW comer of Towne Road, Brenwick stated that
they could not develop the extra 30 acres if they did 110t get an increase in their density cap. While
Brenwick is no longer asking for a rezone of this 30 acres for commercial uses, Brenwick is asking
for a rezone of30 acres from S-1 Residential Estate (a base of 1.3 under ROSa) to a density on this
30 acres that could not be built without a rezone even under ROSa. It seems that the proposed
density on this 30 acres has to exceed S-2 (ROSa base of 2.4), which is a problem for myself and
other residents. If they omit the 30 acres from their proposal, I sincerely doubt any development
having a density of 2.2 will be proposed or approved. If it does get approved, then all future
development will be able to use this extremely dense development as a reference, causing a
downward spiral for increased density in the entire area. I would like to ask that if Brenwick cannot
develop this area without an increase in density that it be dropped from the proposal.

could continue to develop this parcel of land following the previously proposed density of 1.7 -
2.0, not to' exceed 2.0, that would be greatly appreciated and would alleviate the majority of our

As you know, on October 5th Brenwick submitted a modified plan for The Village of West Clay to your
office for the Special Study Committee to review at its October 7th meeting. This modified plan
eliminated the request to increase the amount of commercial/retail square footage within the Village of
WestClay project and modified the land plan west of Towne Road to address the concerns raised by the
committee and the public.
Our traffic engineers, "Edwards" and Kelcey, recently calculated the Peak "Hour AM and PM trips
associated with the proposed" modified plan and compared them to the trips calculated in the original
study conducted in 1999. Attached is a letter from Edwards and Kelcey which.outlines, in Scenario IV,
the trips associated with the proposed modified plan (Updated Study). Below is a table that shows the
comparison of the two studies.

In a letter to your office dated August 3rd, Brenwick proposed a 9% increase to its 1999 Voluntary Traffic
Improvement Funding which coincided with the increase in Combined Peak Hour trips associated with
the land plan, including more commercial/retail square footage, filed in June 2004. As you can see by
looking at the new traffic information, this projected increase in peak hour trips was associated entirely
with the increase in commercial/retail space, since the original study in 1999 was based upon a residential
density of 2.2 units per acre, not the 2.0 units per acre actually approved at that time. Since (i) we have
withdrawn our request to increase the commercial/retail square footage in the project, (ii) the proposed
residential density is the same (exclusive, of course, of the senior housing, which generates very few peak

hour trips) as that which was the basis for the existing Voluntary Traffic Impact Finding and (iii) the
Combined Peak Hour Trips associated with our current proposal is less than the estimated trips in the
1999 study, we do not believe that any increase in our voluntary funding of off-site road improvements is
justified and, accordingly, we hereby withdraw our proposal to increase the funding by 9%. This does not
affect the commitments we made in 1999 and 2002 which we fully intend on honoring or reallocating the
remaining funds as directed by the City.

We have reviewed the primary plat submitted to the Hamilton County Surveyor's Office on
August 24> 2004 for this project and have the following comments:
1. This p!oject falls within the jurisdiction of unincorporated Hamilton County.
2. The Hamilton County Surveyor's Office has no objec1ions to the vacation of the
West Carmel Center Block F Secondary Plat. Please note though that there are
regulated drainage easements on this affeot land that do not show up on this plat

3. In regards to the new primary plat, once the construction plans for the
reconstructions of the Crooked Creek Regulated Drain~ the Mayflower Park Arm

easements for the regulated drains will be determined and need to be shown on
the plat.
4. The submitted revisions to the construction plans for West Carmel Marketplace
are currently being reviewed and additional comments are likely necessary.

5. This plat will need to be submitted through the Hamilton County Plat Review
Process and will need to be approved by this office before the Hamilton County
Commissioners sign the plat.
6. At a later date, a Subdivision Non-enforcement Agreement will be required to

of the new secondary plat for West Carmel Marketplace.
7. Although the Hamilton County Surveyor's Office has reviewed this primary plat
. and issued a comment letter; this office will not be limited by the primary plat in
regards to the pond sizes or location, drainage easement widths, storm sewer .
locations, lot layout, landscape layout~ or any other drainage related issues.
Insufficient information is present~d to conduct a complete drainage review and

Original PUD concepts and proposals include the concentration of high density, heavy
uses. tall buildings and commercial properties in the center of the new "vjl1age," ar0und its new
"square" and in the adjacent streets, in order to create the feeling of a sntall town. As the PUD
spreads 011t to its boundaries, the homes and the residential lots shonld get larger, ~d the early
fom1 of architecture evolves into later, but still traditional forms.. When the Pur~ touches its
existing neighbors=, the change, impact and compatibility should be almost neutral.
Original Brenwick plans conformed to this protocol. Nevertheless, in its tt.ird proposal
nOW for its property west of Towne Road, Brenwick continues to search for more lucrative
models of development to enhance its sales and profitability-It now proposes very significant
and tall buildings to sUIround an assisted-living facility, perhaps because single 1D1ily home
sites may not sell well across the street from such a facility. This gives the west' side a more
urban streetscape than the center core of West Clay will have. The visual, traffj"c and usage
impact on adjoining neighbors will be dramatic. The 1lpscale country hom~/subd.ivision
landscape of West Cannel will be no longer viable around tbis location.

Senior housing does not demand three-story massive facilities. Cottages, attlched homes
and other service structures can be constructed to match virtually any sUIToundittg residential
properties. Stacking stories does increase density and sales, but does not co~orm to the
approved planning for this area. The integrity and continuity of the planning process is
jeopardized by these continuous revisions to the plans, seemingly motivated by the latest
opportunity presented to Brenwjck. :
The commercial use on the 11ort11west corner is a good example of som\ething never
envisioned for West Clay when originally adopted. There is no need in this area fo! more stores
with the explosion of shopping on u.s. 31 and 421, 10 minutes away in either direction. Rather,
Brenwick proposes the development of this comer because "if someone does it, it sb,Quld be u.s."

Brenwick admittedly does a good job of architectural research and street' front f~ade
control. Its public buildings and center core village homes are true to its desigD !goals of 19th
Century Americar However, making a storefront attractive does not, or at leas~ should not,
disguise the fact that it is a store. More stores. We question the scale, scope and impact oftl1is
proposal in this location. again, as violative of the principles used ill. adoption. of the PUD
originally. Cannel planning should be consistently applied, predictable, enforceable, and well
reasoned. It should not reflect just the latest opportunity. It should reflect a plan.

2. Request for Modification.
a. We believe "senior housing" of whatever type used il1 West Clay sh~uld take the
form. of one or two story stroctures very similar to other single-family residences
that SUlTound the area. Senior housing can be just as viable in thi~ mode. It
should not be the size of a 1950's high schooL These structures need to be
comparable and compatible with StlI'l'Ounding residential properties. '
b. The town homes planned for "West West Clay" should not duplicat~ those at its
center core, but should be reduced to two-story stnlctures and should be centered
on the 83-acre parcel and concentrated near Towne Road. They S1;lould not be
placed on an urbanized "main street)' to match the high school-s;.zed assisted
living center, and they should not be placed on the boundary with existing
neighbors' homes. :
c. Any commercial development at 13ISt and Towne's northwest comer should be
minimized or removed entirely to the West Clay center, which can b~ re.-platted if
necessary to use existing vacant ground. now reser/ed for "other ~hops.)' The
residents of West Clay won't mind a car or two around these stor:.as. They all
have 3 or 4 car garages. There are catS in West Clay. The aesthetic virtues of
West Clay are not compronUsed by cars or stores in its business di~trict. Angle
parking is already used there and will service the businesses BrenWick plans to
put on the northwest comer. Brenwick plans angle parking on the northwest
comer anyvlay.
However, the Plan Commission should not deny the Brenwick petition fot commercial
development on the northwest comer Bnd subsequently grant commercial developII'.ent next year
to a rival developer. The Commission should decide on its goals and plans for thi s and similar
properties in this area and maintain that plan throughout this period of growth and .development.
If the Conunission believes that the comer should and will be commercial. then the current
Brenwick plan and petition will be better than a typical strip center. The real que~on is on the
underlying use and what Carmel believes should be on that comer.
3. Other Nei2hbors' Views.
The subdivision of Laurel Lakes, lying on the southwest comer of Towne ~ad and 126th
Stteet, just south of the West Clay parcel now proposed for the assisted living arid town home
development, is supportive of the position taken in tbis letter. This subdivision's executive
conunittee attended the pubHc hearing on Brenwick's petitions and believes the h~ight and mass

of the proposed buildings conflict with the original West Clay design and with their 'general plan
and style of neighborhood. They would also prefer twoustory strudures west of 1!owne Road.

part of the same farm, also generally share these views. :

Dea(Carmel Planning Commission members:
I ask you to consider several points of concern for newly annexed city of Carmel
residents in Clay West Township. We would like to start by asking that you keep all
commercial development contained within the main center of the original Village of
West Clay proposal as originally submitted by the Brenwick Development Corporation.
George Sweet and the Brenwick Development Corporation may state the need for this
commercial parcel of property as a "changing market". But that simply is not true and
goes against what a majority of the people of the area are wanting or needing.
Residents live here because of the more rural nature of the area and would like for it to
stqy that way. The original intent of the Village of West Clay was to have a self-
contained development that was pedestrian-friendly and did not encourage vehicle
traffic. All villages and shops were to be contained withi,n the main center of the Village
of West Clay. This current commercial proposal goes against the concept of the original
proposal and would drastically change the nature of the area.
When the Brenwick Development Corporation held a community meeting to tell area
re~idents about this new commercial project, many important details were left out of the
discussion. The gas station is a problematic example. Many residents in the area are
operating from well water, so there are health and safety concerns regarding the use of
underground fuel tanks, which introduce the risk of contamination of the surrounding
groundwater. There are retail centers and gas stations located at 106th and Michigan
Road, so area residents can easily travel to this location. A need for this non-
pedestrian-friendly development does not exist for such facilities in the 131 st Street and
Towne Road location.
w~ agree with and support the concerns others raise regarding traffic. Let me just
emphasize now that the roads in the area DO NOT have the infrastructure to allow for
fre,quent travel by fuel tankers, large delivery trucks and semis, nor the capacity for
such increases in traffic that would result from the building of this center. Please
remember that there are schools in the area now.
Fci.st food restaurants with drive-through windows and gas stations with service bays
an'd car washes, were also not mentioned at the public meeting Brenwick held. At a
minimum, the new commercial area should be scaled down to exclude any fast-food
dri've through restaurants, liquor stores, and gas stations. It should include only small
business, as originally proposed in the initial Village of West Clay proposal.
In regards to the proposed Senior Housing, we support the concern regarding overall
density levels and adamantly oppose increasing them. There are other concerns

specific to the Senior Housing.
We would believe, if the Senior Housing is approved, that it should be built within the
center of the Village of West Clay and NOT on the west side of Towne Road. There are
numerous reasons for this request, including the following:
1. This goes against the entire original concept of the Village of West Clay proposal.
The initial intent was to have all commercial buildings, shopping areas, etc. be
located within the village so that people did not have to get into their cars and
drive. Seniors would want to live in the Senior Center initially due to the more
rural and peaceful nature of the center. However, as Towne Rd is widened to 4
lanes and the area becomes busier, they would now be isolated away from the
village. Please consider the health, safety, and welfare of these seniors as they
would have to cross a busy intersection to get to the Village center and any shops
there. This proposal as is would force seniors to get in their car and drive a mere
few blocks away. For many of these seniors this would impossible as many may
not drive or have access to a vehicle.
2. There is nota need for such a center as a Senior Assisted living complex exists
on Towne Road and 86th Street, only a mere 5 miles away.
3. Please hold the Brenwick Development Corporation to the initial intent of the
Village of West Clay. This project was to have a dense center and then become
increasingly less dense residential, with only single family detached residential,
as the development moved outward. The idea was to decrease density toward
matching the S-1 residential estate zoning. Approval of the Senior Housing west
of Towne Road clearly violates this and should NOT be allowed.
4. The building of this center would open up the area for future commercial
development. This proposal is a rezoning of S-1 Residential Estate to something
much, much denser and should not be approved west of Towne Road or along
Towne Road. Other developers have already used the Village of West Clay to
increase density for current development in the area. The location of the very
dense Senior Housing increases the problem as it puts pressure on how the
nearby land is developed. It becomes a slippery slope or downward spiral.
The changes we propose would serve to secure the safety, health, and welfare of our
residents. We request the commercial development project not be approved or if
approved, be built within the center of the village. Residential deve,lopment compatible
with S-1 Residential Estate zoning should be built on the northwest corner of 131 5t and
Towne Road. The Senior Housing should be moved within the center of the Village of
West Clay for the health and well-being of those seniors, and to protect the area from
future commercial development, especially west of Towne Road.
There is also a request in the current proposal for changes in building structure. Rather
than requiring structures to be built with the same materials on all 4 sides, one typeof
material could be used on the front with three sides of "other" materials. This will
cheapen the development and is another change that was not mentioned to residents.
We request that the Village of West Clay continue to be developed per the standards
originally set forth in the original proposal.

We would like to take this opportunity to respond to questions submitted by Ms. Marilyn Anderson
regarding our Traffic Impact Analysis of July 29, 2004. Following are the questions relating to our
Analysis and our responses. Ms. Anderson's comments are in bold, with our response following. We
hope that this helps to clarify any questions the Plan Commission may have.
Ms. Anderson writes: The rust page oCTable 2 shows intersections all at 136th Street or 141st
Street, north of the P,UD. Turn the page and look at all the F levels of service. And this doesn't
even include 116th and Shelborne. Why not?
The City of Cannel staff provided Edwards and Kelcey and Brenwick Development with a list of 23
intersections to count and analyze. The intersection of 116th and Shelbome was not on that list and was
therefore not included in this analysis.
Regarding the F levels of service: Those are aclmowledged in the letter and are conditions to be expected
with the existing intersection configurations and stop control cOI}ditions. Traffic signals or roundabouts
are recommended at all three of the intersections that Ms. Anderson'refers to.
Did they actually study current traffic or just "analyze" earlier studies?
Edwards and Kelcey did conduct AM and PM peak hour counts at all of the 23 requested intersections in
May 2004. The AM peak hour was counted from 7am to 9am. The PM peak hour was counted from 4pm
to 6pm. Complete traffic volumes and existing level of service analyses for all of these intersections were
provided to Mr. Mike McBride on June 18, 2004. Along with that information, we also provided Mr.
McBride with a comparison of traffic volUII).es by approach at those 23 intersections as counted in 2004
and in 1998.

In 2002 a traffic study of West Clay was prepared by A&F Engineering for the City of
Carmel....The intersection of 131st and Town with existing. and proposed traffic volumes and
adding left-turn lanes still resulted in D & F ratings for the intersections as a whole. Again, a
traffic signal was required to improve the ratings to B.
We agree with Ms. Anderson and the referenced A&F Engineering study that this intersection will not be
improved by simply adding turn lanes to an unsignalized location. Our analysis finds that current (2004)
levels of service are F at this intersection. 2008 volumes support a continued LOS F whether or not the
land use plan is changed as proposed. Either a traffic signal with turn lanes or a dual-lane roundabout
would be required to bring this intersection up to acceptable levels of service.
The "Total External, Non-Pass-by Trips" is referred to the double ** p~ssage. But this passage
discusses "Pass-By Trips," not "Non-Pass-by Trips" The numbers are exactly the same for all the
columns in the AM Peak Hour (Total External & Total External Non-Pass-By), but the PM and
Combined Peak Hours show a reduction in traffic only in the "Updated Study" rows. Then, even
though there is an increase of 160/0 as the total for the Combined Peak Hours for Total External
Trips, there is only an increase of 90/0 for the Total External Non-Pass-by Trips. The 90/0 figure is
used to justify only a 9% increase in roadway. commitments. I don't understand..
In the original study, pass-by trips are not taken into consideration in the analysis. The total external trips
generated by each land use are equivalent to the number of vehicles entering and exiting the external
street system at the site driveways. However, a portion of these trips is attracted from the passing stream
of traffic. Retail developments, in particular, are frequently located at busy intersections in hopes of
attracting customers from the motorists already on the street. Pass-by trips are defined as "intermediate
stops on the way from an origin to a primary trip destination without a route diversion. Pass-by trips are
attracted from traffic passing the site on an adjacent street or roadway that offers direct access to the
generator. Pass-by trips are not diverted from another roadway."I Therefore, only non-pass-by trips
actually add traffic to the adjacent streets, and pass-by trips can be subtracted from the total generated
trips.
In the case of the original West Clay concept, the entire commercial area was contained within the center
of the Village. Virtually no one was expected to divert from their path on 131st Street or Towne Road to '
enter the Village, run an errand, and then continue on their way to worklhome/etc. The volumes
associated with the 'original study in Table 1 then, are the same in both instances because zero pass-by
trips are expected for this type of development.

In the case of the proposed commercial area at 131 st and Towne Road, however, the development is such
that pass-by trips would be applicable. Vehicles that are already on the roadway today will be attracted to
this site for various purposes. For instance, someone on their way to work will pull off 131 st Street to run
into the banl\ or someone on their way home along Towne Road will stop at the market to pick up milk.
These trips are not adding traffic to theroadway.in the future because they are already there today. They
only add traffic to the site drives. The site simply presents a convenient opportunity to stop along their
present route. So, in the updated study you will notice a reduction in the number of PM peak hour trips to
account for this pass-by factor. Without including pass-by trips in our calculations, we would essentially
be double-counting all of the cars that are making this type of trip.
The pass-by trip volumes used are based upon industry standard practices as referenced in the Institute of
Transportation Engineers Trip Generation Handbook1. According to this resource, 39% of PM peak hour
trips for a retail area of this size will be pass-by trips. Although some AM peak hour pass-by trips may
also be expected, statistical information is not available for that period. Reductions for pass-by trips in
the AM peak hour were therefore not applied.
How is the count handled for cars that leave from within the Village of WestClay and traveled
Towne or 131st St. to get to the peripheral Commercial Area? Towne and 131st are both busy roads
and just crossing them adds to congestion.
Trips between the Village and the proposed commercial area at 131 st and Towne Road were added to the
adjacent roadways just like any other trip made to that commercial area. In the Village area, internal trips
can be assumed as people travel between their homes and the Village without using the adjacent roadway
system or ~y bicycling or walking. This is not true for the commercial area at 131 st and Towne. No
reductions were taken for internal trips at the proposed 131 st/Towne development and all non-pass-by
trips to and from that development were added to the adjacent roadway system.
The Traffic Impact Study is unacceptable. An actual. count of existing traffic needs to be taken and
projections based on that reality rather than counts from the original study done yeats before 146th
Street was improved and traffic down Shelborne increased dramatically.
New traffic counts were conducted in May 2004 and used as the basis for the Levels of Service analysis
provided in the July 29, 2004 Analysis. Please refer to that letter (top of page 3) which explains the
components of the future scenario traffic volumes:

The future scenario LOS therefore includes traffic from the following sources:
1. Existing 2004 traffic volumes, plus
2. Background growth of 1 % per year between 2004 and 2008, plus
3. Traffic volumes from the development of adjacent (and currently undeveloped) parcels to
occur between 2004 and 2008, plus
4. Traffic volumes from the development of the Village of West Clay (originally proposed and
updated)
PI~ase consider the traffic that can be expected to generate for each use for delivery of goods or
services.
Trip generation calculations were prepared according to the Institute of Transportation Engineers Trip
Generation Manua12. The Manual is prepared using actual traffic generation data from sites of various
types around the country. The data is broken down by land use, then by size of that land use or some
other factor that would realate to traffic generation such as number of employees, number of acres, etc.
Since the data is taken from actual counts at actual sites, it includes not only personal vehicles making
trips, but also delivery vehicles, garbage trucks, utility trucks, etc. The trip generation for the PM peak
hour of the Specialy Retail land use, for example, is estimated using a linear equation fitted to data
obtained from 69 existing centers. The curve fits the data with a O.98R2 value, meaning that 98% of the
variance in the number of trips produced for this land use in this time period is accounted for by the

well. Weare confident that the resulting trip generation for the Village is the best information avilable
and includes all traffic generated by the site, passenger cars and commercial trucks.
Notwithstanding the confusing definitions, I do not see any count for any traffic that drives
specifically to the bank, or gas station, or fast food restaurant, or any other business established in
the Peripheral Commercial Area or Village Center. Isn't the whole point to establishing the
Peripheral Commercial Area to draw business from people in cars? Where are these trips counted
and projected?
Following is a breakdown of the trip generation calculations for the currently proposed site. The
shopping center listed at 131 st and Towne Road will account for the variety of commercial uses that may
be constructed at this location.

The internal capture rate was calculated according to the ITE Trip Generation Handbook procedures and
was applied only to residential and Village Commercial volumes. Newest reseach into Multi-Use
developments finds that sites of similar size and composition to the Village of West Clay may have
internal capture rates as high as 30 to 40% and pass-by rates averaging 28%. Our more conservative
approach did not apply any pass-by trips to the Village itself and used a 19% internal capture rate.

Dear Members,
I am writing to you today to ask that you take a very careful look at the Brenwick proposal on the Clay
West project.
As you know this was a very contentious issue with the public when it was approved. As I recall it
was even denied by the Plan Commission after their due diligence but was approvep by the then City
Council.
There were many hours of deliberation and many concessions made on both sides as the Plan
Commission worked very hard to make sure that if Clay West was ever to become a reality it would
be the best it could be even though it was felt that it was a great project on the wrong parcel.
Brenwick was given every thing that was negotiated at the final hearing, they even wrote the
ordinance themselves to make sure it was worded to their satisfaction. They have made this their own
personal project exactly as they wanted it to be given the allowances for the public. Brenwick returned
to the Pan Conl111ission in 2002 and some of their request were denied, they are now returning to you
and asking for the same things again.
Now Brenwick returns to the Plan Commission to again alter their ordinance. I ask that you complete
your due diligence on this request especially in the following areas.
. There should be no expansion of commercial or retail to the approved ordinance
. The original density bonus was far toopennissive and should not grow
. A gas/service station has been denied on every repeated request by the petitioner
. Review of changes to this PUD must remain a part of your purview and not be subjugated to
DOCS
I would ask tllat you seriously consider these items and again deny the petitioners request.

I am writing to express my concerns regarding the recently filed petitions referred to as docket
numbers 04060036 Z & 04060035 OA, regarding the Village of West Clay re-zoning requests.
I was in attendance at the meeting held on August 17~ 2004 and have reviewed the infonnation
provided by Brenwick at www.brenwick.cOl11 regarding their proposed development. I have also
spol{en with George Sweet of Brenwick regarding this proposal.
As a lot owner at Lalces at Hayden Run whose property will adjoin the proposed addition to West Clay
at the northwest corner of Towne Rd. and 131 st street, I was disappointed to see the plans indicating
such a high concentration of commercial use. When my husband and I purchased our home, we
understood that thIs lot was zoned as residential (8-1) and felt secure in our purchase. I feel that if this
area were now developed for any type of commercial use, it would decrease the value of our property
and home due to the increased noise and light, as well as added traffic so close to our home.
While I applaud Brenwick for the high quality, aesthetically pleasing development at the Village of
West Clay, I cannot help btlt feel as though they are trying to "unload" the more traffic intensive and
therefore unpleasant aspects of their development to another area, instead of placing these buildings
within the main Village where they would not be a nuisance to surrounding communities. I
understand that they are trying to buffer this proposed commercial area with homes directly adjacent to
our neighborhood, but I don't feel that rows of homes 7 deep will keep me from noticing a grocery
store loading dock when I look out the window from my second story bedroom.
I respectfully ask you to consider the full impact on the community if this comer is allowed to be re-
zoned for commercial use. Currently, part of what secures the property values in West Cannel is the
fact that there are no large commercial developments in the area. A commercial area of this size will
change that altogether, no matter how beautifully it is developed.
If the board does approve this proposal, I respectfully request that, as a minimum, you consider
requiring the mature tree line that separates the Lakes at Hayden Run properties from the 30 acres at
the northwest comer of Towne Road and 131 st, be left intact to help buffer the view and noise as best
as is possible from our subdivision.

We are writing in opposition to the rezoning request, filed by Brenwick 1ND
Communities with Carmel Plan Commission regarding the 30 acres of currently
residential property, locate,d at tije North-West corner of Towne Road and 131-st Street.
Our concerns are as follows:
1. The close proximity of commercial properties will diminish the value of our
residential properties.
2. It will create an unsafe environment for our children and families.
3. Increased traffic ( including heavy delivery tracks) will increase pollution and
noise levels in the area and traffic congestion on ajasent streets.
4. Expensive boutiques proposed to be built on the said property will not solve the
problem with the lack of shopping centers in the area.
5. I~ despite our oppositio~ the rezoning request is granted, we strongly insist on
Brenwick's erecting a solid brick or stone wall at least eight (8) feet high between
the proposed development and The Lakes At Hayden Run.

We have reviewed the plans submitted for this project and offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
. Streets and Right of Way - City of Carmel.
. Water - Indianapolis Water Company Service Area and Carmel Utilities
· Sanitary Sewers - Clay Township Regional Waste District Service Area
o Storm SewerslDrainage - Hamilton County Surveyor's Office (City of Carmel review).
· Regulated! Legal Drains - Hamilton County Surveyor's Office.
3. Board of Public Works and Safety Requirements:
. Temporary Construction Entrance if app1icable~
· Please he advised that any open cuts of dedicated streets will require separate Board of Public Works
and Safety approvaL
· Any permanent improvement (including irrigation systems) to be installed within dedicated right of way
or dedicated easements. This approval would require a Consent to Encroach Agreement between the

. 'It does not appear that 131 st Street is being uniformly widened across the boundary. Will 126th, 131 st
and Towne be widened across all fro'ntages? The City normally requests this if the street does not meet
current standards. The City needs to review the improvements on Towne, 131 st and 126th with the
Developer.
. ,Any provision for left-turn on Towne, 131 st and 131 st Streets? Please dimension accel/decel tapers.
· Traffic has to move very far over coming south on Towne. Need to shift over north of 131 st.
· ,Please provide a cross-section for Towne, 126th and 131 st for review of conformance to City Cross-

We have reviewed the amended primary plat submitted to the Hamilton County Surveyor's
Offioe on June 21, 2004 for this project and have the following comments:
1. The proposed project falls in the jurisdiction of the City of Carmel
2, The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. This project(s) will be a Hamilton County Regulated Drain Subdivision.
4. The proposed project.falls in the J.W. Brendle Regulated Drain Watershed, which
has an allowable release tate of 0.24 cfs per acre.
s. The Hamilton County Drainage Board has approved a complete study of the J.W.
Brendle Regulated Drain, which will serve many functions but most importantly,
will design the required reconstruotion of the existing ditch. It was previously
agreed in the early stages ofVOWC that Brenwiok would complete the
reconstruction of a portion of the regulated drain when the development started
west of Towne Road. Brenwick will. still be expected to contribute to this
reconstruction but the scope will be determined in the near futme.

The following are preliminary comments on the Village of West ClayPUD modifications:
A 01 JS
Peripheral Retail Area - Buildin,g Elevations:
1. Please provide a copy of the "Village of WestClay Building Guidelines and
Requirements" as proposed. Specific attention shall be paid to the Peripheral Retail
Area. (i.e. what we see is what we get) This area is much more visible to the general
public than areas within the Primary Area (MU). The lack of ADLS review by the
Plan Commission may be a hurdle. I think this can be overcome by additional detail
in the building guidelines or providing for ADLS approval in the ordinance. I may
even suggest ADLS Amendment review. This would be a two-week review window
as opposed to full ADLS (45-60 days).
2. I suggest adding proposed elevations into an appendix of the design guidelines.
3. It is difficult to get a grasp of the building elevations without some feel for signage.
Please produce some renderings with signage for review by the Commission.
Peripheral Retail Area -Site layout:
4. The Department would prefer a site layout that placed the buildings closer to the
primary road rights-of-way and provided parking in the rear or to the side of the
buildings. The Plan as presented provides little in the way of a streetscape and more
the appearance of multiple building placed within a parking lot.
5. Fewer drive cut onto the interior street would increase the pedestrian scale of the
project 'and reduce conflicts.
6. Please provide a detail of how pedestrians access the site. It looks as though they will
be battling cars most of the way. This needs to be looked at closer.
7. It would be better to provide some structure to terminate the view as one turns in off
of Towne Road, possible modifying the building layout.

Peripheral Retail Area - Signage:
8. The Department will not support three (75) seventy-five square foot ground signs for
the uses within this area. The maximum we will support is six (6) foot tall and 30
square feet of sign area on walls to match parking lot screens, one at each entrance.
This area would be limited to the name ofthe Center (WestC1ayUp Town).
9. One ground sign is identified on the plan with no representation of what it looks like.
10. Provide us with some samples of art deco or art modeme sign types. Typical face lit
channe11etter signs as seen in the US 421 Overlay do not appear to compliment the
proposed development.
11. Please note that the frontage for the Supermarket is measured from the interior street
rights-of-way, not 131 st and Towne Road.
12. I would suggest making an allowance for a ground sign for the fueling station.
Peripheral Retail Area - Landscaping:
13. The Landscape Plan needs to be improved with perimeter shrub p1antings as wells as
reference to the "D" buffer yard as opposed to the "A" level. Interior and perimeter
parking lot landscaping needs to be addressed on the Landscape Plan.
Ordinance Amendments:
14. For Section 8.8 DOCS is not in support of allowing sidewalk displays within the
Peripheral Retail Area.
15. Section 8.13 of the PUD Ordinance states that buildings within the Peripheral Retail
Area shall be designed in conformance with the Peripheral Retail Area Design
Guidelines. Is this something other that the language contained within the specific
building requirements of the "Village of WestC1ay Building Guidelines and
Requirements"? I am trying to bridge the gap between pretty pictures and something
we can specifically rely on for the elevations.
16. Amend section 14.4 to provide for bike racks in the Peripheral Retail Area.
17. There needs to be a rear setback from the alley in 15 .1.D. Three feet suggested.
18. Why is rear or side yard garage deleted? Front loading garages would not be in
keeping with the PUD. Please revise all sections.
19. Is Apartment House the language that would regulate the Senior Housing proposal?
Why so many changes to this section if not.
20. Section lS.8.1.D calls out yard dimensions. Js the front intended to be the build to
line? This should be made more clear.
21. Per section 16.5 and notes above front loading garages are not preferred.
22. Per 16.14 the landscaping in the Peripheral Retail Area shall conform to the
Landscape Plan. The "Landscape Plan" is not sufficient as noted earlier. To many
changes can be made to the overall plan to allow a plan to regulate the development.
Standards need to be in place.
23. Sections 18.3.1 and 18.4.B need modification if Department support is desired.
Comments noted above.
24. Modify section 19.14 to allow wood only to be used for gates to enclosure.
25. More detail needs to be provided and required to make the Department comfortable
with section 25.1 regarding the senior housing and Peripheral Retail Area.

Overall the proposed plan fits well within the framework of the Village. However there are areas
where the Department needs further clarification of the proposal and request modifications to the
proposed language. I look forward to working with Brenwick in refining the plan to bring it
closer to the vision the City has for a neighborhood commercial component addressed in the
Comprehensive Plan.
