MOTION CARRIED UNANIMOUSLY Department Report: Alexia Donahue Wold o Items 1 and 2, Greyhound Commons— Signage, has been tabled o Items 4, Kruse Accessory Building will need Suspension of Rules for public notice in newspaper printed one day late o Items 5 and 6, Tom Wood Parking Lot and Day Drive Access, Department recommends tabling o Petitioner accepted tabling Legal Report: John Molitor o Oral argument for pending litigation Bowen/Barnett matter will be November 20, 1:30 p.m. in Superior Court in Noblesville o Board members are welcome to attend o Zeff Weiss represents the Barnetts and will sit with BZA ® Supports BZA Board's decision to deny variance to Bowens Motion: On a motion made by James Hawkins and seconded by Alan Potasnik: To suspend the rules for the Kruse Accessory Building. MOTION CARRIED UNANIMOUSLY 1-2. TABLED Indefinitely (V) Greyhound Commons—Signage. The applicant seeks the following development standards variance approvals: Docket No. 12070014 V PUD Z-344, Section 11.3 (C) (1): Number of signs (2 additional proposed, 1 existing allowed) Docket No. 12070015 V PUD Z-344, Section 11.3 (C) (3): Ground sign height (20 +/- proposed, 10' allowed). The site is located at 14480 Lowes Way. It is zoned PUD/Planned Unit Development. Filed by Joy Skidmore of Kite Realty Group. 3. (V) Olive Garden,EIFS/Stucco. The applicant seeks the following development standards variance approval: Docket No. 12090012 V ZO CH. 23C.09K.2.e EIFS not to exceed 10%. The site is located at 10206 N. Michigan Rd and is zoned I-1/Industrial within the Michigan Rd. Overlay Zone. Filed by Janet Reid of GHA Architecture/Development on behalf of Jack DeGagne for GMRI, Inc. Present for the Petitioner: Jack DeGagne, Darden Restaurants, Orlando, FL • Brought exhibit of EIFS/Stucco • During Plan Commission and BZA process, timing of notification for EIFS/Stucco material required another variance • Tile roof and architectural look have been approved o Elevations with stucco material were shown • In agreement with Findings of Fact Public Hearing closed Department Report: Alexia Donahue Wold • Building has received Development Plan and ADLS approval as well as a couple of variances for tile roof material and additional signage • Variance from the Michigan Road Overlay Zone for amount of EIFS (stucco-looking) material exceeding 10 percent of overall building façade o Plan Commission requested EIFS instead of original proposal to meet the architectural style of Ordinance o Petitioner has made several changes and worked with the Department and Plan Commission Department recommended approval of the variance. The applicant seeks the following development standards variance approval: Docket No. 12090015 V ZO CH 25.01.01.B.5 Max Ground Floor Area 24' X 30' (30' X 38' requested). The site is located at 10256 Niman Ct. and is zoned S-2/Residential. Filed by Tim Kruse, owner. Present for the Petitioner: Tim Kruse ® Like to build accessory building for personal belongings o Variance is for size, 30 feet by 38 feet building o Currently spends over$2,000 per year for storage unit o Items exceed 24 feet by 30 feet accessory building limit in City Code ® Map shown of area and location of building in back yard o Plat drawings with and without easements o Drawings of building elevations Public Hearing closed Department Report: Alexia Donahue Wold o Site is single-family residence with existing attached garage e Variance for detached garage larger than allowed by Ordinance o Ordinance limits detached garage to 720 square feet o Located to rear of property and complimentary to architecture of existing home o Will meet zoning requirements for height and setbacks o Location and design will limit any negative affect on adjacent properties Department recommended approval of Variance. Discussion: o Proposed driveway will be two to four feet from neighbor's driveway o Grass or drainage area o Neighbors aware it will be near side door entrance to their garage o Primarily storage,no commercial use o Useable second floor used for storage o Not planning to use for rental space o Any future use to turn it into rental space would require building permits ® Parcel is single family residential ▪ Building permits would be denied for bathroom, kitchen, etc. O Subdivision does not have any rules against the building being constructed; no homeowners' association Public—Favorable: John Rowland, next door neighbor to north o Any improvements Mr. Kruse has done to property have been very professional and aesthetically pleasing o Does not feel it will harm any property values; be asset to neighborhood Page 3 of 4 �u, Carmel Board of Zoning Appeals October 22,2012 Motion: On a motion made by James Hawkins and seconded by Earlene Plavchak: Docket No. 12090015 V, Kruse Accessory Building, be approved, for maximum ground floor area (24' x 30' permitted, 30' x 38' requested). MOTION CARRIED UNANIMOUSLY 5. TABLED (UV) Tom Wood Parking Lot, Day Drive. The applicant seeks the following use variance approval for a surface parking lot on a residentially zoned property: Docket No. 12080016 UV ZO Ch. 6.01.01 Permitted Uses. The site is located at 9624 Day Dr. It is zoned S-2/Residence. Filed by Paul Reis of Krieg DeVault for Tom Wood, Inc. 6. TABLED (CA) Tom Wood, Day Drive Access. Docket No. 12080017 CA. The applicant seeks approval to amend a commitment made in 1969 as a part of the Special Exception for an auto dealership, to allow access to Day Drive. The site is located at 3130 E. 96th Street. It is zoned B-3/Business within the Keystone Overlay Zone. Filed by Paul Reis of Krieg DeVault for Tom Wood, Inc. New Business: • Discussion regarding 2013 BZA calendar o October meeting proposed for fourth Tuesday, October 29, 2013, to allow for Council Budget hearings o Rules state meetings will be on fourth Monday o Fourth Tuesday is usually City Council Land Use Committee meeting in Caucus Rooms Motion: On a motion made by Alan Potasnik and seconded by Ephraim Wilfong: Suspend the Rules and change the October 28,2013 meeting for BZA to Tuesday, October 29, 2013. MOTION CARRIED UNANIMOUSLY Action: Revised calendar will be provided, amending filing deadlines. January and May Tuesday meetings had been approved previously.
