Specialty Risk International Petitioner seeks the following development standards variance approval: Docket No. 05040001 V Chapter 17.04.03.02 side yard setback The site is located immediately west of 501 Congressional Blvd and is zoned B6/Business. Filed by Elizabeth Hobbs of Krieg DeVault for Specialty Risk International. General Info: The petitioner would like to encroach approximately 12-ft into the eastern side yard setback of 60- ft to place a corporate headquarters office building. Analysis: The parcel that the proposed building will sit on is short in width and long in depth, and a 60-ft side yard setback is required (for. all uses other than residential) on both sides to the lot. These parameters pose a challenge when trying to place an office building. A parking lot exists to the west of the site, where the variance is being sought for the western side yard setback. Findings of Fact: sideyard setback 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: placing a building on a narrow lot with the building will only encroach 12-ft into the side yard setback of 60-ft; allowing for a 48-ft side yard setback, instead of 60-ft. 2.) The use and value of the area adjacent to the p~operty included in the variance will not be affected in a substantially adverse manner beca~se: placing a building on a narrow lot with the buildiqg will only encroach 12-ft into the side yard setback of 60- ft; allowing for a 48- ft side yard setb~ck, instead of 60- ft. 3.) The strict application of the terms of the Zoninlg Ordinance to the property will result in practical difficulties in the use of the property bfcause: The building will have to be modified to fit on the ~ot, which is short in width. The building will then encroach into both side yards if oriented parallel to the streets. Recommendation: The Department recommends positive consideration of Docket No. 05040001 V.
