FINDINGS OF FACT ( in the neaative) - USE VARIANCE
1. The grant of this variance wiUbe contrary to the public interest, due to the existen"ce of special
condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship
because:
The changing of this property from"a residence use into an office use will allow business uses to creep into
a well-established residential neighborhood, affecting quality of life."

The changing of this property from a residence use into an office use will allow business uses to creep into
a well-established residential neighborhood, affecting quality of life. Areas of concern are increased traffic,
building/property upkeep, and negative property values.
3. The use or value of the a"rea adjacent to the subject property will be substantially affected in any
adverse manner because:
The changing of this property from a residence use into an office use will allow business uses to creep into
a well~established residential neighborhood, affecting quality of life.
4. The need for the variance does not arise from a natural condition peculiar to the subject property
because:
This property is a residential lot with a house on it. It is not any different than the other residential lots along
Haverstick Rd, with the same square footage.
5. The granting of this variance does substantially interfere with the Carmel/Clay Comprehensive Plan
because:
This residential neighborhood is seen as an informal boundary to stop the spread of low intensity
employment areas from Keystone and 96th Street. The Comprehensive Plan Land Use map shows this. Day
Road, to the east of Haverstick Rd, is shown as the boundary b'etween residyntial and commercial uses.
DECISION
IT )S THEREFORE the decision of the Carmel Board of Zoning Appeals that Use Variance Docket No. 05020030 UV is
denied, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and
made a part hereof.
