Architectural Design, Lighting, Landscaping and Signage Amendment (ADLS Amend) for the property located at 3210

APPROVED: The Department approved the exterior signage plans as submitted.

Per the request of your counsel made in a letter dated September 17, 2001, pertaining to
the matter listed above, I am issuing this corrected Letter of Grant.
At the meeting held July 23, 2001, the Carmel/Clay Board of Zoning Appeals took the
following action regarding petitions filed by Charles D. Frankenberger of Nelson & Frankenberger
on behalf of Dan Young Chevrolet:
APPROVED: Docket No. V- 77-01, a petition to vary Section 25.7.01 -2: Definitions - Traffic
Directional Sign of the Sign Ordinance in order to establish an 18.58- square -foot Traffic Directional
Sign (Identified as Sign #5 on Sheet L -1 under Tab 3 of the Board's informational packet). The
Board voted four (4) in favor, zero (0) opposed, thereby approving the petition.
APPROVED: Docket No. V- 78 -01, a petition to vary Section 25.701 -2: Definitions - Traffic
Directional Sign of the Sign Ordinance in order to permit a 4' 10" Traffic Directional Sign

APPROVED with Commitments: Docket No. V- 85 -01, a petition to vary Section 25.7.01 -4(i)
of the Sign Ordinance in order to permit an Identification Sign to encroach into the East 96h
Street 75 -foot half right -of -way (Identified as Complex Sign on Sheet L-1 under Tab 3 of the
Board's informational packet). The Board voted four (4) in favor, zero (0) opposed, thereby
approving the petition with the following Commitment, which is to be rendered in writing by
your attorney and submitted to the Board's attorney for review prior to recording:
• If at any time in the future the sign is required to be moved, the relocation of the sign will be
accomplished at the property owner's expense, and the City or any successor unit of
government will not be held in any way liable.
APPROVED: Docket No. V- 86 -01, a petition to vary Section 25.7.02 -7(b): Number & Type of the
Sign Ordinance in order to establish nine (9) Identification Signs on site. The Board voted four (4)
in favor, zero (0) opposed, thereby approving the petition.
APPROVED as amended: Docket No. V- 87 -01, a petition to vary Section 25.7.02- 7(c)(ii):
Maximum Sign Area of the Sign Ordinance in order to permit a 104 - square -foot Identification
Sign on the south end of the west fagade of the main building. The Board voted four (4) in favor,
zero (0) opposed, thereby approving the petition.
APPROVED as amended: Docket No. V- 88 -01, a petition to vary Section 25.7.02- 7(c)(ii):
Maximum Sign Area of the Sign Ordinance in order to permit a 104 - square -foot Identification
Sign on the west end of the south fagade of the main building. The Board voted four (4) in favor,
zero (0) opposed, thereby approving the petition.

Maximum Sign Area of the Sign Ordinance in order to permit a 122.4 -square-foot Identification
Sign on the south facade of the south (certified, pre - owned) building. The Board voted four (4)
in favor, zero (0) opposed, thereby approving the petition.
Once recorded, forward two (2) copies of the Commitments to this Department for
inclusion in the file. The Division of Planning & Zoning will not release the property for sign
permitting until this aspect of the Board's approval has been satisfied.
When applying for Sign Permits for this structure, please include a copy of this letter with
your application materials in order to assist the Department's review.
