You were gracious in hearing out the community and thorough in asking questions. I look forward to a special study being done in order to plan for a positive transition in our community if that is to be. I will begin initiating this immediately. I think it is important for you to know "after the fact" that Mr. Monroe chose not to. meet with us. I could hardly believe how he tried to mislead you about meeting with the neighbors. It Was very apparent he didn't want anyone, especially me, to know what was happening. Jon Dobosiewicz told me after the meeting that he had strongly recommended Mark caJI me three months ago and that he chose not to. I have been the coordinator for. Wild Cherry Comer and surrounding communities for over ten years and Mark knew that. I only found out about this on Wednesday evening of last week and called him Thursday morning leaving a message that I had some questions I would like to ask him. I called again Friday since he had not returned my call. I did reach him and asked him several straight-forward questions. He was very defensive and accused me of being on a "fishing expedition" and made the statement, "This is how you always approach things." He became increasingly adversarial until I told him it would be best if we not continue the discussion. and that we would see each other Monday night. His response was, "So you want vengeance?" I have no idea what he was talking about with any of his statements. Again, thank you for listening and hearing our issues. April 25, 2005 Members of the Carmel-Clay Board of Zoning Appeals The Department of Community Service I would like to begin by clarifying several important issues which directly relate to this petition. (Please refer to map and the Carmel-Clay Comprehensive Plan the Comp Plan.) Error was acknowledged in first draft, showing Haverstick being the line of demarcation for commercial and office development instead of Day Drive. This error was corrected to show Day Drive as the line of demarcation. Two residences west of Day Drive on 96th Street had already received Special Use Variance, that of Hahn Engineers and the dental office. These residential properties were to be maintained as such and have continued to be in compliance, even when applying for the addition by the dental office. The underlying zoning remains S-2, low density residential. This is the reason Paragus development did not apply for a rezone but rather a variance, in keeping with the Comprehensive Plan and underlying zoning of S-2. (please note letter from Gary Ritz of Paragus.) As an adiacent landowner, the "no objection" was not a supportive response but rather just that, no objection. Paragus has been a model of how to work with the whole community in which it is located and not just the adiacent landowners. As you can see by the map, we have serious re-development and re-zoning issues. Wild Cheny Corner is an oasis set in the middle of these issues. Please consider the -"quality of life" reflected in the pictures provided. We do not want to be surrounded by re-development without long- range planning. Granting this petition would complicate any long-range planning, which as you have already heard, it desperately needed. I request this petition be denied with a recommendation that a Special Study be done before any further decisions are made in keeping with the Comprehensive Plan. First, I urge you to reject the application for a use variance and developmental standards variances for the property at 9639 N. Haversticl{ Road. I live nearby. My family has lived in this neighborhood for the past 16 years. My mother once resided here, and my father-in-law and mother-in-law have recently purchased their home one block west of the applicant's and plan to move in this summer to be with us. I Simply put, we are invested in this neighborhood, too. Please do not jeopardize our quality of life by granting these variances. Residents frequently cite a lack of adequate infrastnlcture. Traffic, noise and lighting issues are ongoing in situations such as ours. We desperately do not wish to become the Castleton of tomorrow. The 96th and Keystone intersection is still rated as one of the worst in all of Indiana, and gridlock and backups occur regularly along 96th Street. Right now, our buffer begins along Day Drive. This application is for along Haverstick Road (west of Day Drive) and thus threatens that buffer. Secondly, I hope that the City of Carmel will fund a long-term land use study for this area. Requests like this one have come up repeatedly. Some, we have supported where they made more sense. Over the past eight years, we frequently asked that a long-range land use study for this area be funded as recommended in the Comprehensive Plan. So far, we have had no success. We continue to recommend a course of slowed growth and maintaining the buffer zones until such a study is funded and completed. We honestly feel that the renewed interests of developers come at a time when our neighborhood is exceedingly vulnerable and lacking representation. We, ourselves, find it difficult to make informed decision in light of th~absence of an updated land use study. We spent approximately 15 months working with the neighbors and with the City of Carmel prior to obtaining our final approvals. As a part of our final approval, we were required to provide landscaped buffer areas along the residential properties to our east, west and north property lines. The east and west buffering is either 30-feet or 40- feet in width and the north buffer is 1 00- feet in width. We believe the landscaping buffering requirements were due to our location being west of Day Drive. I would like to see some additional plantings along the back (east side) where the neighboring parcel has an office building right behind this property. A combination of some evergreens and ornamentals would h'elp screen the future parking behind 9639 Haverstick, a level "B" perhaps, and just a commitment to replace any large trees that succumb.
